PUBLIC HEARING MINUTES - ASSESSMENT HEARING FOR THE CARVER BEACH ROAD
IMPROVEMENT PROJECT 72-3 April 2, 1973
The Mayor opened the Assessment Hearing for the Carver Beach Road
Improvement Project 72-3. The following members of the Village Council
were present: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and
Wolf.
PERSONS PRESENT: Ann C. Staggs, Fred Wagner, C.D. Hickman, D.B. Berkey,
Gerry W. Maker, John F. Johnson, William V. Moreno, Herb DeVaan, Mr.
and Mrs. Len Dusoski, Mr. and Mrs. Willard Johnson, Mrs. Ida Johnson.
The Administrator read the official notice of the Assessment Hearing.
Mr. Hickman asked about future home building in this area. He felt these
people should have to pay $30.00 because they would benefit from
the road. Mr. Hickman felt $30.00 was a reasonable assessment for each
resident.
The paYments of $30.00 per resident are due prior to September 10, 1973.
After this time the amount will be $30.00 plus 8% interest which will
be added to the taxes.
A motion was made by Councilman Kurvers and seconded by Councilman
Bennyhoff to adjourn the Assessment Hearing. The following voted in
favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and
Wolf. No negative votes. Motion carried.

CHANHASSEN VILLAGE COUNCIL MINUTES - April 2, 1973
The regular Chanhassen Village Council meeting was called to order on
April 2, 1973 at 8:00 p.m. in the Chanhassen Village Hall and was
opened with the Pledge to the Flag. The following members were present:
Mayor Klingelhutz, Councilmen Bennypoff, Kurvers and Wolf. Councilman
Neils was absent.
VILLAGE COUNCIL MINUTES: A motion was made by Councilman Bennyhoff and
seconded by Councilman Wolf to approve the minutes of the Village Council
meeting of March 19, 1973. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers, and Wolf. No negative votes.
Motion carried.
PLANNING COMMISSION MINUTES: A motion was made by Councilman Kurvers
and seconded by Councilman Wolf that the Planning Commission minutes
of March 27, 1973 be noted and read. The following voted in favor thereof:
Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Wolf. No negative
votes. Motion carried.
PARK AND RECREATION COMMISSION MINUTES: A motion was made by Councilman
Wolf and seconded by Councilman Kurvers that the Park and Recreation

1973 be noted and read. The following voted in favor thereof:
Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Wolf. No negative
votes. Motion carried.
Councilman Neils entered the meeting.
MINNESOTA RECREATION PARK ASSOCIATION: A motion was made by Councilman
Wolf and seconded by Councilman Kurvers to approve joining the
Minnesota Recreation Park Association paying the fee of $25.00. The
following voted in favor thereof: Mayor Klingelhutz, Councilman Benny-
hoff, Kurvers, Neils and Wolf. No negative votes. Motion carried.
MINNETONKA-EXCELSIOR HISTORICAL SOCIETY: A motiDn was made by Councilman
Wolf and seconded by Councilman Bennyhoff to approve the membership fee
of $3.00 to the Minnetonka Excelsior Historical Society for Gail Wolf.
The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers, Neils, and Wolf. No negative votes. Motion carried.
LION'S CLUB: A motiDn was made by Councilman Wolf and seconded by
Councilman Kurvers to approve the Lion's Club donation of a shelter to
either Carver Beaah or Chanhassen Estates Park. The Park and Recreation
Commission will make the final decision of which sitè. The following
voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers,
Neils and Wolf. No negative votes. Motion carried.
PUBLIC HEARING - PROJECT 72-3: A motion was made by Councilman Benny-
hoff and seconded by Councilman Wolf to approve the Assessment Roles
on Project 72-3. The following voted in favor thereof: Mayor Klingel-
hutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes.

A motion was made by Councilman Wolf and seconded by Councilman Kurvers
to add $30.00 to a Building Permit in the Carver Beach Area for 72-3
road improvement until the temporary road is phased out. The following
voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers,
Neils and Wolf. No negative votes. Motion carried.
LIQUOR LICENSES: Upon reviewing the following applications a motion
was made by Councilman Wolf and seconded by Councilman Neils to approve
the following Liquor License applications for the year beginning May 1,
1973 to and including April 30, 1974:

BURNING PERMIT REQUESTS: The Administrator reported that the Village has
been put on N.S.P.'s waiting list for a used Chipper. Discussion followed.
A motion was made by Councilman Kurvers and seconded by Councilman Benny-
hoff to allow the University of Minnesota Research Center a Burning
Permit to burn the 3rd week of April, 1973, providing they meet all
P.C.A. requirements. The Fire Chief should attend the site at various
times during the burning. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff and Kurvers. Councilmen Neils and
Wolf voted.no. Motion carried.
A motion was made by Councilman Neils and seconded by Councilman Bennyhoff
to deny Mrs. Woodbury Andrews a request for a burning permit. The follow-
ing voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff,
Kurvers, Neils and Wolf. No negative votes. Motion carried.
A motion was made by Councilman Kurvers and seconded by Councilman Wolf
to delay action on a decision for a burning permit to Mr. Ben Gowen and
make a special request to the P.C.A. and wait for their ruling. The
following voted in favor thereof: Councilmen Kurvers and Wolf. Mayor
Klingelhutz, Councilman Bennyhoff and Neils voted no. Motion defeated.

