CHANHASSEN VILLAGE COUNCIL MINUTES - PUBLIC HEARING ON BUESGENS OFFICE
PARK PROJECT 73-10

The Public Hearing on Buesgens Office Park Water Main Project 73-10 was
called to order by Mayor Klingelhutz on October 29, 1973 at 7:30 p.m.
The following members were present: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers and Neils. Councilman Wolf was absent.
PERSONS PRESENT: Mr. & Mrs. Frank Bongard
The official notice of Public Hearing as published in the newspaper was
read by the Administrator.
Bill Brezinsky, Village Engineer reported on the proposed watermain
project and how it will be assessed. Mr. Bongard will be paying a resi-
dential, single family assessment.
Mr. Bongard asked when he would have to pay for this project. The Village
Attorney told him that it must be paid in full or a down payment made 30
days from the date of the adoption of the assessment roll or the balance
will be placed on the taxes. Mr. Bongard asked about the proposed street.
He wanted to know if he would be assessed. The Village Attorney stated
that all benefiting properties would be assessed. If at that time he
owned the property he would be assessed.
Mr. Bongard wanted to know if he would be assessed for storm sewer. Mayor
I Klingelhutz stated that he would.
Mr. & Mrs. Bongard will be notified by the Village upon adoption of this
assessment roll.
A motion was made by Councilman Bennyhoff and seconded by Councilman Kurvers
to adjourn the public heaing. The following voted in favor thereof:
Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Neils. No negative
votes. Motion carried.

PUBLIC HEARING MINUTES - October 29, 1973 GREAT PLAINS BLVD. PROJECT 73-4
CONTINUATION OF PUBLIC HEARING
The Mayor opened the Continuation of Public Hearing on the Great Plains
Blvd. Street Improvement Project 73-4. The following members of the
Village Council were present: Mayor Klingelhutz, Councilmen Bennyhoff,
Kurvers, and Neils. Councilman Wolf was absent.
PERSONS PRESENT: Elroy Williams, Eugene Coulter, Dale Geving, Bob Grengs,
Dennis Grover, R.E. Berg, G. Freeburg, Ellis Thomas, Ray Knott, Al
Skluzacek, Harry Bongard, Bill Bongard, Roger Pauly, Gayle Wolff, Steve
Thompson, George Beniek.

The Administrator commented on all the project complaints.

GREAT PLAINS BLVD. STREET IMPROVEMENT PROJECT 73-4
Gene Coulter asked the Village Engineer how they determined the width of
the driveway on Lot 17. Mr. Laska stated that they matched what was
previously there.

Mr. Coulter asked if there were 7 homes down that road if the same 15 foot
approach would have been made. Mr. Laska stated that it was designed for
the existing conditions.
Gene Coulter asked if the 15 foot roadway is adequate for the existing
conditions.
Roger Pauly was present representing Mr. Stodola and Mr. Pauly in regards
to the apartments. He wanted to know what the assessment procedure was
for this project. He gave a presentation in regards to reassessing the
apartment building.
The apartments were assessed as follows:

A motion was made by Councilman Neils and seconded by Councilman Kurvers

CHANHASSEN VILLAGE COUNCIL MINUTES - October 29, 1973
The special Village Council meeting was called to order on October 29, 1973
at 9:45 p.m. in the Village Hall by Mayor Klingelhutz, and was opened with
the Pledge to the Flag. The following members of the Village Council were
present: Mayor Klingelhutz, Councilmen Bennyhoff, KUrvers and Neils.
Councilman Wolf was absent.
CARVER BEACH ROAD: Jurgen Johnson wanted to know of any action to be taken
by the Council regarding this vacated road at Carver Beach. Discussion
followed.
A motion was made by Councilman Bennyhoff and seconded by Councilman Neils
to authorize Russ Larson to study this probelm at Carver Beach and report
back to the Council. The following voted in favor thereof: Mayor Klingelhutz,
Councilmen Bennyhoff, Kurvers, and Neils. No negative votes. Motion carried.
NSA EASEMENT EXCHANGE: A motion was made by Councilman Bennyhoff and
seconded by Councilman Kurvers to adopt Resolution 1029731 to grant a
uick claim deed to Mr. Beddor to cancel out the existing easement. The
~ollowing voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, I
Kurvers, No negative votes. Motion carried.

