1974 01 07CHANHASSEN CITY COUNCIL MINUTES - January 7, 1974 -1- The regular Chanhassen City Council meeting was called to order at 7:30 p.m. on January 7, 1974 by Mayor Klingelhutz and was opened with the Pledge to.the Flag. The following members were present: Mayor Klingelhutz, Councilmen Hobbs, Kurvers and Neveaux. Councilman Bennyhoff was absent. COUNCIL ORGANIZATION: OATH OF OFFICE: An oath of office was taken by re- elected Mayor Klingel- hutz. The oath was signed and filed with the City Clerk. PLANNING COMMISSION: A motion was made by Councilman Neveaux and seconded by Councilman Kurvers to appoint Dave Reed to the Planning Commission for a three (3) year term expiring 12- 31 -76. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Hobbs, Kurvers and Neveaux. No negative votes. Motion Carried. Councilman Bennyhoff entered the meeting. ACTING MAYOR: A motion was made by Councilman Kurvers and seconded by Councilman Neveaux that Councilman Bennyhoff be appointed Acting Mayor to serve in the absence of the elected Mayor. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Hobbs, Kurvers, Bennyhoff and Neveaux. RULES OF ORDER: A motion was made by Councilman Bennyhoff and seconded by Councilman Neveaux that the Village adopt the procedures set forth in the Handbook for Minnesota Cities and use the revised edition of Roberts Rules of Order.-to supplement. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux. No negative votes.. Motion carried. OFFICIAL NEWSPAPER: A motion was made by Councilman Bennyhoff and seconded by Councilman Hobbs to delay action on the City's official newspaper until January 21, 1974. The following voted -in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and.Neveaux. No negative votes. Motion carried. OFFICIAL BANK: A motion was made by Councilman Bennyhoff and seconded by Councilman Kurvers that the State Bank of Chanhassen be designated as the official depository for all City monies. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux. No negative votes. Motion carried. There.are no shareholders, officers or trustees in the State Bank of Chanhassen on the City Council. MEETING NIGHTS: A motion was made by Councilman Bennyhoff and seconded by Councilman Neveaux that the regular City Council meeting nights be the•lst and 3rd Mondays of the month at 8:00 p.m. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux. No negative votes. Motion carried. CHANHASSEN CITY COUNCIL MINUTES - January 7, 1974 -2- AGENDA SYSTEM: A motion was by Councilman Hobbs that all and said agenda to be closed meeting. The following vote Councilmen Bennyhoff, Hobbs, Motion carried. made by Councilman Bennyhoff and seconded meetings be conducted on the agenda system on Thursday, 1:00 p.m., prior to the next 1 in favor thereof: Mayor Klingelhutz, Kurversand Neveaux. No negative votes. III CITY ATTORNEY: A motion was made by Councilman Bennyhoff and seconded by Councilman Kurvers that Russell H. Larson be appointed the City Attorney at a fee rate to be charged on an hourly basis. The following voted in favor thereof: Mayor KlingelhLtz, Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux. No negative votes. Motion carried. FINANCIAL CONSULTANT: A motion was made by Councilman Neveaux and seconded by Councilman Hobbs to table the appointment of the Financial Consultant until January 21, 1974. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux. No negative votes. Motion carried. CITY ENGINEERS: A motion was made by Councilman Bennyhoff and seconded by Councilman Neveaux that Schoell and Madson be appointed as City Engineers. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Hobbs and Neveaux. No negative votes. Motion carried. AUTOMATIC BILLS: A motion was made by CouncilmanBennyhoff and seconded by Councilman Neveaux that all utility bills, salaries and wages be paid automatically. Salaries and wages shall be the lst and 15th day of every month. Overtime shall be paid on the next pay period after sub- mitted. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux. No negative votes. Motion carried. COUNCIL SALARIES: A motion was made by Councilman Bennyhoff and seconded by Councilman Kurvers that the Village Council salaries be set according to Ordinance #52 as follows: Mayor - $100.00 per month, Councilmen - $75.00 per month, and shall be paid mon -ly. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux. No negative votes. Motion carried. PURCHASING: A motion was made by Councilman Bennyhoff and seconded by Councilman Neveauxthatpurchasing may be made in accordance to Resolution #36721 entitled Resolution Creating the Position of Clerk- Administrator. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux. No negative votes. Motion carried. CHECK SIGNATURES: A motion was made by Councilman Bennyhoff and seconded by Councilman Kurvers that the authorized signatures on all City checks be the Mayor, Treasurer and Clerk - Administrator. The following voted in favor thereof: Mayor Klingelhutz, Counc2men Bennyhoff, Hobbs, Kurvers and Neveaux. No negative votes. Motion carried. WEED INSPECTOR: Mayor Klingelhutz, who is the automatic Weed Inspector or the City, oes so appoint Henry Wrase as Deputy Weed Inspector. CHANHASSEN CITY COUNCIL MINUTES - January 7, 1974 Page 3 BONDS: A motion was made by Councilman Bennyhoff and seconded by Councilman Hobbs that the following be bonded for- Treasurer-Deputy Clerk 10,000.00 Clerk - Administrator 5,000.00 All other City Employees and Councilmen 2,500.00 The follodng voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux. No negative votes. Mgtion carried. FINANCIAL AUDIT: A motion was made by Councilman Bennyhoff and seconded by Councilman Hobbs that the firm of Hoffman and Hoffman be hired to prepare the audit to be presented no later than June 30, 1974. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux. No negative votes. Motion carried. ASSESSOR: A motion was made by Councilman Neveaux and seconded by Councilman Kurvers that the Carver County Assessor shall do the assessing in the City of Chanhassen for the year 1974, as per state statute. