1974 08 05CHANHASSEN CITY COUNCIL MEETING AUGUST 5, 1974 The regular City Council meeting was called to order by Mayor Klingelhutz on August 5, 1974, at 8:00 p.m. The meeting was opened with the Pledge to the Flag. The following members were present: Mayor Klingelhutz, Councilmen Kurvers, Neveaux, and Hobbs. Councilman Bennyhoff was absent. MINUTES: A motion was made by Councilman Neveaux and seconded by Councilman Hobbs to approve the July 15, 1974, regular City Council minutes. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Kurvers. No negative votes. Motion carried. A motion was made by Councilman Hobbs and seconded by Councilman Kurvers to approve the July 22, 1974, special Council minutes. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Kurvers. No negative votes. Motion carried. A motion was made by Councilman Neveaux and seconded by Councilman Hobbs to approve the July 29, 1974, special City Council minutes. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Kurvers. No negative votes. Motion carried. A motion was made by Councilman Kurvers and seconded by Councilman Neveaux to note the July 16, 1974, Park and Recreation Commission minutes. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Kurvers. No negative votes. Motion carried. A motion was made by Councilman Neveaux and seconded by Councilman Kurvers to note the July 17, 1974, Planning Commission minutes. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Kurvers. No negative votes. Motion carried. A motion was made by Councilman Kurvers and seconded by Councilman Neveaux to note the July 24, 1974, Planning Commission minutes. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Kurvers. No negative votes. Motion carried. A motion was made by Councilman Kurvers and seconded by Councilman Hobbs to note the July 30, 1974, Housing and Redevelopment Authority minutes. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Kurvers. No negative votes. Motion carried. LOT 9 MINNEWASHTA HEIGHTS STORM SEWER: Bill Schoell inspected the site and feels the stones in the swimming area have to be removed. This will be taken care of by Schoell and Madson, Inc. The extra lengths of dock that have been installed do cover the storm sewer pipe. Council members discussed who would pay for the dock lengths. A motion was made by Councilman Kurvers and seconded by Councilman Neveaux to table this until the next meeting. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Kurvers. No negative votes. Motion carried. INSTANT SHADE, INC. CONDITIONAL USE PERMIT: H. L. Abbett, Glenn Hill, and Ted Biese were present. The 67 acres are located north of State Highway 5 and west of County Road 117. The land will be used as a growing range for trees and the buildings will be used for storage, maintenance of equipment, and office space. There will be no retail sales on the site. The City Attorney stated a letter is needed from Chanhassen City Council Minutes, August 5, 1974 -2- Dick Lyman consenting to a Conditional Use Permit on this land. A 15' x 5' sign is proposed along State Highway 5 to identify the business. Mayor Klingelhutz stated this is a very good interim use for the property until sewer is available and the land developed. Councilman Neveaux stated this is an excellent plan and opportunity for Chanhassen to retain a good progressive business in the community. A motion was made by Councilman Neveaux and seconded by Councilman Kurvers to direct the preparation of a final Conditional Use Permit encompassing those provisions as contained in the City Attorney's letter of August 1, 1974, following the outline of the Bailey permit and supplemented by discussions with the City Planner with specific reference to his letter of August 2, 1974. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Kurvers. No negative votes. Motion carried. A motion was made by Councilman Kurvers and seconded by Councilman Neveaux to direct the Mayor and Administrator to execute the Conditional Use Permit when it is drafted provided it conforms to the above motion. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Kurvers. No negative votes. Motion carried. COMMITTEE TO ESTABLISH POLICY ON LAKES: Mayor Klingelhutz submitted the following names for Council consideration: Councilman Kurvers, Al Sinnen - Grand View Drive, Glen Carlson - Red Cedar Point, Jim Callahan - Pleasant View, Lauren Hillquist - Western Hills, Bob Evans - Carver Beach, Jim Richardson - The Meadows, Bill Turner - Minnewashta Heights, Denton White - Minnewashta Heights, Tom Lentz - Western Hills, Larry Anderson - Western Hills, Al Olson - Western Hills, Jerry Randgaard - Western Hills, Jerry Templeman - Western Hills, Bob Paxton - Sunrise Hills. It was suggested a five or seven person committee be set up with sub - committees to study each lake. This committee should work in conjunction with the Park and Recreation Commission. The Council would like comments from the Park and Recreation Commission on how this committee should be structured. A motion was made by Councilman Neveaux and seconded by Councilman Hobbs to table selection of this committee until the August 19 meeting. