The regular Chanhassen Village Council meeting was called to order at
7:30 p.m. on October 15, 1973 by Mayor Klingelhutz and was opened with
the Pledge to the Flag. The following members were present: Mayor
Klingelhutz, Councilmen Bennyhoff and Wolf. Councilmen Kurvers and
Neils were absent.
COUNCIL MINUTES: A motion was made by Councilman Wolf and seconded by
Councilman Bennyhoff to approve the Village Council minutes of October 8,
1973. The following voted in favor thereof: Mayor Klingelhutz, Council-
men Bennyhoff and Wolf. No negative votes. Motion carried.
PUBLIC HEARING MINUTES PROJECT 72-2: A motion was made by Councilman
Bennyhoff and seconded by Councilman Wolf that the Public Hearing minutes
on the Industrial Park Project 72-2 be noted and read. The following
voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff and
Wolf. No negative votes. Motion carried.
PAY BILLS: A motion was made by Councilman Bennyhoff and seconded by
Councilman Wolf to approve the paying of the bills as submitted except
for the Burroughs Accounting Machine Co. and that final payment of
$6,793.16 be held back until the Administrator talks to the Company. The
following voted in favor thereof: Mayor Klingelhutz, Councñmen Bennyhoff
and Wolf. No negative votes. Motion carried.
Councilman Kurvers entered the meeting.

PLANNING COMMISSION MINUTES: A motion was made by Councilman Wolf and
seconded by Councilman Kurvers that the Planning Commission minutes of
October 10, 1973 be noted and read. The following voted in favor thereof:
Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Wolf. No negative
votes. Motion carried.
RENAISSANCE FAIR: Mr. Larry Vickrey and Ms. Barbara Rork were present
representing Jonathan Corporation and the Renaissance Fair. Ms. Rork
reported that the grounds where the fair was held has been completely
cleaned up except for hay bales and the Children's Theatre.
Mr. Vickrey and Ms. Rork wanted the feelings of the Council to whether
Chanhassen would be receptive to the continuation of the Fenaissance
Fair on this site. They also wanted to know the feelings regarding a
Conditional Use Permit.
Councilman Neils entered the meeting.
Discussion followed. The Council told Ms. Rork to apply for ,a Conditional
Use Permit and submit the cost of publication and attorney fees and other
costs to draw up this permit.
Studies will be m~deon traffic, inspection of temporary buildings and
clean up problems to determine whether Chanhassen benefits from the
Renaissance Fair.

BUESGENS OFFICE PROJECT 73-5 & 73-10: Bill Brezinsky, Village Engineer I
presented the Plans and specifications. He also stated that the figure
in the Engineers letter of October 11, 1973 should be $24,000.00 for
estimated construction of this project.

A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf
to approve the plans and specifications for water to the Buesgens Office
Park. The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried.
INDUSTRIAL PARK PROJECT 72-2: A discussion was held on previous assessment
policies. The Village Attorney reported that the number of years of payment
is merely and there is no legal requirements.
A motion was made by Councilman Neils and seconded by Councilman Wolf to
approve resolution 1015731 adopting the Assessment Role for Project 72-2
Industrial Park with 7% interest and running over 7 years. The following
are the reasons for thE: The seven years pertain only to this particular
property. Because of the conditions in the original bond on this project
the seven years will coincide with the original development contract.
The following voted in favor thereof: Mayor Klinelhutz, Councilmen Bennyhoff,
Kurvers, Neils and Wolf. No negative votes. Motion carried.
The Martin Ward property was not assessed in this development.
LAKE ANN INTERCEPTOR, PHASE II: Lloyd Schnelle reported on his meeting I
with Ms. Van Allen and Mr. Burandt, Staff members of the Metro Council.
This board will require documented evidence of pollution in Lake Lucy
and Lake Ann. December 13, 1973 will be the public hearing for the Metro
Council regarding this.
A motion was made by Councilman Wolf and seconded by COUncilman Wolf and
seconded by Councilman Neils to authorize the Village Engineer and Administra-
tor to work together on a study indicating the need for the Lake Ann
Phase II INterceptor, spending a maximum of $500.00. The following voted
in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers,
Neils and Wolf. No negative votes. Motion carried.
The Administrator will instruct Nordskov in regards to the proposed sewer.
CHANHASSEN ESTATES II: STREETS: The Administrator and Frank Laska re-
ported on the streets in Chanhassen Estates II. The engineers recommended
that the Village Council not accept these streets until improvements are
made by the contractor. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative
votes. Motion carried.
ASSESSMENT PROCEDURE FOR WEST JUNIOR HIGH: The Village Engineer explained
the situation in regards to the assessment on this property. Discussion
followed.
The Council instructed the Administrator to send a copy of the Engineer's I
letter of October 11, 1973 and explain to the school board that they
will have to come before the Council with their complaints.

BUILDING AND PLUMBING INSPECTOR: Ken Biberdorf indicated that he would
accept the position of Building-Plumbing INspector. The Council feels
schooling and training is necessary for this position. Discussion followed.
A motion was made by Councilman Wolf and seconded by Councilman Neils to
appoint Ken Biberdorf as a Building-Plumbing Inspector for the Village
adding $50.00 to his exsisting salary for October, November and December
and as of January 1, 1974 a salary recommended by the Administrator for
this position. The following voted in favor thereof: Mayor Klingelhutz,
Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes.
Motion carried.
A motion was made by Councilman Neils and seconded by Councilman Kurvers
to advertise for a replacement for Ken Biberdorf. The following voted
in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers,
Neils and Wolf. No negative votes. Motion carried.
ELECTION JUDGE: A motion was made by Councilman Wolf and seconded by
Councilman Kurvers to approve Mrs. Russell Olson to be an election Judge.
The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried.
GAS COMPANY SHELTERS: A motion was made by Councilman Wolf and seconded
by Councilman Bennyhoff for the Village to request the Gas Co. to land-
scape around the shelter over the gas relief stations. The following
voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers,
Neils and Wolf. No negative votes. Motion carried.
LAKE REGION MUTUAL AID ASSN. MEETING: Councilman Bennyhoff will represent
the Village at the Lake Region Mutual Aid Assn. meeting October 23, 1973.
JEAN MEUWISSEN: A motion was made by Councilman Wolf and seconded by
Councilman Bennyhoff to pay Jean Meuwissen $2.50 per hour and 9¢ a mile
for completing the village mailing list. The following voted in favor
thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and
Wolf. No negative votes. Motion carried.
OAK & ELM TREES ON LYMAN BLVD: A discussion was held in regards to saving
the Oak and Elm trees on Lyman Blvd. The Mayor reported the Oak trees'
trunk is split on the North side of the tree.
A motion was made by Councilman Neils and seconded by Councilman Wolf
that the Elm and Oak trees be removed and the alignment of the road be put
on the original section line. The following voted in favor thereof: .
Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. Councilman Kurvers
voted no because of lack of information. Motion carried.
A motion was made by Councilman Neils and seconded by Councilman Wolf re-
questing a study be made using a certain amount of landscaping to complete
the road. The following voted in favor thereof: Mayor Kling~lhutz,
Councilman Bennyhoff, Kurvers, Neils and Wolf. No negative votes.
Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Neils to adjourn the meeting. The following voted in favor thereof:
