CHANHASSEN VILLAGE COUNCIL MINUTES - ASSESSMENT HEARING FOR INDUSTRAIL
PARK PROJECT 72-2 - October 8, 1973

The Assessment Hearing for Project 72-2 Industrial Park Project was called
to order on October 8, 1973 at 7;30 p.m. by Mayor Klingelhutz. The
following members were present: Mayor Klingelhutz, Councilmen Neils
and Wolf. Councilmen Kurvers and Bennyhoff were absent.
PERSONS PRESENT: Robert Brenny, B.C. Burdick, Charles M. Towle and
Les Renner.
The Notice of Public hearing as published in the offficial Village news-
paper was read by Lloyd G. Schnelle.
Councilmen Bennyhoff and Kurvers entered the meeting.
A motion was made by Councilman Neils and seconded by Councilman Bennyhoff
that the Village Council feels it is a public necessity and deems it
necessary to hold an official Council meeting on a legal holiday, Ocotber 8,
1973. The following voted in favor thereof: Mayor Klingelhutz, Council-
men Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried.
Frank Laska, Village Engineer explained the project and the estimated
costs of the project.
craig Mertz explained that the notice speaks of payment within 3 years
and the council would not be held by this but could be extended to 10
years or more.

Mr. Charles Towle would like the utility assessment extended to at least
over a 10 to 15 year period to run with the land.
The Village Attorney was not sure which source the money is coming from
for this project. The repayment period should not be determined.
Mr. Burdick asked how the property would be assessed. He stated its
definitely a plus factor for saving to have payment period be 10 to 15
years.
The Marian Oric property was not assessed because the Council feels the
property is unbuildable.
A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf
to adjourn the Assessment Hearing. The following voted in favor thereof:
Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No
negative votes. Motion carried.

8:00 p.m. on October 8, 1973 by Mayor Al Klingelhutz and was
the Pledge to the Flag. The following members were present:

A motion was made by Councilman Neils and seconded by Councilman Wolf
that the Village Council feels that it is of public necessity and deems I

ASSESSMENT HEARING MINUTES PROJECT 73-1: A motion was made by Councilman
Neils and seconded by Councilman Wolf to approve the October 1, 1973
Pleasant Acres Second Addition Project 73-1 Assessment Hearing minutes.
The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried.
COUNCIL MINUTES: A motion was made by Councilman Kurvers and seconded by
Councilman Bennyhoff to approve the October 1, 1973 Village Council minutes.
The following voted in favor thereof: Mayor Klingelhutz, Councilmen Benny-
hoff, Kurvers, Neils and Wolf. No negative votes. Motion carried.
HUMAN RIGHTS COMMISSION MINUTES: A motion was made by Councilman Wolf
and seconded by Councilman Bennyhoff to note the Human Rights Commission
minutes of October 1, 1973. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative
votes. Motion carried.
A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff
to direct the Village Administrator to reorganize the housing study I
committee by calling a special meeting of the previous members and the
Human Rights Commission. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative
votes. Motion carried.
METRO SEWER BOARD: Craig Mertz reported on the letter dated October 2, 1973
regarding .the Metro Sewer Board five year construction progra. He stated
'chat thè Lake Ann Interceptor Phase II has been pushed back to 1977.
Discussion followed.
Mr. Schnelle and Bill Schoell will meet and talk with the Metro Sewer Board
in regards to the Lake Ann Interceptor Phase II.
STATE AID HIGHWAY MONEY: Craig Mertz read a letter in regards to State
Aid Highway money. Chanhassen will be receiving about $49,000.00 in 1974.
This will bring the total State Aid money to $128,000.00 available for
construction of a state aid highway system. Discussion following.
Lloyd G. Schnelle feels that the Village should set up a road improvement
fund for state aid streets.
ELECTION JUDGES: A motion was made by Councilman Kurvers and seconded by
Councilman Bennyhoff to except the following Election Judges, if the
alternate can not serve full time in a precinct, the Council will have
to accept an appointment closer to the Election. The following voted in I
favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils
and Wolf. No negative votes. Motion carried.

