The regular Chanhassen City Council meeting was called to order at
8:00 p.m. on June 3, 1974 by Mayor Klingelhutz, and was opened with
the Pledge to the Flag. The following members were present: Mayor
Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux.
MINUTES: A motion was made by Councilman Kurvers and seconded by
Councilman Hobbs to approve the May 20, 1974 Council minutes after the
following amendments:
1. On Page 3 under Sunrise Hills Association, paragraph 3, add to
the motion "the assessment be deferred until a building permit
is taken out or the lot is sold.
2. On page 3, under Minnewashta Woods PUD -1, add "the Preliminary
Plat was approved." Also add the following information: When
additional sewer is needed in this area or until Mr. Pope's property
is developed, the entire Storm Sewer area will have to be assessed.
In the developer's contract it should state that the required storm
sewer has been put in and paid for by the developer, so at the time
when additional storm sewer is needed, these people in the area
will not have to bare additional costs for the storm sewer.
3. Under Park and Recreation'Commission Minutes, it was noted that
the motion concerning the bus fees does not have "Motion Carried"
written after it.
4. On Page 1, under Storm Sewer Drainage Problem, Case of Mrs. Robert
Sieren, the sentence is paragraph 1 should read as follows:
"Mrs. Sieren said she would pay $330.00 for her share of this
problem if this problem is taken care of immediately."
The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Hobbs, Kurvers and Neveaux. No negative votes. Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Councilman Kurvers
that the May 29, 1974 Council minutes be approved. The following voted
in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers
and Neveaux. No negative votes. Motion carried.
BOARD OF REVIEW MINUTES: A motion was made by Councilman Bennyhoff and
seconded by Councilman Neveaux that the Board of Review minutes be noted
and read. The following voted in favor thereof: Mayor Klingelhutz,
Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux. No negative votes.
Motion carried.
PARK AND RECREATION MINUTES: A motion was made by Councilman Bennyhoff and
and seconded by Councilman Neveaux that the Park and Recreation Commission
minutes of May 21 be noted and read. The following voted in favor thereof:
Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux.
No negative votes. Motion carried.
Councilman Neveaux asked if a Frontier Days Button could be used for
admission to the Park during Frontier Days instead of no charge for that
weekend.

Discussion was held in regard to the bases at Lake Ann ball fields.
The City Administrator explained the type of bases that are being used
and he felt that they should be removed immediately.
Councilman Neveaux was concerned about the bases being used properly. He
feels something has to be done immediately to remove the liability.
A motion was made by Councilman Neveaux and seconded by Councilman Bennyhoff
to direct the Park and Recreation at their June 4, 1974 meeting take
immediate steps to solve the question of liability and danger at Lake Ann
Park in regard to the base situation.
The City Administrator felt the Council should take immediate action instead
of passing this problem back to the Park and Recreation Commission.

A motion was made by Councilman Neveaux and seconded by Councilman Bennyhoff
to direct the City staff to immediately remove the offending bases from the
ball fields the next morning. The following voted in favor thereof:
Councilmen Bennyhoff, and Neveaux— Counci'lman Hobbs, Kurvers
and Mayor Klingelhutz voted no. Motion defeated.
Councilman Hobbs felt the Park and Recreation Commission should review it
first.
Mayor Klingelhutz felt that the Park and Recreation Commission should
review it, because at the time of the purchase of the bases, the Commission
felt they were the safest bases.
Jerry Schlenk suggested the City install the bases every afternoon and have
the team remove them in the evening. This would insure proper installation.
A motion was made by Councilman Neveaux and seconded by Councilman Bennyhoff
to direct the Park and Recreation Commission at their June 4, 1974 meeting
to take immediate steps to solve the question of liability and danger at
Lake Ann Park in regards to the Base situation. The following voted in
favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, KUrvers and
Neveaux. No negative votes. Motion carried.
PLANNING COMMISSION MINUTES: A motion was made by Councilman Neveaux and
seconded by Councilman Bennyhoff that the Planning Commission minutes of
May 22, 1974 be noted and read. The following voted in favor thereof:
Mayor Klingelhutz, Councilmen ,Bennyhoff, Hobbs, Kurvers and Neveaux. No
negative votes. Motion carried.

