The regular Chanhassen Village Council meeting was called to order on
July 16, 1973 at 8:00 p.m. in the Chanhassen village Hall by Mayor Al
Klingelhutz and was opened with the Pledge to the Flag. The following
members were present: Mayor Klingelhutz, Councilmen'Bennyhoff, Kurvers,
Neils and Wolf.
MINUTES: Public Hearing on Dorn Assessment Policy. A motion was made
by Councilman Wolf and seconded by Councilman Bennyhoff to approve the
Public Hearing minutes on the Dorn Assessment Policy of July 2, 1973 after
the following addition: The reason for another Public Hearing is the
Council feels that changes should be made in regards to a 15 year paYment
to a 3 year payment by the developer. The following voted in favor thereof:
Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No
negative votes. Motion carried.
VILLAGE COUNCIL MINUTES: A motion was made by Councilman Neils and seconded
by Councilman Kurvers to approve the Village Council minutes of July 2,
1973. The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried.
MINNWEASHTA HEIGHTS PUBLIC HEARING MINUTES: A motion was made by Councilman
Kurvers and seconded by Councilmen Wolf to approve the Public Hearing
minutes of the Minnewashta Heights Storm Sewer Project 73-8 of July 9, 1973.
The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried.

VILLAGE COUNCIL MINUTES: A motion was made by Councilman Bennyhoff and
seconded by Councilman Neils to approve the Village Council minutes of
July 9, 1973. The following voted in favor thereof: Mayor Klingelhutz,
Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion
carried.
PLANNING COMMISSION MINUTES: A motion was made by Councilman Kurvers and
seconded by Councilman Neils that the minutes of the Continuation of
Public Hearing on the Woodhill Subdivision of June 26, 1973 be noted and
read. The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers, Neils and Wolf. No negative\Otes. Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf
that the Planning Commission minutes of June 26, 1973 be noted and read.
The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers, Neils and WGæ. No negative votes. Motion carried.
A motion was made by Councilmafi Bennyhoff and seconded by Councilman Kurvers
that the Planning Commission minutes of July 10, 1973 be noted and read.
The following voted in favorfuereof: Mayor Klingelhutz, Councilmen Benny-
hoff, Kurvers, Neils and Wolf. No negative votes. Motion carried.
The Village Council noted the meeting night change from the 2nd and 4th
Tuesday's to the 2nd and 4th Wednesday's starting August 1, 1973.

INDUSTRIAL COMMISSION MINUTES: A motion was made by Councilman Bennyhoff
and seconded by Councilman Neils that the Industrial Commission and CBD
minutes of July 11, 1973 be noted and read. The following voted in favor
thereof: Mayor Klinglehutz, Councilmen Bennyhoff, Kurvers, Neils and
Wolf. No negative votes. Motion carried.

CBD COMMITTEE: Carl Dale felt that the Mayor and Councilmen should not
be on the CBD Committees.
The Village Council would like to be notified of a~l the meetings of the
CBD Committees.

HUMAN RIGHTS COMMISSION MINUTES: A motion was made by Councilman
seconded by Councilman Bennyhoff that the Human Rights commission
of July 11, 1973 be noted and read. The following voted in favor

PARK AND RECREATION COMMISSION: A motion was made by Councilman Wolf and
seconded by Councilman Bennyhoff to appoint Richard Lyman to the Park and
Recreation Commission. The following voted in favor thereoF: Mayor Klingel-
hutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes.
Motion carried.
BOARD OF ADJUSTMENTS AND APPEALS MINUTES: A motion was made by Councilman
Kurvers and seconded by Councilman Wolf that the Board of Adjustments and
Appeals minutes of July 7, 1973 be noted and read. The following voted in
favor thereof: Mayor Klinglehutz, Councilmen Bennyhoff, KUrvers, Neils
and Wolf. No negative votes. Motinn carried.
PAY BILLS: A motion was made by Councilman Bennyhoff and seconded by Council-
men Wolf to approve the bills as submitted. The following voted in favor I
thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and
Wolf. No negative votes. Motion carried.
The Accountants were present to discuss the Audit of the Financial Statement
of 1972. He stated that it looked very good.
ROSE LANE~ Sgt. Al Wallin was present to discuss the problems on Rose
Lane. The following persons were Bresent in regards to this problem: Phil

should be restored by next week.

