1974 07 29CHANHASSEN CITY COUNCIL MEETING JULY 29, 1974
The special City Council meeting was called to order by Mayor
Klingelhutz on July 29, 1974, at 8:00 p.m. The meeting was opened
with the Pledge to the Flag. The following members were present:
Mayor Klingelhutz, Councilmen Kurvers, Neveaux, and Hobbs. Councilman
Bennyhoff was absent.
AUDIT REPORT FOR 1973: Ray and Virgil Hoffman were present to explain
the 1973 Audit Report. It was recommended that due to the volume of
work the City records should be put on a machine.
T. E. GALLAGHER ASSESSMENTS: The City is up f
next Monday. The total assessment is $24,175.

A motion was made by Councilman Neveaux and seconded by Councilman
Kurvers that the settlement of the Gallagher assessment appeal as
detailed in the City Attorney's letter of July 25, 1974, be approved.
The following voted in favor: Mayor Klingelhutz, Councilmen Neveaux,
Hobbs, and Kurvers. No negative votes. Motion carried.
STREET AND STORM SEWER PROJECT 74 -1A: Proposed resolution authorizing
Street and Storm Sewer Improvement Project 74 -1A was discussed. A
motion was made by Councilman Neveaux and seconded by Councilman Hobbs
to set the width of W. 79th Street at 36 feet as shown on proposal B.
The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs,
Kurvers, and Neveaux. No negative votes. Motion carried.
The City Attorney querried as to whether the motion of July 15, 1974,
included pipe all along the south side of State Highway 5 and west
side of Highway 101. Number 2 -c of proposed resolution to read:
Construction of a storm water drainage system at the southwest corner
of Trunk Highways 101 and 5 consisting of excavation, pipe jacking,
sodding, placement of pipe, rip -rap and aprons, and employing storm
drain system Alternate B (also shown as Alternate 2) on the City
Engineers' drawing of May 19, 1974, and underground storm drain pipe
throughout the entire course of the storm water drainage system along
Trunk Highway 5 and southerly along Highway 101.
A motion was made by Councilman Hobbs and seconded by Councilman
Neveaux to restate the motion of July 15, 1974, to conform to the
action taken July 29, 1974, with respect to the proposed resolution
authorizing storm sewer and street improvement project 74 -1A as said
proposed resolution was amended at this meeting. The following voted
in favor: Mayor Klingelhutz, Councilmen Hobbs and Neveaux. Councilman
Kurvers abstained. The motion failed for lack of 4/5 vote.
MINNETONKA WEST JUNIOR HIGH ASSESSMENT: The School Board wants to
hook up to city water from their well to the city trunk line. They
will grant an easement. The City Attorney asked the Council to think
about if the City should pick up the cost of oversizing that line
from their well to the City trunk system or shall the City put it in
at our cost and let the school tap it? The Administrator will check
with the Engineer to find out what the cost will be.

CARVER BEACH BOAT LANDING: The Administrator reported he had received
quite a few phone calls last Friday about locking the boat landing.
The boat landing was closed over the weekend and there were no
complaints Monday.
Councilman Kurvers suggested the Council should establish a
policy for all lakes in the City. The Mayor will prepare a list of
names, for Council approva, to serve on a committee to study the
lakes.
METRO COUNCIL FRAMEWORK DEVELOPMENT POLICY: This proposed policy was
discussed. It was decided to have the Administrator and Mayor prepare
a letter to the Metro Council for the City Council to act on at the
next Council meeting. This letter will state that the Council has
studied and discussed the report, the City has done constant planning,
we have a Metro Council approved Guide Plan, Metro Council approved
Parks and Open Space Plan, Metro Council approved sewer plan. The
City has a 22 acre building site law so that prople will not build
in unsewered areas. We have urban -rural tax districts. Chanhassen has
the tools to guide growth. Metro Council has promised the City
utility expansion from years back and have not followed through on it.
Chanhassen is ready to proceed in an orderly planned manner. The
concept proposed appears to have merit. However, we would like to
reserve to Chanhassen the right to call in Metro Council advice to
help us do our planning if the need arises. The City would like to
see that line have some elasticity depending on the need for the
extension of services to existing areas outside the line where there
is a demonstrated need.
