1973 05 14 I I I CHANHASSEN VILLAGE COUNCIL MINUTES - May 14, 1973 -1- The special Chanhassen Village Council meeting was called to order on May 14, 1973 at 8:00 p.m. in the Chanhassen Village Hall by Mayor Al Klingelhutz and was opened with the Pledge to the Flag. The following members of the Village Council were present: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. COUNCIL MINUTES: A motion was made by Councilman Neils and seconded by Councilman Kurvers to approve the May 7, 1973 minutes after the following amendments: Page 3, Valley Rich Co. should be $63,858.30 using PVC pipe, Page 4 under Lake Susan, Mayor Klingelhutz abstained from voting and under change order for the water tower $2,540.00 should be the deduction. The following voted inmvor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. Council Minutes: A motion was made by Councilman Neils and seconded by .Councilman Kurvers to approve the minutes of May 8, 1973 after the fol- lowing amendment is made on page one under Neils, it should read - Would we consider the posistion for someone in the exsisting Village Hall. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. PLANNING COMMISSION MINUTES: A motion was made by Councilman Neils and seconded by Councilman Wolf that the Planning Commission minutes of May 8, 1973 be noted and read. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Kurvers and seconded by Councilman Benny- hoff that the Public Hearing minutes for a Conditional Use Permit for B.M.T., Inc. - Light Industrial use of May 8, 1973 bemted and read. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff that the Public Hearing minutes for a Conditional Use Permit for Nancy DeMun Wenzel - Riding Stables on May 8, 1973 be noted and read. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. HUMAN RIGHTS COMMISSION MINUTES: A motion was made by Councilman Neils and seconded by Councilman Bennyhoff that the Human Rights Commission minutes of May 5, 1973 bemted and read. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. N.S.A. BONDS: Phil Chenawith, Financial Consultant, was present to explain the resolution to sell bonds for the N.S.A. .A motinn was made by Councilman Kurvers and seconded by Councilman Bennyhoff to approve Resolution No. 514731 entitled A Resolution Authorizin~ the Issuance and Providing for the Public Sale of $1,650,000 Improvement Bonds. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. CHANHASSEN VILLAGE COUNCIL MINUTES - May 14, 1973 -2- FRONTIER DINNER THEATRE: Permit. Mr. Bloomberg was present to ask for a Building A motion was made by Councilman Neils and seconded by Councilman Bennyhoff to grant a building permit for an addition to the Frontier Dinner Theatre. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. STREET IMPROVEMENT PROJECT 73-4: Frank Laska, Village Engineer, reported on street conditions in the Village. CORNER LOTS: A motion was made by Councilman Bennyhoff and seconded by Councilman Neils to assess corner lots 100% on front footage abutting the street and 50% of footage on side yards abutting the street. The following voted in favor thereof: Councilmen Bennyhoff, Kurvers, Neils and Wolf. Mayor Klingelhutz voted no. Motion carried. APARTMENTS: A motion was made by Councilman Bennyhoff and seconded by Councilman Neils to assess Apartments 50% per unit X footage. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. Highland Court I has been previously assessed on front lots. CUL-DE-SAC: A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf to assess persons that have no direct footage on road projects but use the road for ingress and egress should be assessed on the basis of the average front footage assessed to the single family within the total project. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. The Council request a legal opinion from the Village attorney on 'properties that have front footage on one street but have possibilities in future to have front footage on another street project. ASSESSMENT HEARING: A motion was made by Councilman Neils and seconded by Councilman Wolf to set the assessment Hearing for 73-4 Street Improvement Project for June 4, 1973 at 9:00 p.m. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. All property owners for Project 73-4 will receive a copy of the policies set up before the Assessment Hearing. Henry Wrase will set up a Street Improvement schedule for future street improvements and present them to the Village Council. SEWER ASSESSMENT POLICY: Adolph Tessness gave a report on a basic policy for Assessments on sewer and water. A discussion followed. A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff to instruct the Engineer to begin preparing the basic assessment roles for the N.S.A., but the assessment formula will come later. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. - ! i j ! I I -I I I 14- CHANHASSEN VILLAGE COUNCIL MINUTES - May', 1973 -3- I RILEY-PURGATORY CREEK WATERSHED DISTRICT: Arnold Weimerskirch will notify someone from the Park and Recreation Commission to attend the Riley Purgatory Creek Watershed District tour on May 20, 1973. Councilman Neils will be attending a tour on June 2, 1973 on the Carver Soil and Water District. TRUCKS: A motion was made by Councilman Neils and seconded by Councilman Wolf to authorize truck No. 101 to be put in the County Auction on May 23, 1973. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Neils seconded by Counèilman Kurvers to authorize payments on the four wheel drive pick up truck purchased from Waconia Dodge for $3,915.00 with $1,800.00 as down payment with the balance to be paid on a Security Agreement with the State Bank of Chanhassen, payable on July 1, 1974 in the amount of $1,115.00 plus interest and another payment in the amount of $1,000.00 plus interest due on July 1, 1975. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. I BUILDING INSPECTOR'S EXAM: A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf to authorize payment of $20.00 for Bill Ballhorn to take the Stàte Building Inspector's exam. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried.
