1973 11 05 CHANHASSEN VILLAGE COUNCIL MINUTES - November 5, 1973 -1- I The regular Chanhassen Village Council meeting was called to order at 7:30 p.m. on November 5, 1973 by Acting Mayor James Bennyhoff and was opened with the Pledge to the Flag. The following members were present: Acting Mayor Bennyhoff, Councilman Kurvers, Neils and Wolf. MINUTES: A motion was made by Councilman Neils and seconded by Councilman Wolf to approve the October 15, 1973 Council minutes. The following voted in favor thereof: Acting Mayor Bennyhoff, Councilmen Kurvers, Neils and Wolf. No negative votes. Motion carried. The Clerk-Administrator will write a letter to the Renaissance Fair Personnel in regards to the removal of the structure on the grounds used for the 1973 Renaissance Festival. A motion was made by Councilman Neils and seconded by Councilman Wolf to approve the October 23, 1973 Council minutes. The following voted in favor thereof: Acting Mayor Bennyhoff, Councilmen Kurvers, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Neils and seconded by Councilman Kurvers to approve the October 23, 1973 minutes of the Assessment Hearing on Great Plains Blvd. Project 73-4. The following voted in favor thereof: Acting Mayor Bennyhoff, Councilmen Kurvers, Neils and Wolf. No negative votes. Motion carried. I A motion was made by Councilman Kurvers and seconded by Councilman Neils to approve the October 29, 1973 minutes of the Public Hearing on Buesgens Office Park Project 73-10. The following voted in favor thereof: Acting Mayor Bennyhoff, Councilmen Kurvers, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Kurvers and seconded by Councilman Neils to approve the October 29, 1973 minutes of the Continuation of Public Hearing on Great Plains Blvd. Street Improvement Project 73-4. The follow- ing voted in favor thereof: Acting Mayor Bennyhoff, Councilmen Kurvers, Neils and Wolf. No negative votes. Motion carried. Mayor Klingelhutz entered the room. A motion was made by Councilman Neils and seconded by Councilman Kurvers to approve the October 29, 1973 special Council minutes. The following voted in favor thereof: Acting Mayor Bennyhoff, Mayor Klingelhutz, Councilmen Kurvers, Neils and Wolf. No negative votes. Motion carried. Mayor Klingelhutz took charge of the meeting. PLANNING COMMISSION MINUTES: A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff that the special Planning Commission minutes of October 17, 1973 be noted and read. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. I CHANHASSEN VILLAGE COUNCIL MINUTES - November 5, 1973 -2- PLANNING COMMISSION MINUTES: A motion was made by Councilman Kurvers and seconded by Councilman Bennyhoff that the Planning Commission minutes of I October 24, 1973 be noted~d read. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. PARK AND RECREATION MINUTES: A mdion was made by Councilman Wolf and and seconded by Councilman Kurvers that the Park and Recreation Commission minutes of October 16, 1973 be noted and read. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. HUMAN RIGHTS COMMISSION MINUTES: A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff that the Human Rights Commission minutes of October 25, 1973 be noted and read. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils,and Wolf. No negative votes. Motion carried. HAROLD HESSE PROPERTY: Mr. Harold Hesse and Mr. Herb Baldwin were present requesting a variance to Ordinance #45, Sections 2.01 and 2.02. Discussion followed. A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf to approve a variance to Ordinance 45 Section 2.01. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Wolf and seconded by Council~an Kurvers I to approve a variance to Ordinance 45 Section 2.02 for the Hesse Property. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. The grant of these variances in no way constitutes acceptance of the preliminary plat. MINNETONKA SCHOOL DISTRICT 276 ASSESSMENTS: Mr. Huskins, Chairman of the Minnetonka School Board and Mr. McKay and Mr. Bergman were present repre- senting School District 276. Mr. Huskins gave a presentation in regards to adjusting the sewer and water assessment charges at West Jr. High school. Discussion followed. A decision will be made on November 19, 1973 in regards to this matter. BURDICK PARK ADDITION: Mr. Brenny and Mr. Burdick were present requesting Street Improvements in the Frontier Development Park. The Council told them a written request from them would be necessary before any action can be taken. BUESGENS OFFICE PARK PROJECT 73-10: Bill Brezinsky, Village Engineer presented the bids on Water Main Project 73-10, Buesgens Office Park. A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf to approve resolution. 115731 entitled Accepting the Low Bid from McGrand and Frovarp in the amount of $19,422.54. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. HETHERINGTON TREES: A motion was made by Councilman Neils and seconded by Councilman Wolf to reimburse Mr. Hetherington $250.00 for two willow trees per contract agreement. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. I DRY CLEANING BILL: A motion was made by Councilman Neils and seconded by Councilman Kurvers to pay Country Cleaners $4.50 for dry cleaning the curtains for the Election Booths. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. Mayor Klingelhutz left the room and Acting Mayor Bennyhoff took over the meeting. MINNEWASHTA HEIGHTS STORM SEWER: Bill Brezinsky presented a letter regard- ing a contract amendment for the Minnewashta Heights Storm Sewer. A motion was made by Councilman Wolf and seconded by Councilman Kurvers to approve the contract amendment on Project 73-7 in the amount of $5,200.00 to G & L Contracting and authorize the Mayor and Administrator to sign the contract amendment. The following voted in favor thereof: Acting Mayor Bennyhoff, Councilmen Kurvers, Neils and Wolf. No negative votes. Motion carried. Mayor Klingelhutz entered the room and took over the meeting. I SNOW PLOW: A motion was made by Councilman Kurvers and seconded by Council- man Bennyhoff to approve the price quote of $1,901.50 from Hayden-Murphy Co. for an 11 foot reversible snow plow. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Kurvers and seconded by Councilman Wolf for a temporary transfer of 1,901.50 from the Utility fund to the General Fundy paying back the money at the first quarter of 1974 and 1975 at 7%. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. CHANHASSEN VILLAGE COUNCIL MINUTES - November 5, 1973 -4- BUILDING/PLUMBING INSPECTOR: A motion was made by Councilman Kurvers and seconded by councilman. Bennyhoff to approve Resol.ution 1.157.32 apPoint.ing Jerr:1 Schlenk to Building and Plumbing Inspector and Assistant Zoning Administrator at his present salary of $890.00. Further on Jan. 1, 1974 his salary will be increased to 1,020.00 per montb. The followÎng'voted 'in favor thereof: Mayor Klingeihutz, Councilman Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carrie~. A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf to approve resolution 115733 appointing Jerry Boucher to Utility Maintenance Foreman 1. He will gßt a salary increase of 20.00 for the remainder of 1973 which will bring his salary to 696.00 per month. Commencing in 1974 he would received the Council proposed salary of 98.86 increase making his salary 794.86. When Mr. Boucher passess h~ sewer test he will receive a 25.00 per month increase and the same for the water test. His total salary in 1974, if he meets these requirements would be $844.86. STATE HIGHWAY: A motion was made by Councilman Wolf and seconded by Councilman ~ Neils to approve resolution 115734 approving the Highways preliminary plans for improvement for a part of Trunk Highways 169,212 and 101 renumbered as Trunk ~ighway Number 5,51 and 187. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes.' Motion carried. See minutes of November 27, 1973. ORDINAN..C. E 29: A motion was made by Councilman Wolf and seconded by councilmarl Kurvers to change Land description plate numbers 66DO, 69DO and l65Do from Agricuitural to Non-Agricultural. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. LABOR RELATION CONFERENCE: A motion was 'made by Councilman Bennyhoff and sec- onded by Councilman Neils to pay Mr. Schnelle's fee for the Labor Relation Conference on November 8, 1973. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion. carried. A motion was made by Councilman Bennyhoff and seconded by Councilman Kurvers to pay:expenses for any Council member who will be able to attend the Labor Relation Conference on November 8, 1973. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kuruers, Neils and Wolf. No negative votes. Motion carried. EARL LÚND ASSESSMENT: A discussion was held in regards to a letter from Mr. and MrS. Earl Lund on a deferred assessment of $3,669.00 on lot 9, which isa vacant lot next to their home. A motion was made by Councilman Kurvers and seconded by Councilman Bennyhoff to table any action regarding this deferred assessment until November 19, 1973 at which time more information will be available. DELORES ROMAN: A motion was made by Councilman Bennyhoff and seconded by Councilman Kurvers to grant a final extension to Delores Roman, for 6 months, I for her trailer house on Lot 35 Block 4 Red Cedar Point. The trailer will have to be removed by April, 1974. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. HORSE ORDINANCE: The Council requests the Village Atto~ney to draft a horse ordinance. A motion was made by Councilman Bennyhoff and seconded by Councilman Neils to adjourn the meeting.
