1973 06 18 CHANHASSEN VILLAGE COUNCIL MINUTES - June 18, 1973 -1- I The regular Chanhassen Village Council meeting was called to order on June 18, 1973 at 8:00 p.m. in the Chanhassen Village Hall and was opened with the Pledge to the Flag. The following members were present: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. Councilman Kurvers was absent. VILLAGE COUNCIL MINUTES: A motion was made by Councilman Bennyhoff and seconded by Councilman Neils to approve the minutes of June 4, 1973 after the following corrections are made: Under Lake Susan Sewer Project, Mayor Klingelhutz did not vote. Under Sewer line in Sunrise Ridge, easements are to be acquired from Robert Buesgens and Mr. & Mrs. F.D. Scott in Sunrise Ridge and Frank Moltan is to be contacted regarding the matter of a proposed assessment for the acquisition of the easement and the installation of the line. The Planning Commission minutes should add the following names to the motion on the CBD Committee: Action Committee recommendations are Steve Wolf, Jim Mielke, John Havlik, Ed Dunn, Tom Klingelhutz, Harry Pauly, Bernard Schneider, Al Klingelhutz. Architecture and Design Sub- committee should add the following persons: Tim Stone, Dan Herbst, Jerry Yanisch, Elmer Aagard, Ann Koltyk, Anne NEils. The Traffic and Parking Sub-committee should add, Arnie Ryba, Francis Klein, Frank Kurvers and Adolph Tessness. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. I PUBLIC HEARING MINUTES: A motion was made by Councilman Bennyhoff to approve the Public Hearing minutes on Lake Susan Sanitary Sewer Improvement Project 73-7 of June 4, 1973, after the following statement is omitted from Paragraph 8: Al Klingelhutz Farm is zoned Residential I-A in the future. The following voted in favor thereof: Mayor Klingelhutz, Council- men Bennyhoff, Neils and Wolf. No negative votes. Motion carried. VILLAGE COUNCIL MINUTES: A motion was made by Councilman Neils 'and seconded by Councilman Bennyhoff to approve the minutes of the Sp~çtal Council minutes of June 7, 1973. The following voted in favor thereof: Councilman Bennyhoff, Neils and Wolf. Mayor Klingelhutz:abstained from voting. No negative votes. Motion carried. PARK AND RECREATION MINUTES: A motion was made by Councilman Neils and seconded by Councilman Bennyhoff that the Park and Recreation Commission minutes of June 5, 1973 be noted and read. The followng voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Wolf and seconded by Councilman Neils to reject the motion made by the Park and Recreation Commission concerning Cathcart Field in the June 5, 1973 minutes. The following voted in favor thereof: MaYor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. I PLANNING COMMISSION MINUTES: A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff that the Planning Commission minutes of June 12, 1973 be noted and read. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. CHANHASSEN VILLAGE COUNCIL MINUTES - June 18, 1973 -2- PUBLIC HEARING MINUTES: A motion was made by Councilman Neils and seconded I by Councilman Bennyhoff that the Public Hearing minutes for Lowell Carlson on June 12, 1973 be noted and read. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf that the Public Hearing minutes on Moon Valley Rifle Range and Gravel pit be noted and read. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Neils and seconded by Councilman Bennyhoff that the first part of the Public Hearing minutes on Woodhill Subdivision be noted and read. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. HUMAN RIGHTS COMMISSION MINUTES: A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff that the Human Rights Commission minutes of June 9, 1973 be noted and read. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. PAY BILLS: A motion was made by Councilman Wolf' and seconded by Councilman Bennyhoff to approve the bills as submitted except to disallow payment to Burroughs Corp. in the amount of $16,669.55 until the machine is in full operation. The following voted in favor thereof: Mayor Klingelhutz, I Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. ' The Village Attorney will take care of the legal matter regarding the $500. bill for the house wrecking. A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf to authorize the Village Attorney to try and collect the Railroad fire bill of approximately $3,000.00.The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf to pay Widmer Bros., Inc. $28,877.22 from Industrial Park Project 72-2. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Benny- hoff, Neils and Wolf. No negative votes. Motion carried. RESOLUTION FOR VILLAGE CHECKING ACCOUNT AND SAFETY DEPOSIT BOX: A motion was made by Councilman Bennyhoff and seconded by Councilman Neils to adopt the resolution for the State Bank of Chanhassen authorizing 3 signatures on the Village checks. These three would be Al Klingelhutz, Gerald W. Schlenk, Kay Klingelhutz. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. Schlenk. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. CHANHASSEN VILLAGE COUNCIL MINUTES - June 18, 1973 -3- MRS. RICHARD SCHMIDT: Mrs. Richard Schmidt presented pictures and plans for moving a house into the Village. I A motion was made by Councilman Wolf and seconded by Councilman Neils to allow Mrs. Richard Schmidt to move the home on Lot A in Bardwell Acres and complete landscaping within six months. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. LAKE SUSAN SEWER PROJECT 73-7: The Village Engineer reported on his letter dated June 18, 1973 on the proposed Sewer project. A discusssion followed. A motion was made by Councilman Wolf and seconded by Councilman Neils to defer action on Lake Susan Sewer Project 73-7 until a full Council meets or if a petition is presented before the full Council meets a special meeting could be called to make a decision. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. NSA AND LOT 9 MINNEWASHTA HEIGHTS: The Village Engineer reported letter of June 15, 1973 on the Trunk Water Line along Highway 7. updated his letter of June 15, 1973 on the North Chanhassen Sewer Water project costs. on his He also and I A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf to approve the contract amendment increase of $16,970.00 for the construc- tion of trunk water line along the East side of Highway 17. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion Carried. The Village Attorney reported on the letter of May 7, 1973 regarding Lot 9 Block 5 in Minnewashta Heights. A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff to hold a Public Hearing on July 9, 1973 at 7:30 p.m. regarding Public Improvement on Lot 9 Block 5 Minnewashta Heights. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. SEWER AND WATER INSTALLERS HOOK UP ORDINANCE: A motion was made by Council- man Wolf and seconded by Councilman Bennyhoff to adopt ordinance No. 53 providing for the licensing of Utility installers. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Neils and seconded by Councilman Wolf to provide a fee of $25.00 in section 4.02 of Ordinance No. 53 WITH a $5,000.00 Bond and Insurance consisting of $200,000.00 Bodily injury or death of anyone, $500,000.00 for bodily injury or death of two or more persons and at least $100,000.00 for property damage. Thefollowing voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. I CHANHASSEN VILLAGE COUNCIL MINUTES - June 18, 1973 -4- SEWER-ANB-WA~ER-INSTALLERS HOOK UP ORDINANCE, CON'T: A motion was made I by Councilman Bennyhoff and seconded by Councilman Wolf that new applica- tions of Utility Installers License before August 1, 1973 will be good until August 1, 1974. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. GENE REILLY - COLONIAL SHOPPING CENTER: Gene Reilly was present asking about turning the Colonial Shopping Center parking lot over to the Village. A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff to present this to the Traffic and Parking Sub-committee of the CBD for action as soon as possible and making a recommendation. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. CAR FIRE BILL: Robert Meyers was present to ask for a reduction or dispense with the fire bill of $94.50. A motion was made by Councilman Bennyhoff and seconded by Councilman Neils to reduce Robert Meyers car fire bill from $94.50 to $20.00 because of extenuating circumstances. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff and NEils. Councilman Wolf voted no. Motion carried. STREET IMPROVEMENT PROJECT 73-4: A motion was made by Councilman Wolf and seconded by Councilman Neils to authorize improvements and direct the Engineer to prepare final plans and specifications and advertise for bids on Street Imrpovement Project 73-4. The following voted in favor thereof: Mayor Klingelhut7, Counci!men Bennyhofff_ Neils and Wolf. No negative votes. Motion carried. Kl::Sou,! nON &/5' 3c)..., I COUNCIL MEETING: The Village Council will meet on June 19, 1973 at 7:00 p.m. to look at Lyman Blvd. and meet at the Village Hall at 7:30 p.m. in regards to hiring a new Administrator. UTILITY EMPLOYMENT: A motion was made by Councilman Wolf and seconded by Councilmen Neils to hire Ken Biberdorf in the Utility Dept. at $676.00 per month and a 5% increase after 6 mos. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion CB.rr ied . A motion was made by Councftman Neils and seconded by councilman Bennyhoff to have Jerry Schlenk to look into Plumbing school for Ken Biberdorf. A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff hire John Beckstrom as a part time summer helper in the Utility Dept. for $2.00 per hour. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. RAISE FOR JACK ERNST: A motion was made by Councilman Wolf and seconded by Councilman Neils to give Jack Ernst a 50¢ per hour increase in pay. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. STOP SIGNS: A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf to have a stop sign installed at 68th St. going on to Nez Pierce. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. TWIN HILLS PCA REPORT: The Village Attorney gave a report on Twin Hills Farm. He will write a letter to the PCA acknowledging the two reports that were sent to the Village about the Twin Hill Farms. VILLAGE HALL REMODELING: A motion was made by Councilman Bennyhoff and seconded by Councilman Neils to reject all bids submitted on the Village Hall remodeling. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. I TELEPHONE - LAKE ANN PARK: A motion was made by Councilman Wolf and sec- onded by Councilman Bennyhoff to have a telephone IDS taIled at Lake Ann Park. The following voted in favor thereof: Mayor Klingelhutz, Councilman Bennyhoff, Neils and Wolf. No negative votes. Motion carried. LAWN MOWER FOR PARKS: A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff to purchase a new Roof 60 inch demonstrator mower for $1,995.00 with a full written warranty. This should be put in the Park maintenance budget for 1974. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf to issue a warrant for payment of the new Roof 60 inch lawn mower. LOWELL CARLSON-PUBLIC HEARING: Lowell Carlson was present to ask the Council for a Conditional Use Permit for a structure 40 x 100 ft. on his property. A motion was made by Councilman Wolf and seconded by Councilman Neils to deny the request of a Conditional Use Permit as per Planning Commission minutes of June 12, 1973. The following voted in favor thereof: Mayor Kli~glehutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motlon carrled. I GEDNEY PROPERTY: A motion was made by Councilman Bennyhoff and seconded by Councilman Neils to authorize the Village Attorney and Councilman Wolf to meet with Chaska in regards to the Gedney property. CHANHASSEN VILLAGE COUNCIL MINUTES - June 18, 1973 -6- BOARD OF ADJUSTMENTS AND APPEALS: A motion was made by Councilman Wolf I and seconded by Councilman Bennyhoff to approve the variance to Ronald Schroer as per reqest and recommendation by the Board of Adjustments and Appeals on a side yard garage. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. OEO EMPLOYEE: A motion was made by Councilman Wolf and seconded by Council- man Bennyhoff to inform OEO that the Village will hire Dale Gregory on a full time basis starting August 31, 1973. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. MEETING: Mayor Klingelhutz will attend a meeting on Wednesday morning, June 20, 1973 at 8:00 a.m. in Norwood for the Carver County Safety Council.
