CHANHASSEN VILLAGE COUNCIL MINUTES - December 17, 1973

The regular Chanhassen Village Council meeting,was called to order at
7:30 p.m. on December 17, 1973 by Mayor Klingelhutz and was opened with
the Pledge to the Flag. The following members were present: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers and Neveaux. Councilman Wolf
was absent.
MINUTES: A motion was made by Councilman Kurvers and seconded by Council-
man Bennyhoff to approve the December 3, 1973 minutes after the following
addition on page 3 under Hoist for Utility Truck: "A motion was made by
Councilman Kurvers and seconded by Councilman Bennyhoff to authorize the
purchase of the Hoist for the Utility Maintenance Truck from the L-Z Co.
in the amount of $5400.00. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers, Neveaux and Wolf. No negative
votes. Motion carried. II The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers and Neveaux. No negative votes.
Motinn carried.
PLANNING COMMISSION MINUTES: A motion was made by Councilman Bennyhoff
and seconded by Councilman Kurvers that the Planning Commissinn minutes
of December 12, 1973 be noted and read. The following voted in favor
thereof: Mayor Klingelhutz, Councñmen Bennyhoff, Kurvers and Neveaux.
No negative votes. Motion carried.
Councilman Wolf entered the meeting.
PARK AND RECREATION COMMISSION MINUTES: A motion was made by Councilman
Kurvers and' seconded by Councilman Bennyhoff that the Park and Recreation
Commission minutes of December 4, 1973 be noted and read. The following
voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers,
Neveaux and Wolf. No negative votes. Motion carried.
At the next Council meeting a representative will be present to discuss
snowmobile trails through Lake Ann Park.
HOUSING STUDY COMMITTEE MINUTES: A motion was made by Councilman Bennyhoff
and seconded by Councilman Wolf that the Housing Study Committee minutes
of December 5, 1973 be noted and read. The following voted in favor thereof:
Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neveaux and Wolf. No
negative votes. Motion carried.
INDUSTRIAL COMMISSION MINUTES: A motion was made by Councilman Bennyhoff
and seconded by Councilman Neveaux that the Industrial Commission
minutes of December 11, 1973 be noted and read. The following voted in
favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neveaux
and Wolf. No negative votes. Motion carried.
The Village Attorney and Administrator will work with the CBD and
Industrial Commission to set up a plan for working with Industrial and
Commercial plans coming into othe Village.
The Village Attorney will wo.rk on the name change in the Industrial
Commission Ordinance.

PAY BILLS: A motion was made by Councilman Bennyhoff and seconded by
Councilman Neveaux to approve payment of all bills except for 10% of
$7,644.66 to Burroughs Co. payable when all programs are working on I
the accounting machine. The following voted in favor thereof: Mayor '
Klingelhutz, Councilman Bennyhoff, Kurvers, Neveaux and Wolf.
MINNETONKA SCHOOL DISTRICT ASSESSMENT: A motion was made by Councilman
Bennyhoff and seconded by Councilman Wolf that this Council is standing
firm on the position in our memorandum of December 13, 1973 from the
Village Attorney. The following voted in favor thereof: Mayor Klingelhutz,
Councilmen Bennyhoff, Kurvers and Wolf. Councilman Neveaux abstained.
No negative votes. Motion carried.
MINNETONKA SCHOOL DISTRICT: No decision will be made on the "Memorandum of
Understaning" until after the ViTIage Attorney reviews it.
MAPSI, INC: A motion was made by Councilman Bennyhoff and seconded by
Councilman Neveaux to approve the 1974 Dog Patrol Contract. The following
voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers,
Neveaux and Wolf. No negative votes. Motion carried.
POLICE CONTRACT: A motion was made by Councilman Kurvers