BURNING PERMITS, CON'T: A motion was made by Councilman Bennyhoff and
seconded by Mayor Klingelhutz for approval of a burning permit to I
Mr. Ben Gowen if the P.C.A. gives approval. The following voted in
favor thereof: Mayor Klingelhutz and Councilman Bennyhoff. Council-
men Kurvers,iTeils and Wolf voted no. Motion defeated.
RENAISSANCE FAIR: Barbara Rork, Gary Meyer and Larry Vickery were pre-
sent to ask for Council approval to hold the Renaissance Fair in Chan-
hassen. The site selected would be between Highways 17 and 117 South
of State Highway i. The Police Chief felt there would be no unusual
problems with the traffic.
A motion was made by Councilman Neils and seconded by Councilman Wolf
to grant permission to the Environmental Entertainment Enterprises to
have the Minnesota Renaissance Fair in Chanhassen providing an alterna-
tive parking lot is available in the event of bad weather. This will
be co-ordinated through the Police Dept. The following voted in favor
thereof:' 'Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and
Wolf. No negative votes. Motion carried.
BOARD OF ADJUSTMENTS AND APPEALS: A motion was made by Counéilman
Kurvers and seconded by Councilman Bennyhoff to grant a variance on
Ordinance No. 47, Section 7.05 Subsection 2 - Front yard Regulations,
to John Havlik to build a garage on the West side of his house. The
following voted in favor thereof: Mayor Klingelhutz, Councilmen Benny-
hoff, Kurvers, Neils and Wolf. No negative votes. Motion carried.

ROAD ACCESS PERMIT: Mr. Ralph Ratliff was present requesting an
easement to his property located to the West of Powers Blvd. and
South of Lilac Lane in the Twin Hills Farm area.
A motion was made by Councilman Neils and seconded by Councilman Wolf
to grant a tempora~easement access across Village Property to serve
one home. The Village will not maintain this driveway. The following
voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers,
Neils and Wolf. No negative votes. Motion carried.
BUESGENS OFFICE BUILDING: Mrs. Robert Buesgens was present to answer
questions on the proposed building.
A motion was made by Councilman Wolf and seconded by Councilman Kurvers
to approve the building permit for a structure 80 ft. x 110 ft. to
Robert Buesgens per recommendations of the Planning Commission minutes
of March 27, 1973. The following voted in favor thereof: Mayor Kling-
elhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative
votes. Motion carried.
MINNEWASHTA CREEK TOWNHOUSES AND ESTATES PROPOSAL: Orlan Narr, Jim
Rydeen, Bruce Carlson, Don Berkey and Don Anderson were present. There
was a discussion on ideas the Council would like to see in the proposed
area.

MINNWEASHTA CREEK TOWNHOUSES AND ESTATES PROPOSAL, CON'T: ,rezoning
subject to the following recommendations:
l. A 12 Ft. wide walk way area between Lots 7 and 8 that could
be used for emergency vehicles if needed.
2. The Townhouse streets be private.
3. Outlot includeds access rights for the total Development.
4. Slip lanes to be placed on Minnesota State Highway 7 based
on Minnesota State Highway Dept. recommendations with the
total cost being accessed to the developer.
The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers, Neils and Wolf~ No negative votes. Motion carried.
CBD: John Neveaux was present to answe~ any questions on the CBD Concept.
A motion was made by Councilman Neils and seconded by Councilman Wolf
to adopt the land use plan as revised on March 27, 1973 and approve the
rezoning amendment to Zoning Ordinance No. 47 on the CBD, to be drawn up
by the Village Attorney, and the Council will establish an action
Committee to study the following problems:
1. Parking
2. Traffic
3. CBD Design Action Committee
The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Kurvers, Neils and Wolf. Councilman Bennyhoff was out of the room.
No negative votes. Motion carried.

76TH STREET AND GREAT PLAINS BLVD: A motion was made by Councilman Neils
and seconded by Councilman Wolf to hold a Public Hearing on April 23, 1973
at 8:00 p.m. for Street Improvements on Great Plains Blvd. from Chan
View to the dead end and 76th St. from Iroquois to Great Plains BLvd.
The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried.
WESTERN HILLS 2ND ADDITION AND SUNRISE HILLS 4th ADDITION: A motion was
made by Councilman Neils and seconded by Councilman Wolf to authorize the
advertising for bids on Sewer and Water in Western Hills 2nd Addition and
Sunrise Hills 4th Addition. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Neils, Kurvers, and Wolf. No negative
votes. Motion carried.
LAKE ANN PARK: A motion was made by Councilman WaIf and seconded by
Councilman Neils to open Lake Ann Park April 3, 1973 using the sa~e hours
as last year. The following voted in favor thereof: Mayor Klingelhutz,
Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Carried.
A motion was made by Councilman Bennyhoff and seconded by Councilman Neils
to adjourn the meeting. The following voted in favor thereof: Mayor Kling-
elhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes.
