1974 02 18CHANHASSEN CITY COUNCIL MINUTES - February 18, 1974 -1- The regular Chanhassen City Council meeting was called to order at 8:00 p.m. on February 18, 1974 by Mayor Al Klingelhutz and was opened with the Pledge to the Flag. The following members were present: Mayor Klingelhutz, Councilmen Kurvers and Neveaux. Councilmen Bennyhoff and Hobbs were absent. A motion was made by Councilman Neveaux and seconded by Councilman Kurvers that the City Council feels it is a public necessity and deems it necessary to hold an official Council meeting on a legal holidy, February 18, 1974. The folloiwng voted in favor thereof: Mayor Klingelhutz, Councilmen Kurvers and Neveaux. No negative votes. Motion carried. Councilman Bennyhoff entered the room. MINUTES: A motion was made by Councilman Kurvers and seconded by Council- men Neveaux to approve the February 4, 1974 Council minutes. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Neveaux. No negative votes. Motion carried. PLANNING COMMISSION MINUTES: A motion was made by Councilman Bennyhoff and seconded by Councilman Neveaux that the regular Planning Commission minutes of February 13, 1974 be noted and read. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Neveaux. No negative votes. Motion carried. PUBLIC HEARING MINUTES - RENAISSANCE FESTIVAL INC: A motion was made by Councilman Neveaux and seconded by Councilmen Bennyhoff that the Public Hearing Conditional Use Permit for the Renaissance Festival, Inc. minutes of February 13, 1974 be noted and read. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Neveaux. No negative votes. Motion carried. PARK AND RECREATION COMMISSION: A motion was made by Councilman Bennyhoff and seconded by Councilman Kurvers taht the Park and Recreation Commission minutes of February 5, 1974 be noted and read. The following voted in favor thereof: Mayor Klingelhutz, CouncTmen Bennyhoff, Kurvers and Neveaux. No negative votes. Motion carried. INDUSTRIAL COMMISSION MINUTES: A motion was made by Councilmen Neveaux and seconded by Councilman Kurvers that the Industrail Commission minutes of February 12, 1974 be noted and read. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Neveaux. No negative votes. Motion carried. APPROVAL OF BILLS: A motion was made by Councilman Bennyhoff and seconded by Councilman Neveaux to approve the bills as submitted. A discussion was held in regards to the bills from Schoell and Madson for $2,202.00 and $70.40 for Lamppa Construction Co. In view of the discussion , Councilman Bennyhoff withdrew the motion and Councilman Neveaux withdrew his second. A motion was made by Councilman Bennyhoff and seconded by Councilman Neveaux to approve the bills as submitted except for the bill from Schoell and Madson for $2,202.00 and Lamppa Construction co. for $70.40. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Neveaux. No negative votes. Motion carried. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Neveaux. No negative votes. Motion Carried. RENAISSANCE FESTIVAL CONDITIONAL USE PERMIT: Barbara Rork and Jules Smith were present in regards to a decision on the Conditional Use Permit for the Renaissance Festival. Councilman Neveaux asked Ms. Rork if she had any the Conditional Use Permit. Barbara Rork stated 9 days rather than 6 days with odds being such t better weather. Under Condition #3 she also like the Festival to erect booths and additional 3 or 1974 deadline for removing the booths. questions in regards to she would like the Festival zat they would have one more weekend before 4 days from the Sept. 30, Ms. Rork stated that there is overnight camping of persons with booths at the fair during the Festival days. The mayor asked about the culverts that were installed at the site. Ms. Rork stated she did not know the size of the culverts but she did state that the culverts were the same size as the one that was replaced. Mr. Roger Schmidt stated the residents in this area would be opposed to lengthening of the construction time of the Fair because of the noise and inconvenience involved of the residents. He also wanted to know if there is some way of controling noise during the festival. They would also like the participants entrance changed to the main entrance. Katherine Wyers feels the atmosphere created from the Renaissance is immoral. She also stated that there was a lack of a water supply. Ms. Rork stated they had 2 water trucks and that the State Health Board was out to check this and approved it. Councilman Kurvers asked the attorney about charging a fee from which the City would benefit from the Festival. the City Attorney stated it could probably be worked into the contract. No decision will be made until all Council members are present. ON SALE LIQUOR LICENSES: A motion was made by Councilman Kurvers and seconded by Councilman Neveaux to set the annual On -Sale Liquor License fee at $4,800.00 plus $200.00 for Sunday Liquor Licenses. The following voted in favor thereof: Mayor Klinglehutz, Councilmen Bennyhoff, Kurvers and Neveaux. No negative votes. Motion carried. VALLEY AUTO PARTS: A motion was made by Councilman Neveaux and seconded by Councilman Bennyhoff to authorize the City Attorney's law firm to begin negotiations with Valley Auto Parts. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhof, Kurvers and Neveaux. No negative votes. Motion carried. CHANHASSEN CITY COUNCIL MINUTES - February 18, 1974 -4- NORDSKOVS LETTER DATED JANUARY 31, 1974: A motion was ,made by Councilman Kurvers and seconded by Councilman Neveaux that the Council will take no action on this letter of January 31, 1974 until all fees due to the City are paid in full. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Neveaux. No negative votes. Motion carried. CITY EQUIPMENT OSHA REQUIREMENT: A motion was -made by Councilman Neveaux and seconded by Councilman Kurvers to authorize the City Administrator to pursue putting the City equipment in line with the OSHA requirements and any costs in excess of $1,000.00 be brough back to the Council for approval. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Neveaux. No negative vetes. Motion carried. BIENNIAL CITY ELECTIONS: A motion was made by Counciban Bennyhoff and seconded by Councilman Neveaux to adopt the Ordinance Establishing the the Biennial Election System. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Neveaux. No negative votes. Motion carried. HORSE ORDINANCE: The City Attorney presented each Councilmember with a copy of the Horse Ordinance for study. No action was taken. SUMMER HELP SALARIES: A motion was made by Councilman Bennyhoff and seconded by Councilman Neveaux to approve the summer help salaries as per recommendations in the February 5, 1974 Park and Recreation Commission minutes. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Neveaux. No negative votes. Motion carried. A motion was made by Councilman Bennyhoff and seconded by Councilman Kurvers to adjourn the meeting.
