PUBLIC HEARING MINUTES - STREET IMPROVEMENT PROJECT 73-4, GREAT PLAINS
BLVD. AND WEST 76th STREET - April 23, 1973.
The Mayor opened the Public Hearing for the Great Plains Blvd. and
West 76th Street Improvement Project 73-4 at 8:00 p.m. in the Chanhassen
Village Hall. The following members of the Village Council were present:
Mayor Klingelhutz, Councilmen Bennyhoff and Kurvers. Councilmen Neils
and Wolf were absent.
PERSONS PRESENT: W. Robertson, Frances Jacques, Walter Hanson, Ray
Knott, William Bongard, Roger Bongard, Mrs. Wm. H. Bongard, Elroy
Williams, Jeanette Knott, S. Thompson, Al Sklzacek, George Benick,
Richard E. Berg, Eugene Coulter, Harry Pauly, Gayle Wolff, Gordon E.
Freeburg, Jacquelin Freeburg, Mary Ann Geving, Dale Geving, Nicholas
Johnson, Richard Mingo.
The Administrator read thec£ficial notice of the Public Hearing.
Frank Laska, the Village Engineer, gave a report on the exact location
and the way the roads will be improved. Great Plains Blvd. and West
76th St. will be 28 feet wide. The estimated cost of the project
will be $22,000.00, $8.25 per lineal foot.
Councilman Neils entered the meeting.
Elroy Williams questioned disturbing the dirt around the water main
at the new road and Santa Fe.
Russ Larson, the Village Attorney reported that except for the section
over the Richard Mingo and Emil Pauly property. The improvements on
West 76th St. and Great Plains Blvd. are ·within Village limits. He
will attempt to get an easement from Mr. & Mrs. Pauly and Mr. and
Mrs. Mingo.
Henry Wrase stated that the Village has always maintained this road.
Eugene Coulter asked for a Traffic Count on these roads. He felt it
was a needed project but objected to the method of assessment. He also
wanted to know how outlots will be assessed. Mr. Coulter was told a
unit basis rather than frontage footage would be considered.
J. Geving asked if it would be cheaper to do a large number of streets
than just these two. The Engineer stated the cost could possibly be
slightlybwer. Mr. Geving asked how corner lots would be assessed. He
made a proposal to the Council which was to take ~ of front, ~ of side
yard footage and total them. Then take ~ of the total and use that for
assessing corner lots.
Gayle Wolff questioned the purpose of the project. He also said he
felt the Village should be complimented on how they have maintained
the roads.
W. Robertson asked about the types of bases used on this road. It will
be a 4~ " base and 2" in deep asphalt strength.
F. Jacques asked about the illegal trucks using the road.

Nick Johnson asked what it will cost to put it in reasonable driving
condition. The Village Engineer said around $4.00 or $5.00 a foot
for upgrading and some asphalt. The VillageEngineer also stated that
a 7 Ton road should be adequate.

A question was asked to those present of who actually wanted the road
improvement. Thirteen were against it, 4 in favor of it and the rest
were in question about it.
A motion was made by Councilman Neils and seconded by Councilman Kurvers
to adjourn the Public Hearing. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers, and Neils. No negative votes.
Motion carried.

The Special Chanhassen Village Council meeting was called to order on
April 23, 1973 at 9:35 p.m. in the Chanhassen Village Hall. The following

VOLUNTEER FIRE DEPT. INSURANCE: A motiDn was made by Councilman Bennyhoff
and seconded by Councilman Neils to accept this medical disability Insurance
proposal from Schneider Agency, Inc. paid annually and a guaranteed price
for three years.

RESIDENTIAL SEWER AND WATER CONNECTION: Richard Dutcher was present to
read and explain his findings from other Municipalities. Of the
seven master plumbers he contacted, none were interested. He felt one
common thing among all municipalities was proper testing after installa-
tion and recoarse by the Village or city if something goes wrong.
The Village Attorney will propose a draft amending our present Sewer
and Water Ordinance.
LES BRIDGER - NO PARKING SIGNS: Les Bridger presented a petition to
the Council with all homeowners signatures on these streets.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Neils to put up no parking signs as requested on April 16, 1973 located
by legal description, with a written report from the Police Dept. as
to the reason for the No Parking Signs being put up. The following
voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers
and Neils. No negative votes. Motion carried.
BURNING PERMIT REQUEST: A motion was made by Councilman Bennyhoff and
seconded by Mayor Klingelhutz to approve a Burning Permit for Bud
Wudlick. The following voted in favor thereof: Mayor Klingelhutz, and
Councilman Bennyhoff. Councilman Kurvers and Neils voted no. Motion
defeated.
PARK AND RECREATION SUPERVISION: A motion was made by Counci~man Benny-
hoff and seconded by Councilman Neils to pay Ron Mielke $90.00 and
Robert Downs $135.00 for Park and Recreation Supervision. The following
voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff,
Kurvers, and Neils. No negative votes. Motion carried.
DUMP TRUCK: A motion was made DV Councilman Bennyhoff and seconded by
Councilman Kurvers to authorize payment to Waconia Ford of $4151.55
out of the General Fund, $2,500.00 would be paid out of the budget and
$1,651.55 which would be paid out of the budget. A security agreement
and a financial statement will be set up with the State Bank of Chanhassen
in the amount of $5,000.00, $2,500.00 + interest payable July 1, 1974 and
$2,500.00 + interest which will be payable July 1, 1975. The following
voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers
and Neils. No negative votes. Motion carried.
BUILDING WORKSHOP: A motion was made by Councilman Bennyhoff and sec-
onded by Councilman Neils to approve paying $25.00 + expenses for Bill
Ballhorn to attend a 3 day Building Inspection WorkshOp at Morris, MN.
The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers and Neils. No negative votes. Motion carried.
KENNEL PERMIT: A motion was made by Councilman Bennyhoff and seconded
by Councilman Kurvers to grant a Kennel permit to John Malakowsky.

Bennyhoff, Kurvers and Neils. No negative votes. Motion carried.

BURDICK PARK ADDITION: A motion was made by Councilman Bennyhoff and I
seconded by Councilman Kurvers to accept Change Order No. 1 on \
improvement Project No. 72-2 in the amount of $23,480.00. The following
voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff,
Kurvers and Wolf. No negative votes. Motion carried.
PROJECT 71-1F: A motion was made by Councilman Bennyhoff and seconded
by Councilman Kurvers to approve payment for easements on parcels 4
and 5 on Project 7l-1F. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers and Neils. No negative votes.

Councilman Kurvers to advertize for an additional person for the Utility
Dept. The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers and Wolf. No negative votes. Motion carried.

PLUMBING INSPECTOR: A motion was made by Councilman Kurvers and seconded
by Councilman Bennyhoff to increase the fee paid to Hubert Forcier to
$8.50 per inspection. The following voted in favor thereof: Mayor Klingel-

carried.