ESTABLISHING ESCROW AMOUNT IN LIEU OF PERFORMANCE BOND FOR REPAIR OF PAVE- I
MENT IN CHANHASSEN ESTATES SECOND ADDITION: A motion was madé by Council-
man Bennyhoff and seconded by Councilman Wolf releasing the bond of
Chanhassen Estates 2nd Addition and taking $1,500.00 in escrow for the
work to be done on streets, as stated in Schoell and Madson, Inc.'s letter
'dated December 17, 1973. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers and Wolf. Councilman Neveaux
abstained from voting. No negative votes. Motion carried.
MINNEWASHTA HEIGHTS STORM SEWER: A motion was made by Councilman Neveaux
and seconded by Councilman Wolf to approve Resolution 1217731 for a Public
Hearing to be held on January 21, 1974 at 7:30 p.m. for the Minnewashta
Heights Storm Sewer. The following voted in favor thereof: Mayor Klingel-
hutz, Councilmen Bennyhoff, Kurvers, Neveaux and Wolf. No negative votes.
Motion carred.
LOCAL FUEL-COORDINATOR: A motion was made by Councilman Bennyhoff and
seconded by Councilman Neveaux to appoint Willard Johnson to be the Local
Fuel Coordinator. The following voted in favor thereof: Mayor Klingelhutz,
Councilmen Bennyhoff, Kurvers, Neveaux and Wolf. No -negative votes. Motion
carried.
RENAMING OF CHASKA ROAD: The Administrator will check with Shorewood on
renaming of the street.
ASSESSMENT POLICY: A motion was made by Councilman Neveaux and seconded I
by Councilman Kurvers to table any action on the request for an assessment
policy and in the meantime instruct the Village Administrator to prepare . ,
guidelines for the Council to review. The following voted in favor there-
of: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neveaux and Wolf.
No negative votes. Motion carried.

CIGARETTE LICENSES FOR 1974: A motion was made by Councilman Bennyhoff
and seconded by Councilman Wolf to approve the $12.00 1974 Cigarette
Licenses for the following: American Legion Post 580, Bart's Pharmancy,
Kenny'f Meats, Chalet Pizza, Chanhassen Dinner Theatre, Chanhassen
Conoco, Brown's Standard, M.A. Gedney Co., FasGas Station, Imperial
Service Station, Leach's Resort, O'Leary's Kitchen, Pauly's Bar, Inc.,
Riviera Club, Chanhassen DX Station, Chanhassen Texaco. The following
voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff,
Kurvers, Neveaux and Wolf. No negative votes. Motion carried.
RENAISSANCE FESTIVAL: Ms. Rork was present from the Renaissance Festival.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Wolf to grant the request from, the Renaissance Festival to allow the
Children's Theatre to be taken down by June I, 1974. The following voted
in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and
Wolf. Councilman Neveaux abstained from voting. No negative votes.
Motion carried.
AGREEMENT FOR PRESECUTION SERVICES: A motion was métde by Councilman Wolf
and seconded by Counc~lman Kurvers to approve the agreement for Presecu-
tion Services with Carver County. The following voted in favor thereof:
Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neve~ux and Wolf. No
n~gative votes. Motion carried.
RAILROAD CROSSING: The Administrator will be preparing a resolution on
s~gnal lights on Highway 117.
RÖAD VACATIO~: The Village Administrator will look into the vacating
of the road in Carver Beach requested by Jurgen Johnson.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Neveaux to adjourn the meeting.
Councilman Bennyhoff withqrew his motion and Councilman Neveaux withdrew
his second.
PLANNING COMMISSION APPOINT~ŒNT: A motion was made by Councilman Neveaux
and seconded by Councilman Wolf to appoint Mariana Shulstad to fill the
unexpired term of John Neveaux expiring 12-3l-74 and to appoint Dave
Reed to fill Arnie Ryba's unexpired term expiring 12-31-76. The following
voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers,
Neveaux and Wolf. No negative votes. Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Kurvers to adjourn the meeting. The following voted in favor thereof:
Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neveaux and Wolf. No
negative votes. Motion carried.
