1973 09 10 -1- CHANHASSEN VILLAGE COUNCIL - PUBLIC HEARING: MOLINE ADDITION UTILITY SERVICE PROJECT 73-9 September 18, 1973 I The Mayor opened the Public Hearing for 65th Street Water, Moline Addition Project 73-9 at 7:30 p.m. in the Village Hall. The following members of the Village Council were present: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. PERSONS PRESENT: Rev. Hugh Gilmore and Mr. and Mrs. Robert M. Peterson. The Village Attorney read the official notice of the Public Hearing. Bill Brezinsky, Village Engineer, explained about the proposed water line and the properties it will serve. The main line will be layed in the right away without disturbing individual properties except for hook-up lines. Mrs. Peterson asked how many properties will be assessed. Bill Brezinsky reported that there will be 11 assessments charged. The Libby property will have 3 individual unit assessments. Councilman Kurversæked Mr. Peterson if they wanted sewer with the water. He stated that any time the sewer goes through is all right with him. It will cost about $1,334.00 per unit or an estimated $13,700.00 for the total project. I A motion was made by Councilman Wolf and seconded by Councilman Neils to adjourn the Public Hearing. Motion carried. -------------------------------------------------------------------------- CHANHASSEN VILLAGE COUNCIL MINUTES - September 10, 1973 The special Village Council meeting was called to order at 8:00 p.m. on September 10, 1973 by Mayor Al Klingelhutz and was opended with the Pledge to the Flag. The following members were present: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. MINUTES: A motion was made by Councilman Neils and seconded by Wolf to approve the Village Council minutes of August 27, 1973. following voted in favor thereof: Mayor Klingelhutz, Councilmen Kurvers, Neils and Wolf. No negative votes. Motion carried. Councilman The Bennyhoff, PARK AND RECREATION MINUTES: A motion was made by Councilman Neils and seconded by Councilman Kurvers that the Park and Recreation Commission minutes of August 23, 1973 be noted and read. The follOwing voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. I CHANHASSEN VILLAGE COUNCIL MINUTES - September 10, 1973 -2- ROBERT BUESGENS, SEWER FOR LOT 7 SUNRISE RIDGE: Adolph Tessness was present representing Robert Buesgens in regards to sewer for Lot 7 in Sunrise Ridge. Mr. Tessness reported on the plat diagram and the Engineer's report of June 2, 1973, that shows that the sewer main will be extended through the Scott and Buesgens property in the future for Carver Beach. I Mr. Scott was present to explain his oppositions to the proposed sewer to Robert Buesgens. Discussion followed. The Village Attorney recommended that Buesgens and Scotts negotiate privately. A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf to table any action on Robert Buesgens/F.D. Scott Sewer Lot 7 Sunrise Ridge. The following voted in favor thereof: Mayor Klingelhut~, Council- men Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. TREES IN RED CEDAR POINT: Craig Mertz reported on Mr Head's trees in the Red Cedar Point area and Sewer Construction. A motion was made by Councilman Bennyhoff and seconded by Councilman Kurvers to have Village Attorney offer Mr. Head $900.00 each for two maple trees in the event they are removed or die within one year after construction of sewer. One tree is 80 ft. high and has a 30 inch in I diameter base and the other tree is 100 ft. high with a 36 inch base. The following voted in favor thereof: Mayor Klingelhutz, councimen Bennyhoff, Kurvers, Neils. Councilman Wolf voted no. Motion carried. MOLINE'S ADDITION, PROJECT 73-9; A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff to authorize Resolution 910731 entitled Instructing the Village Engineer to prepare detailed plans and specifications and advertise for bids on Moline's Addition Project 73-9. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. ALLOCATION OF FEDERAL REVENUE SHARING MONIES: The Village Attorney reported on the Revenue Sharing monies. A report has to be made regarding $10,502.00 to be received between Julyl, 1973 and June 30, 1974. A motion was made by Councilman Neils and seconded by Councilman Wolf to use funds in the amount of $10,502.00 for Public Safety. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. BUDGET: A budget meeting will be held Wednesday, Sept. 13, 1973 at 7:30 p.m. NORTH SERVICE AREA: The Village Attorney reported on the Booster Station Project 71-IB regarding a new firm and a contract for $29,631.00. A motion was made by Councilman Bennyhoff and seconded by Councilman Kurvers to grant the assignment of contract to Kehne Electric Co. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Benny- hoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. I J CHANHASSEN VILLAGE COUNCIL MINUTES - September 10, 1973 -3- I LAKE SUSAN SANITARY SEWER PROJECT 73-7: A motion was made by Councilman Bennyhoff and seconded by Councilman Kurvers to authorize Resolution 910732 entitledAthorizing the Advertising for Bids on Lake Susan Sanitary Sewer Project 73-7. The following voted in favor thereof: Councilman Bennyhoff, Kurvers, Neils and Wolf. Mayor Klingelhutz abstained from voting. No negative votes. Motion carried. MINNEWASHTA HEIGHTS STORM SEWER: The Village Engineer presented the bids for the Minnewashta Heights Storm Sewer Project which are as follows: BIDDER G & L Contracting Lamppa Chris' Construction AMOUNT $8,933.00 11,523.00 13,963.00 Discussion follows. A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf to approve Resolution 910733 entitled Rejecting the Bids on Minnewashta HEights Storm Sewer. The following voted in favor thereof: Mayor Klingel- hutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. MRS. RICHARD ROSSING - CARVER BEACH ROAD ASSESSMENT: Mrs. Rossing was present to clear up the assessments on her property and homes regarding the Carver Beach Road Assessment. She will be charged for 2 assessments. I DUNCAN STORLIE: Duncan Storlie was present to give an updated report on the Community Schools Program. A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf that the Mayor or a representative and the Park and Recreation Commission Chairman or a representative be the representative from Chanhassen on the Community School Committee. The followiftg voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Kurvers and seconded by Councilman Wolf to endorse the Survey Form regarding the Community School Program. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. BIENNIAL ELECTIONS: A motion was made by Councilman Bennnyhoff and sec- onded by Councilman Kurvers to enact an Ordinance effective after the November, 1973 election to extend the term of the office of Mayor and the term of office for the Council seat now occupied by Councilman Kurvers, one year . in order that the Village complies with Biennial Election requirements, as per the Village Attorney's schedule of September 10, 1973. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. I GINNY HARRIS: Ginny Harris, Clerk-Administrator of Victoria was present to discuss administrative details of the Chanhassen-victoria sewer service. CHANHASSEN VILLAGE COUNCIL MINUTES - September 10, 1973 -4- STREET LIGHTS: A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff to install a st.reet- light at Fir Tree Ave. and I Shore Drive in Minnewashta Heights. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. Councilman Kurvers voted no. He feels more studies should be made before putting up street lights. Motion carried. A motion was made by Councilman Wolf and seconded by Councilman Kurvers to install a street light between the Village Hall and the Chanhassen Elementary School on Laredo. LIFT STATION NO.8: A motion was made by Councilman Bennyhoff and seconded by Councilman Neils to authorize $200.00 be paid for underground service to Lift Station #8. The following voted in favor thereof: Mayor Klingel- hutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. PLEASANT ACRES II: Pleasant Acres II Assessment Role Public Hearing will be held Monday, Oct. I, 1973 at 7:30 p.m. GREAT PLAINS BLVD: A discussion on the progress of Great Plains Blvd. was held.j TRANSIT STUDY COMMITTEE: A motion was made by Councilman Neils and seconded by Councilman Bennyhoff to appoint Steve Wolf and Bill Schoell to the Transit Study Committee. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative I votes. Motion carried. DAN COLICH: A motion was made by Councilman Neils and seconded by Coun- cilman Wolf to grant Dan Colich a 6 ft. side variance for a double garage assuming no variance is needed for the front yard. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. LEAGUE OF MINNESOTA MUNICIPALITIES: A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf to pay expenses for the Mayor to attend the Metropolitan League of Municipalities meeting on September 22, 1973. The following voted in favor thereof: Mayor Klingel- hutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried.