ELECTION JUDGES, CON'T: The following is a list of approved Election '
Judges and Ballot Counters:

Precinct #1: Viola Buschkowsky, Mrs. Lewis Woitela, Mrs. Robert Meuwissen,
Mrs. Arnold Schroeder, Mres. Vernice Jorrison, Mrs. Jean Meuwissen, Mrs,
Bernard Schroeder, Al Olson, Alternate - Sally deLancey.
Precinct #2: Mrs. Richard Comer and Mrs. Florence Raser.
Precinct #3: Mrs. Audrey Flemming, Sharon Loechler, Mrs. James Reiva.
HUNTING PERMITS: Mr. Schnelle feels that hunting in Chanhassen Estates
Park connecting Rice Marsh would be dangerous to the children and homes
close to this area.
A motion was made by Councilman Neils and seconded by Councilman Wolf to
deny the request for hunting permits to Tom Lenzmeier and Jerry Boucher
for Chanhassen Estates Park. The following voted in favor thereof:
Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No
negative votes. Motion carried.
Mr. Schnelle will work with the Conservation Dept. and the Police Dept.
to come up with a recommendation about hunting and the areas to be hunted
in.
The Council feels hunters should be at least 1000 feet from Village Parks
and residences.

TRANSPORTATION MEETING: Mr. Schnelle reported on the Transporation meetin9c~
he attended.
A motion was made by Councilman Neils and seconded by Councilman Kurvers
to appoint Mayor Klingelhutz, Lloyd G. Schnelle and Steve Wolf as alternate
to the Carver/Hennepin County Task Group. The following voted in favor
thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and
Wolf. No negative votes. Motion carried.

73-1 CON't: A letter from the Village Engineer dated OCtober 5, 1973
recommended to accept the low bid from G.L. Contracting, Inc. in the
amount of $59,303.65 using PVC or ABS plastic Sewer pipe.

A motion was made by Councilman Bennyhoff and seconded by Councilman
KUrvers to approve resolution 108731 entitled Accepting the Low bid from
G.L. contracting in the amount of $59,303.65. The following voted in favor
thereof: Councilmen Bennyhoff, Kurvers, Neils and
Wolf. Mayor Klingelhutz abstained from voting. No negative votes. MotiDn
carried.
BUESGENS OFFICE BUILDING: Mr. Schnelle reported on Mr. Bongard's letter in
regards to the assessment of water service improvement.
Bill Brezinsky reported on the Engineer's letter of October 5, 1973 on the
feasibility study providing water service to Buesgens office building.
A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf to
have the Engineer's prepare plans and specifications on Buesgens Office
Park water service, Resolution J-OJL732. The following voted in favor thereof:
Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No
negative votes. Motion carried.

A motion was made by Councilman Bennyhoff and seconded by Councilman Kurvers
to hold the Public Hearing on Buesgens Office Park at 7:30 p.m. on October
29, 1973. The following voted in favor thereof: Mayor Klingelhutz,
Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion
carried.
A motion was made by Councilman Benhýhoff and seconded by Councilman
Wolf to receive bids on Monday October 29, 1973 at 2:00 p.m. on Buesgens
Office Park water service. The following voted in favor thereof: Mayor
Klingelhut+, Councilmen Bennyhoff, KUrvers, Neils and Wolf. No negative
votes. Motion carried.

A motiDn was made by Councilman Neils and seconded by Councilman Bennyhoff
that Robert Buesgens pay all cost associated with this project even if the
project isn't accepted. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative
votes. Motion carried.
PARKING AND TRAFFIC STUDY: A motion was made by Councilman Wolf and seconded
by Councilman Kurvers to authorize a feasibility study prepared on Parking
and Traffic for the CBD Committee. The following voted in favor thereof:
Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No
negative votes. Motion carried.
CARVER COUNTY LAW ENFORCEMENT ADVISORY COUNCIL: A motion was made by Council-
man Wolf and seconded by Councilman Kurvers to appoint Mayor Klingelhutz and
Anne Neils as alternate to the Carver County Law Enforcement Advisory
Council. The following voted in favor thereof: Mayor Klingelhutz,
Councilmen Bennyhoff, Kurvers, Neilsand Wolf. No negative votes. I

GARBAGE COLLECTION: Mr. Schnelle will check on Garbage hauling permits
and find out which firms can legally haul garbage in Chanhassen.

RENAISSANCE FESTIVAL CLEAN UP: A motion was made by Councilman Kurvers
and seconded by Councilman Bennyhoff for the Village Clerk to contact
Mr. Larry Vickory at which time they will have 10 days to clean the
area or the village will clean it up and assess it against the property
owners. The following voted in favor thereof: Mayor Klingelhutz,
Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes.
Motion carried.
ADVERSE CLAIM: A motion was made by Councilman Bennyhoff and seconded
by Councilman Kurvers for the Village Attorney to file an adverse claim
Bishoff property. The following voted in favor thereof: Mayor Klingelhutz,
Counqilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes.

INDUSTRIAL PARK DAMAGES: A motion was made by Councilman N~s and sec-
onded by Councilman Bennyhoff for the Village Attorney to study the
law regarding the $7,000.00 in penalties the contractor has incurred
during the 72-2 project. The fOllowing voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative
votes. Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Neils to adjourn the meeting. The following voted in favor thereof:
