1973 04 16 ~ I I II CHANHASSEN VILLAGE COUNCIL MINUTES - April 16, 1973 -1- The regular Chanhassen Village Council meeting was called to order on April 16, 1973 at 8:00 p.m. in the Chanhassen Village Hall and was opened with the Pledge to the Flag. The following members were present: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. VILLAGE COUNCIL MINUTES: A motion was made by Couneilman Bennyhoff and seconded by Councilman Neils to approve the minutes of the April 2, 1973 meeting. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. PUBLIC HEARING MINUTES: A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf to approve the Public Hearing minutes for the Carver Beach Road Improvement Project 72-3, on April 2, 1973. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. PLANNING COMMISSION MINUTES: A motion was made by Councilman Kurvers and seconded by Councilman Bennyhoff that the Planning Commission minutes of April 10, 1973 be noted and read. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers Neils and Wolf. No negative votes. Motion carried. PARK AND RECREATION COMMISSION MINUTES: A motion 'was made by Councilman Wolf and seconded by Councilman Kurvers that the Park and Recreation Commission minutes of April 3, 1973 be noted and read. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes.' Motion carried. PAY BILLS: A motion was made by Councilman Bennyhoff and seconded by Councilman Neils to approve the bills as submitted. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes.~ Motion carried. APPOINTMENT TO THE BOARD OF ADJUSTMENTS AND APPEALS: A motinn was made by Councilman Bennyhoff and seconded by Councilman Neils to appoint Nick Waritz to the Board of Adjustments and Appeals as per the recommendation of the Planning Commission. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. STANDARD OIL CAR WASH BUILDING: W.B. Housenga from Standard Oil presented a proposal to add a car wash building to the Standard Oil 'Station. A motion was made by Councilman Neils and seconded by Councilman Bennyhoff to grant preliminary approval to a car wash building requiring the exterior of the building to co-ordinate with the exterior of the existing building and final approval contingent on landscaping plans. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. '- ~ CHANHASSEN VILLAGE COUNCIL MINUTES - April 16, 1973 -2- STANDARD OIL CAR WASH BUILDING PERMIT APPLICATION: A motion was made I', by Councilman Kurvers and seconded by Councilman Neils that Standard Oil be required to pay three Metropolitan SAC unit charges at $275.00 per unit, three Chanhassen Sewer unit charges at $320:00 per unit~ a~d three Chanhassen Water unit charges at $380.00 per unlt on the bUlldlng permit application. The following voted in fa~or thereof: Mayor . Klingelhutz, Councilmen Bennyhoff, Kurvers, Nells and Wolf. No negatlve votes. Motion carried. RESIDENTIAL SEWER AND WATER CONNECTION: Richard Dutcher from Minnewashta Heights presented a petition to change the Village Ordinance which deals with residential sewer and water hook up. Discussion followed. No action will be taken until additional proposals and data are presented on April 23, 1973. LES BRIDGER - NO PARKING SIGNS: Les Bridger asked the Village to amend the Traffic Ordinance and post no parking signs on Vogelsberg Trail, Lakota Lane and Mandaff. No action will be taken until April 23, 1973, at which time the residents of that area will present a petition to the Village Council. KENYON KENNEL PERMIT APPLICATION: A motion was made by Councilman Neils and seconded by Councilman Bennyhoff to grant a permit to Kenyon I Kennels. The following voted in favor thereof: Mayor Klingelhutz, , Councilman Bennyhoff, Neils and Wolf. Councilman Kurver~ was on a fire call. No negative votes. Motion carried. ACTION ON PUD'S: A motion was made by Councilman Bennyhoff and seconded by Councilman Neils that if no further action is taken on Gabbert and Biersdorf's PUD's within 30 days the Village will hold a Public Hearing to rezone the land. The following voted in favor thereof: Mayor Klingel- hutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. BURDICK PARK ADDITION: A motion was made by Councilman Bennyhoff and seconded by Councilman Kurvers to approve the final plat of the Burdick Park Addition authorizing the Mayor and Administrator to sign the hard shell after the Village Engineer has reviewed the plat. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. A motinn was made by Councilman Bennyhoff and seconded by Councilman Wolf to approve the rezoning of the Burdick ~roperty of Lots 1,2 and 3 of Block Ii Lots 1 and 2 of Block 3 zoned to C3 and Lots 1,2,3,4 and 5 of Block 2 zoned to I-I. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. SAC CHARGES: A motion was made by Coun~ilman Wolf and seconded by Councilman Neils to approve the concept~of the SAC Charges and authorize ,; .' . The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. VICTORIA SEWER AND WATER AGREEMENT: A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff to approve resolution No. 416731 entitled Chanhassen-Victoria Sanitary Sewer and Water Service Agreement, County Road 15 area, after changing Section 5.10, Three year termination provision for cause. The following voted in favor thereof:Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. NSA STATUS REPORT: The Village Attorney gave a Status report on the NSA and presented plans and costs on 7l-E - Red Cedar Point including Victoria. Anticipated costs of the entire North Service Area are as follows: $725,000.00 18,900.00 77,000.00 629,100.00 Total Construction Cost Victoria Costs Carver County Costs Chanhassen Costs The total project will cost $795,811.00 including Construction Costs, Administrative, Attorney and Engineering fees. A motion was made by Councilman Kurvers and seconded by Councilman Bennyhoff to authorize Resolution 416732 to advertize for bids on May 10, 1973 for 71-E - Red Cedar Point including Victoria. The fol- lowing voted in favor thereof: Mayor Klingelhutz, Councilmen Benny- hoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. FEASIBILITY STUDY - LAKE SUSAN: The Village Engineer presented a Fea- sîbility Study on Lake Susan. No action was taken until a more detailed study is presented to the Village Council. SUMMER EMPLOYMENT: A motion was made by Councilman Bennyhoff and seconded by Councilman Neils to hire Karen Sernett as Senior instructor and life- guard at the rate of $3.50 per hour. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Kurvers and seconded by Councilman Benny- hoff to hire Mark Bielski as Park Maintenance Helper at the rate of $3.00 per hour. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion Carried. INDUSTRIAL COMMISSION RESOLUTION: A motion was made by Councilman Kurvers and seconded by Councilman Wolf to approve Resolution No. 416733 entitled Consideration of Municipal Industrial Revenue Bonds. The follôwing voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilmen aennyhoff and seconded by Councilman Neils to adjourn the meeting.