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Kurvers. No negative votes. Motion carried. CARVER BEACH BOAT LANDING: Several City residents were present to discuss the boat landing. Mayor Klingelhutz read the July 22 Council minutes. Lauren Hillquist, Western Hills, stated he feels his area should be given as much ease of access as anyone in the City and would like a key left in the Western Hills area. The Carver Beach Association will meet to decide which two people in Carver Beach will be in charge of the keys. Mayor Klingelhutz stated that no action will be taken on the boat landing until recommendations are received from the lakes study committee. Chanhassen City Council Minutes, August 5, 1974 -3- A motion was made by Councilman Neveaux and seconded by Councilman Hobbs to amend the agenda. The following in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Kurvers. No negative votes. Motion carried. POLICE PROTECTION: Bernie Drevnick, Acting Sargent, was present requesting approval to hire an additional part time patrolman for eight hours a week on Thursday evening at a cost of $869.00 for the remainder of the year. Chanhassen is primarily serviced with one police car but being this is a Sheriff's vehicle it is also responsible for other cities and townships in the County. The present Chanhassen contract represents four full time policemen. The contract is for emergency service. Excluding Chaska there are 28 persons in the Sheriff's Department. Nine of these are designated as patrolmen that cover the whole County. Chaska has seven patrolmen for the City. The Administrator will contact Sheriff Schalow and see if the new contract is ready for the City. A motion was made by Councilman Hobbs and seconded by Councilman Neveaux to table the request for an additional patrolman for two weeks. In that time the Council will discuss problems with the Sheriff. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Kurvers. No negative votes. Motion carried. STORM SEWER AND STREET IMPROVEMENT PROJECT 74 -1A: Martin Ward and Ed Callinan, Attorney for Mr. Ward, were present -to discuss the storm sewer project. Mr. Callinan asked why the water could not drain south on the east side of Highway 101 and not require an easement from Mr. Ward? Bill Schoell answered this can be done but Alternate 2 offers more benefit at a lesser cost than Alternate 3 shown on the May 19, 1974, drawing. Mr. Callinan stated Mr. Ward is content with the drainage of the moisture off his land now the way it is including the drain tile system. Mr. Ward does not want his property taken. Bill Schoell stated this drainage system on the east side of Highway 101 will not do the same benefit as it would on the west side to drain the whole area. By deleting the southerly proposed culvert the Ward property would not derrive as much benefit as it might if the southerly culvert is placed. The City Attorney asked would the placement of a culvert under Highway 101 at its northerly position as shown on the May 19 drawing, would that adequately drain the Frontier Development Park area? Bill Schoell answered yes, along with the rest of the system as shown. The City Attorney asked, would the catch basins on the south side of Highway 5 drain any of Mr. Wards property? Bill Schoell stated they would drain part of the Ward property in the northeast corner. The City Attorney suggested the Council study the question of whether or not the Council would consider Alternate 3. No negative votes. Motion carried. 0 METRO DEVELOPMENT FRAMEWORK: Bud Redburn, Chanhassen Chamber of Commerce, was present to discuss the Chambers' letter endorsing Alternate 3. Chanhassen City Council Minutes, August 5, 1974 -5- A motion was made by Councilman Neveaux and sedon.ded by- Goungil�man Hobbs to adopt the Planning Commission recommendation of July 17 with the modification that the line off of Lyman Blvd. goes south along State Highway 101 to County Road 14 then easterly along County Road 14 to the Chanhassen east boundary line for the purpose of making availability of utility extension to Lake Riley area. A motion was made by Councilman Hobbs and seconded by Councilman Kurvers to approve the July 29, 1974, letter from the Chanhassen City Council to the Metropolitan Council. Copies of this report will go to Senator Lord, Representative Jopp, Mr. Thuet, and Kingsley Murphy. MINNETONKA WEST JUNIOR HIGH SCHOOL: Bill Schoell explained the 6 " water line from the end of the City system to the school boiler- room. This is a service line to be paid for by the school. A motion was made by Councilman Neveaux and seconded by Councilman Hobbs to approve the details of the school board hook up as shown on Schoell and Madson map of August 5, 1974, with the express condition that the entire cost of the line be borne by the school board and that satisfactory easements or deed be granted to the City for access to the well house and related facilities. FIRE RATING: A letter was received from Insurance Services Office of Minnesota dated July 23, 1974, changing the Chanhassen Fire.Rating from Class 9 to Class 7. A motion was made by Councilman Kurvers and.seconded by Councilman Neveaux to compliment the Fire Department for extra hours they put in to gain a rate saV ng to the taxpayers of Chanhassen. ENGINEERING AND SURVEYING SERVICES: A letter dated May 1, 1974, and resub mitted August 2, 1974, from Schoell and Madson requesting increased rates was received. A motion was made by Councilman Hobbs and seconded by Councilman Neveaux to approve the revised rate schedule for engineering and surveying services per letter dated August 2, 1974, retroactive to May 1, 1974. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Kurvers. No negative votes. Motion carried. NORTH SERVICE SEWER AREA: Bill Brezinsky gave a report on discrepancies to be corrected before final payment is made to the contractors.