FIRE DEPT. CHECK: A motion was made by Councilman Bennyhoff and seconded
I by Councilman Neils to issue a check to the Fire Dept. in the amount of
$4,121.62. The following voted in favor thereof: Mayor Klingelhutz,
Councilmen Bennyhoff, Kurvers and Neils. No negative votes. Motion carried.
BUESGENS OFFICE PARK PROJECT 73-10: A motion was made by Councilman
Kurvers and seconded by Councilman Neils to approve resolution 1029732
instructing the Village Engineer to prepare detailed plans and specifications
and acquire the necessary easements for Buesgens Office Park Project 73-10.
The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers and Neils. No negative votes. Motion carried.
A motion was made by Councilman N~ils and seconded by Councilman Bennyhoff
to table any action on accepting or rejecting the bids on project 73-10
until November 5, 1973. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers and Neils. No negatiove
votes. Motion carried.
GREAT PLAINS BLVD. PROJECT 73-4: A motion was made by Councilman Bennyhoff
and seconded by Councilman Neils to approve resolution 1029733 entitled
Adoption of Assessment Role for Street Improvement Project 73-4 as pre-
sented by the Village Engineer. The following voted in favor thereof:
Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Neils. No negative
votes. Motion carried.

A motion was made by Councilman Bennyhoff and seconded by Councilman Néils
to set the years of payment on Project 73-4 at 10 years with 7% interest.
The following voted in favor thereof; Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers and Neils. No negative votes. Motion carried.
All persons in regards to this project should be notified by the Village
that the assessment rolls have been adopted.
RICHARD ORDAL: Mr. Ordal and his attorney were present to inquire about
the problems in getting a building permit.
The Village Attorney read the recommendation made by the Park and Recreation
Commission from August 11, 1973 minutes. The recommendation from the
Board of Adjustments and Appeals was also read.
The Village Clerk will send all availatie information regarding this
matter to Mr. Ordahl and his attorney, at which time the Village Council
and Mr. Ordal and his attorney will meet to discuss the matter.

SNOW PLOW: Henry Wrase was present requesting a 71 foot reversible snow
plow for cul-de-sacs. Discussion followed. Action will be taken on
November 5, 1973.

BOND SURPLUS: A motion was made by Councilman Bennyhoff and seconded by
Councilman Neils to approve Resolution 1029734 entitled Requesting I
a Levy of $37,737.66 for Bond and INterest due to a surplus in our Bond
and INterest fund. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers and Neils. No negative votes.
Motion carried.
CHANHASSEN ESTATES SECOND ADDITION: Frank Laska, Village Engineer reported
on his letter of October 24, 1973 in regards to the Streets in Chanhassen
Estates 2nd Addition. The Engineer recomends the Village consider a
2 year agreement with road contractors.
A motion was made by Councilman Kurvers and seconded by Councilman Bennyhoff
for the Village to check out this road with borings every 100 feet to
check the thickness of the blacktop. The following voted in favor thereof:
Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Neils. No negative
votes. Motion carried.
PARK BONDS: A motion was made by Councilman Neils and seconded by Councilman
Kurvers to approve Resolution 1029735 entitled Authorizing the Deputy
Clerk-Administrator to Execute Bonds of the issue of $275,000 Park and
Equipment Refunding Bonds and closing P?pers. The following voted in favor
thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Neils.
No negative votes. Motion carried.
BUILDING/PLUMBING INSPECTOR: A discussion was held in regards to Jerry
Schlenk becoming the Building/Plumbing Inspector and Assisstant Zoning
Administrator. Jerry Boucher then would take over Jerry Schlenk's
position as Utility Foremen.

A motion was made by Councilman Kurvers and seconded by Councilman Neils
for the Village Clerk to advertise for a maintenance/Mechanic position.
The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff,
Kurvers and Neils. No negative vote~. Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Councilman Neils
to adjourn the meeting. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers, and Neils. No negative votes.