YOUTH EMPLOYMENT: Ms. Erickson was present to explain to the Council
the two youth programs availabh for Chanhassen. The Governor's youth
program will contribute 1,403.00 for Chanhassen's share. Ms. Erickson
will assist the City for any other monies available to the city.

KENNEL PERMIT APPLICATION: A motion was made by Councilman Neveaux and
seconded by Councilman Hobbs to table action on the Kennel Permit appli-
cation of Margaret Rossing until a report can be made by the Administrator.
The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Hobbs, Kurvers and Neveaux. No negative votes. Motion carried.
VETERINARIAN CLINIC CONDITIONAL USE PERMIT: Mr. Richard Louis and Dr.
Molnau were present to answer questions in regards to the Veterinarian
Clinic. Mr. Louis stated they would construct the building with a
one hour fire protection. Discussion followed regarding the interior
and exterior of the structure. There will be 28 parking Epaces available
around the building.
A motion was made by Councilman Neveaux and seconded by Councilman Benny-
hoff to grant a Conditional Use Permit for the Veterinarian Clinic
subject to the conditions and restrictions amended on June 3, 1974, and
to include in Condition #8 a building permit will not be issued by the
City until a fully detailed and dimension site plan has been submitted
and review by the City staff, and the building shall be a type 4
One hour fire resistance building. The following voted in favor thereof:
Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux.
No negative votes. Motion carried.
TOM KLINGELHUTZ REGARDING PROPOSED STATE AID ROAD: Tom Klingelhutz was
present to request the Council's reconsideration of the extension of
Frontier Trail to Carver Beach. He stated that he feels this road is
very crucial because it would help with Fire and Police Protection for
three major developments, and would help our Central Business District,
which we desperately need. It would also aid in safety at Chanhassen
Elementary. He stated all the sewer and water lines are in and ready
if development could be started.
A motion was made by Councilman Kurvers and seconded by Councilman Hobbs
to have a corridor study made starting at County Road 16 west of the
State Bank of Chanhassen and proceed northerly to West 70th Street to
determine the feasibility of the road. The following voted in favor
thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and
Neveaux. No negative votes. Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Councilman Hobbs
to suspend the agenda for °a short time. The following voted in favor
thereof: Mayor Klingelhutz, Counc$ men Bennyhoff, Hobbs, Kurvers and
Neveaux. No negative votes. Motion carried.
MRS. LES ANDERSON'S ASSESSMENT: Mrs. Anderson would like to propose that
she pay the interest and general taxes each year on her lots and pay off
each assessment as it is sold, on her 49 -50 parcels.
The Council felt a committee should be formed to study the possibilities
available to the City. This committee would work with Mrs. Anderson.
A motion was made by Councilman Neveaux and seconded by Councilman Bennyhoff
to table action on Mrs. Anderson's request for tax deferrment until 6 -17 -74
at which time the reports will be available from the City Staff and Fiscal
Agents in regards to the impact on the NSA. The following voted in favor
thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and
Neveaux. No negative votes. Motion carried.

STORM SEWER DRAINAGE FOR FRONTIER DEVELOPMENT PARK: Frank Laska, City
Engineer, explained the Storm Sewer Drainage for Frontier Development
Park. The Council felt alternate "B" seems most feasible at this time.
WEST JR. HIGH ENVIRONMENTAL STUDY FOR LAND USE: Arnie Weimerskirch has
requested that the Council authorize this study group,that was commissioned
by the Council at their meeting of January 21, 1974, $150.00 to be
used:for land appraisals and for making applications for State and Federal
Funding.
A motion was made by Councilman Bennyhoff and seconded by Councilman Hobbs
to grant this study group no more than $150.00 to be used for land
appraisals and for making applications for State and Federal funding for
the land adjacent to West Jr. High School. The following voted in favor
thereof; Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and
Neveaux.

