1973 07 09 I CHANHASSEN VILLAGE COUNCIL MINUTES - July 9, 1973 -1- PUBLIC HEARING - MIN~EWASHTA HEIGHTS STORM SEWER PROJECT 73-8 The Mayor openéd_ the Public Hearing for the MinnewashtaHeights Storm Sewer Project 73-8 at 7:30 p.m. in the Chanhassen Village Hall. The following members of the Village Councilm were present: Mayor Klingelhutz Councilmen Bennyhoff, Kurvers, Neils and Wolf. PERSONS PRESENT: F. Denton White, Jr., James E. Marr, Carl Fowler, -~-- ~;xçJ¡., Frank Beddor, Jr., Wilma Thompson, Fran Neveaux, John Neveaux, p~~üi~her, R.N. Dutcher, E.H. Hallenbach, Morris Mullin, L.J. Halbach, Merilyn Turner. The Village Attorney read the official notice of Public Hearing. The Village Engineer, Bill Brezinsky, explained the letter of May 7, 1973 regarding Lot 9 in Minnewashta Heights and explained the four alternatives of solutions solving the siltation and erosion problems on Lot 9. Mr. Marr asked if the pipe would just lay on the bottom of the Lake? The pipe would be layed 4 ft. below water level at the edge and extend out 175 feet at which point it will lay on the bottom of the lake. Mr. Marr asked if this digging would disturb the bottom? The Village Engineer 'felt this would not cause any problem. The Engineer stated after the Village authorizes the project, it still has to make application with the watershed district and conservation dept. He felt they would have no problems with this. I Mr. Dutcher asked what restoration would be done after the project is com- pleted? The asphalt will be removed on the lot and a roadway or walk way will be placed on the 18 foot driveway to the larger section of the lot. The rest of the lot will be graded but will not be repaved or sodded. Mr. Halback wondered about heavy rains causing gullies on the lake lot after the asphalt is removed. Mr. Neveaux felt that if the pipe is 175 feet long that about 40 feet of the pipe will be laying on the bottom of the lake. The Engineer will check this out. Mr. Hollenback would like to see the pipe on the boat side of the dock. Mr. Hollenback asked about a settlement of $1,500.00 which the Village would pay and the 80 Minnewashta Heights residents would pay the balance of $5,200.00. He felt all residents should help pay because the entire area would benefit. He also wanted to know how this would be assessed. Mayor Klingelhutz felt it was too difficult to tell how it would be assessed until the actual cost is known. I Mayor Kling~lhutz asked Bill Brezinsky how he can justify the fact on a report that the Village should pay $1,500.00 toward the project. Bill Brezinsky said he didn't report that that is what the Village should pay and it was only a suggestion in order to settle the easement on this project. He didn't know where the $1,500.00 figure came from. CHANHASSEN VILLAGE COUNCIL MINUTES - July 9, 1973 PUBLIC HEARING - MINNEWASHTA HEIGHTS STORM SEWER Mr. Russ Larson said that it was a proposal advanced to him from representa-I tives from the Minnewashta Heights Association in a meeting they had in June. It was a suggestion by these representatives that the Village pay the $1,500.00 for the easements. -2- Mr. Hallenback stated Mr. Lempke and Lot 9 people and Mr. Tessness negotiated the $1,500.00 figure. Councilman Wolf stated that the $1,500.00 was only a proposed figure. Mayor Klinglehutz asked if additional run off to the beach is caused from the sewer in Minnewashta Heights. Bill Brezinsky stated the run off has increased 8% over the previous run ,off. Mr. Halback stated all the water has been directed from all other lots to lot 9 and the run off is directed by the way the grading of the road was done. Councilman Kurvers felt the Village had to justify the $1,500.00 and know exactly what it is for. Councilman Bennyhoff felt this lot would be improved a great deal. He felt we have to justify that $1,500.00, and what benefit will the Village get? Mr. Mullin asked if the Minnewashta Heights residents should meet again to negotiate. Councilman Neils asked how much more run off there is. Bill Brezinsky stated there is approximately 20% more run off on Lot 9. foill Mr. Dutcher asked for a concrete idea on what the Village would negotiate A motion was made by Councilman Wolf and seconded by Councilman Neils to adjourn the Public Hearing. Motion carried. ------------------------------------------------------------------------------- CHANHASSEN VILLAGE COUNCIL MINUTES - July 9, 1973 The special Village Council meeting was called to order on July 9, 1973 at 9:00 p.m. in the Village Hall. The following members were present: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. A motion was made by Councilman Bennyhoff and seconded by Councilman Kurvers to dispense with all formalities. The following voted in favor thereof: , Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. MINNEWASHTA HEIGHTS STORM SEWER: A motion was made by Councilman Wolf and I seconded by Councilman Kurvers to approve Project 73-8 Minnewashta Heights Storm Sewer and authorize final plans and specifications. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. I I II CHANHASSEN VILLAGE COUNCIL MINUTES - July 9, 1973 -3- MINNEWASHTA HEIGHTS STORM SEWER: (con't) Discussion was held on additional damage due to run off from the Sewer Project in the NSA. A motion was made by Councilman Bennyhoff and seconded by Councilman Neils that the Council has determined that by reason of the construction of the Sani tary Sewer on Lot 9 Block 5 Minnewashta Heights, that the surfac,e" wate~_run off over Lot 9, being private property, has been increased 'hot less"than 20% and that the Council has also taken into consideration the fact that the easement acquisition could entail considerably condemnation expenses all of which would be proper to charge against the North Area Sewer and Water project, therefore, the Council has elected to charge 28% of the cost of the Storm Sewer project against the North Service Area Sewer and Water Project. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. Councilman Wolf has to leave the meeting. WATER EXTENSION TO THE MOLINE ADDITION: A petition was presented to the Council to have the water extended to the Moline addition. Jerry Schlenk explained the location of the residents requesting water. A motion was made by Councilman Neils and seconded by Councilman Kurvers to authorize the Village Engineer to have a feasibility study prepared of the Sewer and Water service to the Moline Addition and surrounding areas. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Neils. No negative votes. Motion carried. PROJECT 73-4: Frank Laska the Village Engineer explained the final plans for the Street Improvements on Great Plains Blvd. A motion was made by Councilman Kurvers and seconded by Councilman Neils to authorize the advertising for bids on Project 73-4 Great Plains Blvd. and 76th st. improvement. The advertisement should be in the Village Newspaper on July 19 and 26, 1973 and August 2, 1973 -, the bids will be opened and on August 6, 1973 the bids will be approved or disapproved. PROJECT 71-1BT: Bill Brezinsky reported on the application made to the County of which they 'denied. The County felt $3,600.00 was not enough savings. A motion was made by Councilman Neils and seconded by Councilman Kurvers to authorize the Engineer to go back to the original plan of Project 71-lBT Water Main on County Road 117. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils.~ No negative votes. Motion carried. ZOOMOBILE: A motion was made by Councilman Kurvers and seconded by Councilman Bennyhoff to make payment of $20.00 to the Zoomobile. The following voted in favor thaeof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, and Neils. No negative votes. Motion carried. CHANHASSEN VILLAGE COUNCIL MINUTES - July 9, 1973 -4- FIRE BILL: Mrs. Terri Proft was present and explained why she feels she I should not have to pay the bill for her car fire. A motion was made by Councilman Neils and seconded by Councilman Bennyhoff in view of extenuating circumstances to void the $100.00 fire bill. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Neils. No negative votes. Motion carried. ROSE LANE: Mr. Spannus was present to explain the problems on Rose Lane. He would like to have stricter enforcements, more NO Parking signs - Violators will be ticketed and cars will be towed away signs. This will be taken care of immediately. WELTER HOME: Proposed sale of the Welter home site will be on J,ULY 5, 1973. The Village has 30 days to act on the proposal. The Village Council-requests the Park and Recreation Commission to call a special meeting to make a written recommendation. The Village Council also requests Tim Stone and Tom Klingelhutz look at the property. The Council would also like the Park and Recreation Commission to look into the $60,000.00 available from the Lower Minnesota Watershed District. PLEASANT VIEW ROAD: Discussion was held on improving sections of Pleasant I View Road. A motion was made by Councilman Neils and seconded by Councilman that the Village proceed with Street improvement on Pleasant View Road with the Council's understanding that Pleasant View Road will not be made into a four lane highway, the Council feels this will be a major hazzard on this highway. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Neils. No negative votes. Motion carried.
