1973 07 23 r I I I \ CHANHASSEN VILLAGE COUNCIL MINUTES - July 23, 1973 -1- The special Chanhassen Village Council meeting was called to order on July 23, 1973 at 8:00 p.m. in the Village Hall by Mayor Al Klingelhutz and was opened with the Pledge to the Flag. The following members were present: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Nåls and Wolf. VILLAGE COUNCIL MINUTES: A motion was made by Councilman Kurvers and seconded by Councilman Wolf to approve the Village Council minutes of July 16, 1973 after the following corrections are made: Add Phil Gullickson,Jr. to the list under Rose Lane and omit Dean Burdick and Jerry Neher. Under Pleasant View Road on Page 4 it should read - The Council feels that this will eliminate the hazard. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. McKEON MEETING MINUTES: A motion was made by Councilman Neils and seconded by Councilman Wolftht the minutes of the McKeon Construction meeting be noted and read. This meeting was held on July 17, 1973 concerning the Woodhill Subdivision. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. WELTER HOUSE: Tim Stone and Adolph Tessness reported on the Welter House. Tim Stone stated the structure is basicly sound and would be adequate for renting to a single family. It would be inadequate for a community center because extensive remodeling would have to take place. New wiring, plumbing would also be needed. Adolph Tessness felt the Village Could rent it for about $150.00 per month. He stated it would be about $1,700.00-$2,000.00 for wiring. A new septic drain field would have to be installed and a pump on the well. Mr. Tessness felt the basic house and buildings are worth the $28,000.00. Discussion followed. A motion was made by Councilman Kurvers and seconded by Councilman Neils to table the decision on the purchase of the Welter house until the Park and Recreation Commission have made their recommendations. The decision will be made on or before July 30, 1973. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. JACK SCHMIDT - SOFTBALL TOURNAMENT: Russ Larson read the letter from the Chanhassen Slow Pitch Softball League describing the nature of the league. Jack Schmidt was present, representing the league, requesting a 3.2 Beer license for Jµly 28, 1973. Discussion followed. A motion was made by Councilman Bennyhoff and seconded by Councilman Kurvers to grant a 3.2 Beer License (non-intoxicating liquor) to the Chanhassen Slow Pitch Softball League for Saturday, July 28, 1973. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No ne~ative votes. Motion carried. A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf to set a fee of $10.00 for the 3.2 Beer License to the Chanhassen Softball League. The following voted in favor thereof: Mayor Klingàhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. , CHANHASSEN VILLAGE COUNCIL MINUTES - July 23, 1973 -2- JACK SCHMIDT, con It: A motion was made by Councilman Kurvers and seconded by Councilman Neils for the Chanhassen Slow Pitch Softball League to I make an additional $50.00 deposit which will be returned if the Park is cleaned up to the satisfaction of the Village. The playing fields and surrounding park land must also be cleaned up. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. It is the responsibility of the League to contact the Police Dept. for the inspection of the grounds on Saturday evening, July 28, 1973. BOARD OF ADJUSTMENTS AND APPEALS: A motion was made by Councilman Wolf and seconded by Councilman Kurvers to grant a variance of 5 feet front yard and a 15 foot rear rear yard from Section 7.05 of Ordinance No. 47 to James Bixler. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. TIMOTHY STONE - VARIANCE: A motion was made by Councilman Neils and seconded by Councilman Wolf to grant a 1311" front yard and a 71 side yeard variance for a garage from Section 7.05 of Ordinance No. 47. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. CONTRACT AMENDMENT NO. 1 FOR PROJECT 7l-lBT: Bill Schoell presented the contract amendment No. 1 for Project 7l-lBt. A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff I to grant contract amendment No. 1 for Project 7l-lBT in the amount of $18,160.75. The fOllowing voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. WELL NO.3: Bill Schoell, Village Engineer reported on the letter of July 12, 1973 in regards to Well No.3. Discussion followed. INSTY-PRINTS: A motion was made by Councilman Neils and seconded by Councilman Wolf to approve payment of $128.20 to Insti-Prints for 200 copies of Ordinance No. 33 and 33-A. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, KUrvers, Neils and Wolf. No negative votes. Motion carried. TENNIS COURTS: A motion was made by Councilman Wolf and seconded by Councilman Kurvers to pay $1,471.98 to MRC Sales Co. for fencing and a net for the Tennis Court from the Park and Recrfftion Acquisition fund. The following voted in- favor thereof: Mayor Klingéhutz, CouncDmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. BUDGET: A discussion was held on the 6 month Budget report. PROJECT 7l-lF: A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff for the Village Engineer to respond to the letter from Henry Neils dated July 19, 1973 and take allÅ“cessary steps to reslove this matterl The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Nerrs and Wolf. No negative votes. Motion carried. I I I CHANHASSEN VILLAGE COUNCIL MINUTES - July 23, 1973 -3- TRAILOR HOUSE: Councilman Neils asked about the building lot on Lot 35 Block 4 in Red Cedar Point ( 3727 South Cedar ) where a trailer house now sits. The Council feels the lot is buildable. POLICING OF PARKS: A discussion was held on additional Policing of our Parks. A motion was made by Councilman Bennyhoff and seconded by Councilman Kurvers to adjourn the meeting. The following voted in favor thereof: Mayor Klingelhutz, Councilmen BEnnyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried.