BILLING OF SANITARY SEWER - GEDNEY: Lloyd Schnelle, the City Administrator,
explained the situation between the Gedney Plant and the City of Chanhassen.
He has consulted with the City Attorney and the City Engineer and they
both feel 50� per thousand is a reasonable amount.
A motion was made by Councilman Kurvers and seconded by Councilman Neveaux
to stand firm on the 50� per thousand as calculated by the City staff.
The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers and Neveaux.
Councilman Hobbs voted no. Motion carried.
Councilman Hobbs felt Gedney should have all the information to change
his mind before the Council makes the decision. The City Administrator
will deliver this information and explain the decision.
CBD COMMISSION: The Council discussed the role of the CBD Commission.
A suggestion was made to set up a single action review committee and
abolish all the other committees. Discussion followed.
A motion was made by Councilman Neveaux and seconded by Councilman Bennyhoff
that it be recommended to the Planning Commission that the exsisting
CBD Advisory Committees be abolished by the Planning Commission and in
their place they appoint a CBD action review committee to consist of not
more than 5 members. A list of names will be submitted and the
Committee would be an advisory committee to the Planning Commission and or
the zoning Administrator at his discretion. Discussion followed. During
the discussion a Motion was made by Councilman Hobbs and seconded by
Councilman Kurvers to amend the above motion that the Council recommends
that the Planning Commission review the subcommittees and consider the
possibilities of abolishing the CBD Committees and replacing them with
one action committee from the list of names forwarded to them. The following
voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs,
Kurvers and Neveaux. No negative votes. Motion carried. The following
voted in favor of approving the original motion as amended: Mayor
Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux. No
negative votes. Motion carried.

CARVER-HENNEPIN PARK, MR. FRENCH: Mrs. Vivian Beaugrand, Chairman of
the Park and Recreation Commission was present asking the feelings
the Council in regards to this park.
A motion was made by Councilman Bennyhoff and seconded by Councilman Hobbs
for the Park and Recreation Commission to take immediate action to
pursue any action needed for the Carver- Hennepin Park on Lake Minnewashta.
The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Hobbs, Kurvers and Neveaux. No negative votes. Motion carried.
ESTABLISHING APPOINTMENT OF HOUSING REDEVELOPMENT AUTHORITY: A motion
was made by Councilman Bennyhoff and seconded by Councilman Hobbs to
appoint the following year terms to the already appointed Housing and
Redevelopment Authority:
Herb Bloomberg - 1 year
Harry Funk - 2 years
Gail Stone - 3 years
Bill Gullickson- 4 years
Tom Klingelhutz- 5 years
The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Hobbs, and Neveaux and Kurvers. No negative votes. Motion
carried.
WESTERN HILLS 2ND ADDITION: A motion was made by Councilman Kurvers6rd
seconded by Councilman Neveaux to add to the May 6, 1974 motion in
regards to Western Hills Association on Lot 12 to include Lot 12 in
Auditor's Subdivision in the motion.
After discussion it was found it should be under Sunrise Hills Association
Beach lot .
The motion was withdrawn.
A motion was made by Councilman Neveaux and seconded by Councilman
Bennyhoff that the motion made May 20, 1974 entitled Sunrise Hills
Association, 3rd paragraph should read it is moved that all special
assessments for sewer and water serving privately owned recreational
beach lots, including Lot 12 Auditors Sub. #2, all payments of all
assessments be deferred until a building permit is taken our or the
property is sold.. The following voted in favor thereof: mayor Klingelhutz,
Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux. No negative votes.
Motion carried.
SPECIAL MEETING: A motion was made by Councilman Neveaux and seconded
by Councilman Bennyhoff to hold a special Council meeting on June 10,
1974 to discuss the status of the City Commissions. The following voted
in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers
and Neveaux. No negative votes. Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Councilman Hobbs
to adjourn the meeting. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Hobbs, Kurvers and Neveaux. No negative
