PUBLIC HEARING - NORTH AREA SEWER AND WATER IMPROVEMENT PROJECT 73-1.
January 15, 1973. PLEASANT ACRES SECOND ADDITION
The Mayor opened the Continuation of the Public Hearing on the
North Area Sewer and Water Improvement Project 73-1. The following
members of the Village Council were present: Mayor Klingelhutz,
Councilmen Bennyhoff, Kurvers, Neils and Wolf.
PERSONS PRESENT: James Hardy, Terry Dwyer, Dale Collins, Mrs. W.R.
Schram, Vernon Peterson, Willard Johnson, Shirley Johnson, Lee R.
Anderson.
The Village Engineer explained his updated Feasibility Study dated
January 12, 1973.
Some of the people present objected to the proposed project completely.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Wolf to adjourn the Public Hearing. The following voted in favor
thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils
and Wolf. MotiDn carried.

CHANHASSEN VILLAGE COUNCIL MINUTES - January 15, 1973.
The regular .Chanhassen Village Council meeting on January 15, 1973
at 8:45 p.m., was held in the Chanhassen Village Hall and opened with
the Pledge to the Flag. The following people were present: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf.
VILLAGE COUNCIL MINUTES: A motion was made by Councilman Wolf and
seconded by Councilman Neils to except the Council minutes of the
December 18, 1972 meeting after adding to Resolution #1218721, Public
Hearing 73-1, January 8,1973 at 7:30 p.m. and under Gas Bids adding
to the County's Bid to read 25.3 and 23.5 which were rejected and
accept the bid from Minnesota Victoria Oil for 22.22 on gas and
13.5 on No.2 fuel. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No
negative votes. Motion carried.
Amotion was made by Councilman Wolf and seconded by Councilman Benny-
hoff to approve the minutes of the December 26, 1972 meeting. The
following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried.
A motion was made by Councilman Kurvers and seconded by Councilman
Neils to approve the minutes of the January 8, 1973 meeting. The
following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion
carried.

COMMITTEE MEETING: A motion was made by Councilman Wolf and seconded
by Councilman Neils to hold a committee meeting Monday, January 22, 1973
at 7:00 p.m. The following voted in favor thereof: Mayor Klingelhutz,
Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes.
Motion carried.

PARK AND RECREATION MINUTES: A motion was made by Councilman Wolf and
seconded by Councilman Kurvers that the Park and Recreation Commission
minutes of December 19, 1972 be noted and read. The following voted
in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers,
Neils and Wolf. No negative votes. Motion carried.
PLANNING COMMISSION MINUTES: A motion was made by Councilman Neils
and seconded by Councilman Bennyhoff that the Planning Commission
minutes of December 19, 1972 be noted and read. The following voted
in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers,
Neils and Wolf. No negative votes. Motion carried.
A motion was made by Councilman Kurvers and seconded by Councilman
Wolf that the Public Hearing Minutes of December 19, 1972 on the
Western Hills Second Addition be noted and read. The following voted
in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers,
Neils and Wolf. No negative votes. Motion carried.
A motion was made by Councilman Wolf and seconded by Councilman Kurvers I
that the Public Hearing Minutes of December 19, 1972 on the Sunrise
Hills Fourth Addition be noted and read. The following voted in
favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils
and Wolf. No negative votes. Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Kurvers that the Public Hearing minutes of December 19, 1972 on the
Burdick Plat be noted and read. The following voted in favor thereof:
Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. NO
negative votes. Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Neils that the Planning Commission minutes of January 9, 1973 be
noted and read. The following voted in favor thereof: Mayor Klingelhutz,
Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes.
Motion carried.
ROBERT SOMERS: A motion was made by Councilman Neils and seconded by
Councilman Wolf to deny a Conditional Use Permit to Robert Somers for
a boat house and to have Mr. Somers remove the partially erected building
by June 1, 1973. He may have a 30 day extension if necessary. The
following voted in favor thereof: Mayor Klingelhutz, Councilmen Kurvers,
Neils and Wolf. Councilman Bennyhoff voted no. Motion carried.
MEADOWS CAR WASH: A motion was made by Councilman Neils and seconded I
by Councilman Bennyhoff to table any action on the Meadows Car Wash.
The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motinn carried.

BOARD OF ADJUSTMENTS AND APPEALS: A motion was made by Councilman Neils
and seconded by Councilman Bennyhoff to grant a 6 foot variance from
Ordinance No. 47 to John Phillips on Lot 1 "Block 1 Highland,Second
Addition to preserve the trees, prevent erosion and preserve the
beauty of the land. The following voted in favor thereof:' Mayor
K1inge1hutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No
negative votes. Motion carried.
INDUSTRIAL COMMISSION: A motion was made by Councilman Kurvers and
seccnded by Councilman Bennyhoff that the Industrial Commission minutes
of December 13, 1972 be noted and read. The following voted in
favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers,
Neils and Wolf. No negative votes. Moticn carried.
PLANNING COMMISSION: A motion was made by Councilman Wolf and sec-
onded by Councilman Bennyhoff that Tim Stone be appointed to the
Planning Commission for the balance of a one year term expiring
December 31, 1973. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No
nègative votes. MotiDn carried.
PARK AND RECREATION COMMISSION: A motion was made by Councilman
Neils and seconded by Councilman Wolf that the following persons
be appointed to the Park and Recreation Commission:

RESCUE TRUCK BIDS CaN'T: A motion was made by Councilman Bennyhoff
and seconded by Councilman Kurvers to except the low bid from Waconia
Ford for $5,911.00. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative
votes. Motion carried.
PLEASANT ACRES SECOND ADDITION: A motion was made by Councilman Bennyhoff
and seconded by Councilman Neils to submit the Preliminary Plans of
the Pleasant Acres Second Addition Sewer Project to the Minnehaha
Water Shed District. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative
votes. Motion carried.
BUILDING REMODELING: Frank Kurvers gave a report on the remodeling of
the" Village Hall and Tim Stone explained the two Sketch Plan Concepts.
A discussion followed.
Councilman Kurvers requested that the Councilmen be polled for Concept
approval. Councilmen Bennyhoff, Neils and Wolf are in favor of the
offices upstairs and Mayor Klingelhutz, and Councilman Kurvers are in
favor of the qi£ices downstairs. They stated that the Fire Department
should review this further. The Fire Chief will take it to the Fire Dept.
and submit a report to the Council as soon as possible. '
ORDINANCE 3-C: A motion was made by Councilman Bennyhoff and seconded
by Councilman Wolf to adopt Ordinance 3-C entitled An Ordinance
Amending Ordinance No.3-A, Regulating the Use of Streets and Highways
Within the Village of Chanhassen. The following voted in favor
thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and
Wolf. No negative votes. Motinn carried.
METROPOLITAN SEWER BOARD: There was a discussion on the letter received
regarding the first phase of the Lake Ann Interceptor.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Neils to adjourn the meeting. The following voted in favor thereof:
Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No
negative votes. Motion carried.
