The regular Chanhassen Village Council meeting was called to order on
May 21, 1973 at 8:00 p.m. in the Chanhassen Village Hall by Mayor Al
Klingelhutz, and was opened with the Pledge to the Flag. The following
members of the Village Council were present: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers and Neils. Councilman Wolf was absent.
COUNCIL MINUTES: A motion was made by Councilman Bennyhoff and seconded
by Councilman Kurvers to approve the minutes after the following amendments:
on Page 2 under Assessment Hearing, it should read as follows: A policy
was set for assessing all future street improvement projects. The
residents affected by Street Improvement Project 73-4 will receive a
letter explaining this new policy and they will have until June 4, 1973
at 9:00 p.m. to reply by mail, commenting on the new policy. The following
voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers
and Neils. No negative votes. Motion carried.
PAY BILLS: A motion was made by Councilman Bennyhoff and seconded by
Councilman Kurvers to approve the bills as submitted. The following voted
in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and
Neils. No negative votes. Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Councilman Neils
to pay Lane Minnesota $7,085.25 for work done on Well No.3. The following
voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers
and Neils. No negative votes. Motion carried.

VACATION: A motinn was made by Councilman Bennyhoff and seconded by
Councilman Neils to pay Adolph Tessness 18 days of accrued vacation from
1968 and 1969 at the rate of pay upon termination date, May 15,1973. The
following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff,
Kurvers and Neils. No negative votes. Motion carried.
A motion was made by Councilman Kurvers and seconded by Councilman Bennyhoff
that the Village Personnel Policy be amended by adding thereto: All
employees shall submit detailed time records to the Village Treasurer
bi-monthly showing hours worked, sick leave and vacation time taken.
The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers and Neils. No negative votes. Motion carried.
PROSPECTUS: A motion was made by Councilman Bennyhoff and seconded by
Councilman Kurvers to approve the Prospectus of Chanhassen as per changes.
The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers and Neils. No negative votes. Motion carried.
DORN SEWER ASSESSMENT: A motion was made by Councilman Bennyhoff and
seconded by Councilman Kurvers to set June 18, 1973 at 7:30 p.m. for an
Assessment Hearing on 71-4 Dorn Sewer and Water Project. The following
voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers
and Neils. No negative votes. Motion carried.

DOG COMPLAINT: Bruce Wirtz was present to complain about the dog problems
in this neighborhood. It was suggested that he sign a complaint in the
Carver County Courthouse.

WARREN JENKE - TRAILER: A motion was made by Councilman Bennyhoff and
seconded by Councilman Neils to approve a trailer house to be moved into
Chanhassen for 30 days (May 14, 1973 to June 15, 1973) to Warren Jenke.
The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers and Neils. No negative votes. Motion carried.

NEWSLETTER: Gail Stone presented the Newsletter.
A motion was made by Councilman Neils and seconded by Councilman Bennyhoff
to approve the Village Newsletter as per corrections. The following voted
in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and
Neils. No negative votes. Motion carried.
GABBERT AND GABBERT PROPERTIES: Warren Beck from Gabbert and Gabbert
presented a status report on the properties they own. The Council requested
a written report on the discussion tonight and future plans of the land.
A motion was made by Councilman Bennyhoff and seconded by Councilman Kurvers
to extend the zoning of the Gabbert and Gabbert properties for one more
year, until the next reviewal. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers and Neils. No negative votes.
Motion carried.
BEIERSDORF PROPERTIES: Ken Beiersdorf was present to explain what has
transpired through the property he owns. He was asked to send the Village I
Council a written report on the discussion held tonight and future plans
of the land.
A motion was made by Councilman Bennyhoff and seconded by Councilman Kurvers
to extend the PUD zoning for one more year until the next reviewal. The
following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff,
Kurvers and Wolf. No negative votes. Motion carried.
SUMMER RECREATION EMPLOYMENT: A motion was made by Councilman Bennyhoff
and seconded by Councilman Neils to have Arnie Weimerskirch proceed with
hiring of the following individuals for Summer Recreation:
Program -Swimming - Assistant Instructor; Age 19 and over - 40 hr. week
1 at $2.25 per hour.
Life Guard - Age 19 and over - 40 hr. week at $2.00 per hour
Arts & Crafts and T-Ball - Vicki Dorsey - $3.00 per hour and
6 hours a day
Assistant for Vicki Dorsey - $2.00 per hour, 5 hours per day
Age 18 and over.
Maintenance Helper - Age 16 and over - up to 100 hours
$1. 50/hr.
The following voted in favor thereof:
Kurvers and Neils. No negative votes.
Mayor Klingelhutz, Councilmen Bennyhoff,
Motion carried.
TWIN HILL PCA REPORT: The Village Council requests that a member of the
PCA come out and give reports on all lakes and Watershed Districts in
Chanhassen. The Council would like them to explain the findings and
give suggestions and help form guidelines.