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux. No negative votes. Motion carried. SAFETY DEPOSIT BOX: A motion was made by Councilman Bennyhoff and seconded by Councilman Kurvers that the following persons be authorized to enter the City safety deposit box maintained in the State Bank of Chanhassen: 1. Treasurer 2. Mayor 3. Clerk - Administrator The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff,. -Hobbs., Kurver-s• and Veveaux : No - negative votes. Motion carried. CHANHASSEN CITY COUNCIL MINUTES - January 7, 1974 -4- SECRETARIAL HELP: (Persons taking Planning Commission, Park and Recreation Commission, Council, Human Rights Commission and Industrial Commission minutes): To be hired at the rate of $2.25 per hour. CIVIL DEFENSE DIRECTOR: A motion was made by Councilman Kurvers and seconded by Councilman Neveaux that Charles Anding be appointed Civil Defense Director. The following voted in favor thereof: Mayor Klingdhutz, Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux. No negative votes. Motion carried. FIRE MARSHAL: A motion was made by Councilman Neveaux and seconded by Councilman Hobbs that Harold Lund be appointed as Fire Marshal. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux. No negative votes. Motion carried. DEPUTY CLERK: A motion was made by Councilman Neveaux and seconded by Councilman Kurvers that Gerald W. Schlenk be appointed Deputy Clerk. The following voted in favor thereof: Mayor Klingeehutz, Councilmen Bennyhoff, Kurvers, Hobbs and Neveaux. No negative votes. Motion carried. HEALTH OFFICER: A motion was made by Councilmen Bennyhoff and seconded by Councilman Neveaux to table appointment of the Health Officer until January 21, 1974. The following voted in favor thereof: Mayor Klingelhutz, Councilman Bennyhoff, Hobbs, Kurvers and Neveaux. No negative votes. Motion carried. COUNCIL MINUTES: A motion was made by Councilman Kurvers and seconded by Councilman Bennyhoff to approve the December 17, 1973 Council minutes. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux. No negative votes. Motion carried. SPECIAL PLANNING COMMISSION MINUTES: A motion was made by Councilman Kurvers and seconded by Councilman Neveaux that the Planning Commission minutes of December 15, 1973 be noted and read. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux. No negative votes. Motion carried. A motion was made by Councilman Neveaux and seconded by Councilman Bennyhoff that the administrator be directed to incorporate the changes requested by the Planning Commission into the new personal data 'sheet and he will work with the other commissions for additional suggestions on a revised personal data sheet. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux. No negative votes. Motion carried. PARK AND RECREATION MINUTES: A motion was made by Councilman Neveaux and seconded by Councilman Bennyhoff that the Park and Recreation Commission minutes of December 18, 1973 be noted and read. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux. No negative votes. Motion carried. SEWER AND WATER ASSESSMENT - Mr. & Mrs. E.J. Lundquist: Mr. & Mrs. E.J. Lundquist were present to explain their problem. Mr. & Mrs. Lundquist sent a registered letter to the City stating they would be unable to attend the Public Hearing and would the City please inform them of their assessment. Page 5 CHANHASSEN CITY COUNCIL MINUTES - January 7, 1974 SEWER AND WATER ASSESSMENT, CONTINUED: A motion was made by Councilman Hobbs and seconded by Councilman Neveaux that Mr. & Mrs. E.J. Lundquist be refunded $382.29 for 15 months interest paid on there assessment. The interest was refunded because the City did not inform them in regards to there assessment. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux. Motion carried. A motion was made by Councilman Kurvers and seconded by Councilman Bennyhoff that from now on the City will notify by mail all people con- cerned after the assessment roll has been adopted. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Hobbs and Neveaux. No negative votes. Motion carried. ACCRETIONS - RED CEDAR POINT: Craig Mertz and Russ Larson explained their letter dated January 2, 1974 in regards to the Accretions at Red Cedar Point. Discussion followed. A motion was made by Councilman Kurvers and seconded by Councilman Bennyhoff to grant a quick claim deed to the accretions of Lots 2,3,4,5,6 and 7 in Block 4, Red Cedar Point and authorizing the Mayor and Clerk - Administrator to sign the quick claim deeds. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff and Kurvers. Councilman Neveaux voted no. Councilman Hobbs abstained. Motion carried. MINNETONKA SCHOOL DISTRICT: A motion was made by Councilman Neveaux and seconded by Councilman Hobbs to approve the "Memorandum of Understanding" from the Minnetonka School District Community Schools. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux. No negative votes. Motion carried. CHALET PIZZA BUILDING PERMIT: A motion was made by Councilman Neveaux and seconded by Councilman Bennyhoff to grant Chalet Pizza a Building Permit for remodeling of the building providing the exterior remodeling will conform with the present exterior. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and Wolf. No negative votes. Motion carried. METRO TRANSIT COMMISSION: Ed Hjermstad was present to discuss the Metro Transit Commission and the Richfield Bus Company. A motion was made by Councilman Bennyhoff and seconded by Councilman Kurvers to instruct the Village Clerk to write up a resolution #0002 -74 allowing the MTC Bus from Jonathan to stop in Chanhassen on route to Southdale and Minneapolis to broaden the bus service in Chanhassen. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux. No negative votes. Motion carried.. MINNETONKA SCHOOL DISTRICT: A discussion was held in regards to the Minnetonka School District Assessment. A motion was made by Councilman Bennyhoff and seconded by Councilman Hobbs for the City Clerk - Administrator and the City Attorney to write a letter responding to the Minnetonka School Board stating the City of Chanhassen is standing firm with the $79,500.00 offer and feel it's fair we have negotiated as far as we can.
