The regular Chanhassen City Council meeting was called to order at 8:00 p.m.
on February 4, 1974 by Mayor Al Klingelhutz and was opened with the Pledge
to the Flag. The following members were present: Mayor Klingelhutz,
Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux.
MINUTES: A motion was made by Councilman Bennyhoff and seconded by
Councilman Neveaux to approve the January 21, 1974 Council minutes. The
following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff,
Hobbs, Kurvers and Neveaux. No negative votes. Motion carried.
A motion was made by Councilman Hobbs and seconded by Councilman Kurvers
to amend the January 21, 1974 Public Hearing minutes to include the
letter from Mr. Hallenback, president of the Minnewashta Heights Assn.
dated January 21, 1974. Also that when the City and City Engineers
inspect the Storm Sewer Project 73 -8, that a member of the Minnewashta
Heights Assn. accompany them. The following voted in favor thereof:
Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux. No
negative votes. Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Neveaux to approve the January 21, 1974 Public Hearing minutes as amended.
The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Hobbs, Kurvers, and Neveaux. No negative votes. Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Councilman Hobbs
to amend the January 28, 1974 minutes under Lake Ann Phase II Sanitary
Sewer Line to read as follows: "After a lengthy discussion between the
Council and the land owners and developers, the Council stated they would
further consider the sewer project if in addition to the special assessment
for the trunk sewer costs that the land owners - developers served by
the system establish a fund as security for payment of the assessment.
The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Hobbs, Kurvers and Neveaux. No negative votes. Motion carried.
A motion was made by Councilman Kurvers and seconded by Councilman Hobbs
to approve the January 28, 1974 minutes as amended. The following voted
in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers
and Neveaux. No negative votes. Motion carried.
PLANNING COMMISSION MINUTES: A motion was made by Councilman Bennyhoff
and seconded by Councilman Hobbs that the Planning Commission minutes
of January 23, 1974 be noted and read. The following voted in favor
thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and
Neveaux. No negative votes. Motion carried.
PARK AND RECREATION COMMISSION MINUTES: A motion was made by Councilman
Kurvers and seconded by Councilman Bennyhoff that the Park and Recreation
Commission minutes be noted and read. The following voted in favor thereof:
Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux. No
negative votes. Motion carried.
NEXT COUNCIL MEETING: A motion was made by Councilman,Kurvers and seconded
by Councilman Hobbs that the Council hold an official meeting on Feb. 18,
1974, a legal holiday because it is a public necessity. The following
voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs,
Kurvers and Neveaux. No negative votes. Motion carried.

PUBLIC SERVICE COMMISSION HEARING ON COUNTY #14: A motion was made by
Councilman Hobbs and seconded by Councilman Kurvers for the City Administrator
to send a letter to the Public Service Commission in regards to the County
#14 and Chicago and Northwestern Railroad Crossing, and state that in
addition to the proposed installation of safety equipment to include
tarring and a rumble strip by the crossing. The following voted in favor
thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and
Neveaux. No negative votes. Motion carried.
TECHNICAL SERVICE REQUEST: A motion was made by Councilman Bennyhoff and
seconded by Councilman Neveaux to adopt Resolution #0006 -74 requesting
technical assistance from the State Highway Dept. in repairing our traffic
counters. The following voted in favor thereof: Mayor Klingelhutz,
Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux. No negative votes.
Motion carried.
LEGISLATIVE ACTION CONFERENCE: A motion was made by Councilman Bennyhoff
and seconded by Councilman Kurvers to pay fees of $8.00 for the Legislative
Action Conference on February 28, 1974 for anyone from the City Attending.
The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff,
Hobbs, Kurvers and Neveaux. No negative votes. Motion carried.
DOG ORDINANCE PROBLEMS: Four residents from Chanhassen Estates were present
asking about the present dog ordinance and if the Council is considering
a tougher ordinance.
The City Attorney will be working on a new ordinance incorporating stiffer
penalties into it.
HOUSING REDEVELOPMENT AUTHORITY: A motion was made by Councilman Neveaux
and seconded by Councilman Hobbs to adopt Resolution #0007 -74 establishing
a Public Hearing on March 18, 1974 at 7 :00 p.m. to determine whether there
is a need for a municipal housing redevelopment authority in the City of
Chanhassen. The following voted in favor thereof: Mayor Klingelhutz,
Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux. No negative votes.
Motion carried.
AMENDMENT TO ZONING ORDINANCE #47: The City Attorney went over the proposed
changes in Ordinance #47.
A motion was made by Councilman Bennyhoff and seconded by Councilman Hobbs
that under Section 13.04 Procedures, insert zoning Administrator in the
first blank and $20,000.00 in the second blank. The following voted in
favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Hobbs and
Neveaux.. No negative votes. Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Councilman Kurvers
to adopt Resolution #0008 -74 regarding Ordinance 47 -A, amending sections
19.10(1), 12.12(1), 13, 19.18, 19.19, 23.06(5) and 23.10. The following
voted in favor thereof: Mayor Klingelhutz, Counc -Umen Bennyhoff, Hobbs,
Kurvers and Neveaux. No negative votes. Motion carried.
RENAISSANCE FESTIVAL, INC: The City Attorney prepared recommended provision
for a Conditional Use Permit for the Renaissance Festival, Inc. of which
was supplied to each council members. Three residents,abutting property
owners of the proposed Renaissance Festival site were present. A
discussion followed.

MUNICIPAL LIQUOR LICENSE: After much discussion the Council postponed set-
ting the Liquor license fees until more information on cabaret and enter-
tainment fees is supplied to each council member. All liquor license
applicants will be notified that fees will probably increase and when
this will take place.
CARVER COUNTY LAW ENFORCEMENT ADVISORY COUNCIL: A motion was made by
Councilman Bennyhoff and seconded by Councilman Neveaux to support the
constitution to Incorporate the Advisory Council. The following voted
in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers
and Neveaux. No negative votes. Motion carried.
ST. HUBERT'S CHURCH BEER LICENSE: A motion was made by Councilman Bennyhoff
and seconded by Councilman Hobbs to grant a beer license to St. Hubert's
Church for a fee of $1..00 retroactive to 7 -1 -73. The following voted
in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs and
Kurvers. Councilman Neveaux abstained from voting. No negative votes.
Motion carried.
INDUSTRIAL PARK IMPROVEMENT PROJECT 72 -2: A motion was made by Councilman
Bennyhoff and seconded by Councilman Kurvers to pay Widmer Brothers
$7,584.90 as per recommendations from the Engineer's letter of February 4,
1974. The following votedin favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Hobbs, Kurvers and Neveaux. No negative votes. Motion carried.
CITY HALL REMODELING: A motion was made by Councilman Hobbs and seconded
by Councilman Neveaux to accept the following price quotes on the City
Hall remodeling except the painting quote and that the remodeling be done
by day labor:

Electric Frontier Electric 2,050.00
Carpet Frontier 2,321.33
Air Conditioning Volk Heating 850.00
The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers, Hobbs and Neveaux. No negative votes. Motion carried.
CARVER COUNTY THOROUGHFARE PLAN PUBLIC HEARING: Mayor Klingelhutz and
Dan Herbst will be attending this meeting February 5, 1974 at 8:00 p.m.
in Waconia.
MTC: The City Administrator will write up a resolution regarding the
MTC studies.
SNOWMOBILES: The City Administrator will contact the Snowmobile Club
in regards to complaints received by the City.
A motion was made by Councilman Bennyhoff and seconded by Councilman Hobbs
to adjourn the meeting. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Benny::zoff, Hobbs, KSrvers and Neveaux. No negative
votes. Motion carried.