TWIN HILLS, CON'T: A motion was made by Councilman Neils and seconded
by Councilman Kurvers that the PCA report of May 9, 1973 on Twin Hills
be noted. The following voted in favor thereof: Mayor Klingelhutz,
Councilmen Bennyhoff, Kurvers and Neils. No negative votes. Motion carried.

A letter from the Village Engineer dated May 18, 1973 recommended to accept
the low bid from Minn-Kota Excavating, Inc. in the amount of $657,314.50
using PVC plastic pipe.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Neils to approve Resolution No. 521731 entitled Accepting the low bid
from Minn-Kota Excavating, Co. in the amount of $657,314.50. The following
voted in favorthereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers,
and Neils. No negative votes. Motion carried.
NSP RATE STUDY: Gene Coulter was present and explained the proposal
from the Metro Rate Authority.
A motion was made by Mayor Klingelhutz and seconded by Councilman Neils
to adopt an ordinance of the Uniform Franchise of the Metro Rate Authority.
The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff and Neils. Councilman Kurvers abstained from voting because
he is employed by NSP. No negative votes. Motion carried.
A motion was made by Councilman Kurvers and seconded by Councilman Benny-
hoff to appoint Gene Coulter to serve as a representative of Chanhassen on
the Metro Rate Authority. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers and Neils. No negative votes.
Motion carried.

The Village Council commends Mr. Coulter for his dedication on this proj ect.
VILLAGE CLERK APPOINTMENT: A motion was made,by Councilman Neils and
seconded by Councilman Bennyhoff to appoint Gerald W. Schlenk as Village
Clerk. The following voted in favor thereof: Mayor Klingelhutz, Council-
men Bennyhoff, Kurvers and Neils. No negative votes. Motion carried.

SWEDLUND DUMP: A motion was made by Councilman Neils and seconded by
Councilman Bennyhoff for the Village Attorney to send a letter to the
owners of Swedlund Dump and give them a 30 day notice to clean up the
property or the Village will have it assessed against the property.
The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers and Neils. No negative votes. Motion carried.

TRANSPORTATION: A motion was made by Councilman Bennyhoff and seconded
by Councilman Neils not to support the Transportation study group in
Carver County because the Council feels there should be more co-ordination
between the study groups and the study should be more complete and save
more money. The fullowing voted in favor thereof: Mayor Klingelhutz,
Councilmen Bennyhoff, Kurvers and Neils. No negative votes. Motion
carried.
COLONIALSHOPPING CENTER: The Village will write a letter to the owner
of the Colonial Shopping Center asking them to repair the parking lot.
POSTED ROADS: A motion was made by Councilman Kurvers and seconded by
Councilman Bennyhoff to post all 7 ton roads in the Village at 5 tons
and all 9 ton roads to 7 ton roads during the Spring of the year. The
following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff,
Kurvers and Neils. No negative votes. Motion carried.
AMENDING ZONING ORDINANCE: A motion was made by Councilman Kurvers and I
seconded by Councilman Neils to amend the zoning ordinance for land-
scaping Building sites. After the property has been landscaped the
property owner should maintain continual growth of plants one year
after planting. The following voted in favor thereof: Mayor Klingelhutz,
Councilmen Bennyhoff, Kurvers, Neils. No negative votes. Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Neils to adjourn the meeting. The following voted in favor thereof:
Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Neils. No negative
votes. Motion carried.