ROSE LANE CaN'T: The Village will have the signs put back up and extended
to Shorewood on County Road 117, Christmas Lake Road, Twin Hills Road and
have the No Parking enforced.
JACK SHMIDT: Jack Schmidt was present asking for permission to use 3 Lake
Ann Ball Fields and a 3.2 Beer License. He said he would be have 20-24
teams on Saturday July 28, 1973. Councilman Wolf reminded him about not
parking on the grass and to try to use car pools. They will have to contact
the Jaycees about Beer sale. Discussion followed.
A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf
to grant Jack Schmidt the use of 3 Lake Ann Ball Fields on July 28, 1973
for a fee of $40.00. He is responsible for clean up. The following voted
in favor thereof; Mayor Klingelhutz, Councilmen Bennyhoff and Kurvers,
Councilmen Neils and Wolf voted no. Motion carried.
HELMER OLSON: A motion was made by Councilmen Bennyhoff and seconded by
Councilman Wolf that Mr. & Mrs. Helmer Olson may not rent out the lower
part of their home because this is a single family residential area.
The following voted in favor thereof: Mayor Klingelh~ , Councilmen
Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried.
KNOLLWAY ESTATES: Bob Lindahl was present to request a variance to Ordinance
No. 45 from a 2~ acre plot to 2 acres. The Village Engifieer reported on
the soil studies. Discussion followed.

A motion was made by Councilmen BennYhoff~~d. seconded by Councilman Wolf
to grant the variance to Ordinance No. 45 from a 2~ acre plot to a 2 acre
plot. The following voted in favor thereof: Mayor Klingelhutz and Council-
man Bennyhoff. Councilman Neils and Wolf voted no. Councilman Kurvers
abstained from voting. Motion defeated.
Councilman Kurvers and Neils feel they did not have enough information.
They requested the Percalation tests be taken. Councilman Wolf feels it
doesn't fit in with the overall Village plan.
BOARD OF ADJUSTMENTS AND APPEALS: Dean Burdick was present to ask for a
variance from Ordinance No. 47.
A motion was made by Councilman Neils and seconded by Councilman Wolf to
grant a variance to Section 7.05 of Ordinance No. 47 as per requirements
of the Board of Adjustments and Appeals minutes of June 19, 1973. The
slope of the driveway and gutter should divert water away from the Schmieg
property. The following voted in favor thereof: Mayor Klingelhutz,
Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion
Carried.
BMT - CONDITIONAL USE PERMIT: Mr. Wm. Turner was present regarding a
Conditional Use Permit.

A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf
to grant a Conditional Use Permit as per changes to Mr. Turner for Light
Commercial Use. The following voted in favor thereof: Mayor Klingelhutz,
Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion
Carried.

AMENDMENT #2 PERTAINING TO WATER SUPPLY WELL #3 PROJECT 71-lBT: A motion
was made by Councilman Bennyhoff and seconded by Councilman Wolf to I
accept Amendment #2 pertaining to water Supply Well #3 - Project 71-lBT
with a net deduct of $1,590.00 and revised contract amount of $33,021.50.
The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried.
AL KLINGELHUTZ VARIANCE: Al Klingelhutz requested " a variance to section
13.0 of Ordinance No. 33 on his farm. He wants to sell 119 acres and
keep 1 Acre and the home for himself. Discussion followed.
A motion was made by Councilman Neils and seconded by Councilman Wolf to
have the Planning Commission look at the request of a waiver to Section
13.0 of Ordinance No. 33. The following voted in favor thereof: Councilmen
Bennyhoff, Kurvers, Neils and Wolf. Mayor Klingelhutz abstained from
voting. Motion Carried.
HOLLY HUSETH: A motion was made by Councilman Wolf and seconded by Councilman
Kurvers to hire Holly Huseth for $1.60 per hour for 10 hours per week.
The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried.
PLEASANT VIEW ROAD: A motion was made by Councilman Neils and seconded

Pleasant View Road will not be made a four lane highway. The Council
feels that this will·~ eliminate the hazord. The following voted in
favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils
and Wolf. No negative votes. Motion carried.

FIRE DEPT. BEER LICENSE: A motion was made by Councilman Wolf and seconded
by Councilman Bennyhoff to grant 3 nonintoxicating beer licenses to the
Fire Dept. to be used at the Renaissance Festival on September 1,2,8,9,
15, and 16, 1973. The following voted in favor thereof: Mayor Klingelhutz,
Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion
carried.
FENCING - LIFT STATIONS: A motion was made by Councilman Kurvers and
seconded by Councilman Wolf to fence all lift stations in the NSA and
charge it to that project. The following voted in favor thereof: Mayor
Klingelhutz, Councllmen Bennyhoff, Kurvers, Neils and Wolf. No negative
votes. Motion carried.
Each Lift station will cost about $300.00 to fence.
A motion was made by Councilfuan Bennyhoff and seconded by Councilman Wolf
to adjourn the meeting. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative
votes. Motion carried.
