The regular City Council meeting was called to order by Mayor
Klingelhutz on September 23, 1974, at 8:00 p.m. The meeting was
opened with the Pledge to the Flag. The following members were
present: Mayor Klingelhutz, Councilmen Hobbs, Bennyhoff, Neveaux,
and Kurvers.
MINUTES: A motion was made by Councilman Kurvers and seconded by
Councilman Neveaux to approve the September 9, 1974, regular City
Council minutes. The following voted in favor: Mayor Klingelhutz,
Councilmen Hobbs, Bennyhoff, Neveaux, and Kurvers. No negative
votes. Motion carried.
A motion was made by Councilman Neveaux and seconded by Councilman
Hobbs to note the Planning Commission Public Hearing minutes for
Nordskov of August 14, 1974. The following voted in favor: Mayor
Klingelhutz, Councilmen Hobbs, Bennyhoff, Neveaux, and Kurvers.
No negative votes. Motion carried.
The Council noted that the August 14, 1974, Planning Commission
public hearing for Nordskov and Lotus Lake Townhouses did not
begin at the times stated.
A motion was made by Councilman Hobbs and seconded by Councilman
Kurvers to note the Planning Commission Public Hearing minutes for
Lotus Lake Townhouses of August 14, 1974. This public hearing
was continued. The following voted in favor: Mayor Klingelhutz,
Councilmen Hobbs, Bennyhoff, Neveaux, and Kurvers. No negative
votes. Motion carried.
A motion was made by Councilman Kurvers and seconded by Councilman
Hobbs to note the Planning Commission minutes of August 14, 1974.
The following voted in favor: Mayor Klingelhutz, Councilmen
Hobbs, Bennyhoff, Neveaux, and Kurvers. No negative votes. Motion
carried.
A motion was made by Councilman Neveaux and seconded by Councilman
Hobbs to note the Planning Commission minutes of September 11, 1974.
The following voted in favor: Mayor Klingelhutz, Councilmen
Hobbs, Bennyhoff, Neveaux, and Kurvers. No negative votes. Motion
carried.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Hobbs to note the Park and Recreation Commission minutes of
September 17, 1974. The following voted in favor: Mayor Klingelhutz,
Councilmen Hobbs, Bennyhoff, Neveaux, and Kurvers. No negative
votes. Motion carried.
BILLS: A motion was made by Councilman Kurvers and seconded by
Councilman Neveaux that the City not pay Minn Kota Excavating
any more money until the contractor appears before the Council
to explain why the delay on the 71 -1E Project. The following
voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux,
and Kurvers. Councilman Bennyhoff voted no. Motion carried.
A motion was made by Councilman Neveaux and seconded by Councilman
Kurvers that final payment on Project 71 -1A, Hoffman Bros., be
paid upon completion of the sealcoating of Fir Tree. The following

voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Bennyhoff,
Neveaux, and Kurvers. No negative votes. Motion carried
A motion was made by Councilman Bennyhoff and seconded by Council-
man Hobbs to pay Community Schools $394.90 for the 1974 Summer
Recreation Program as per Park and Recreation Commission minutes
of September 17, 1974. The following voted in favor: Mayor
Klingelhutz, Councilmen Hobbs, Bennyhoff, Neveaux, and Kurvers.
No negative votes. Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Hobbs to approve the bills as amended. The following voted in
favor: Mayor Klingelhutz, Councilmen Hobbs, Bennyhoff, Neveaux,
and Kurvers. No negative votes. Motion carried.
WESTERN HILLS PROJECT 1973 -2: The Mayor appointed Councilman
Hobbs, Councilman Kurvers, Henry Wrase, and Bill Brezinsky to a
committee to inspect this project. This should be done within the
next two weeks.
WARMING HOUSE: Denis Stedman was present. Jerry Schlenk has
received a verbal estimated price of $4500 for a completely built
building. The Council would like a sketch showing the location
of the rinks, parking, and warming house.
A motion was made by Councilman Kurvers and seconded by Councilman
Hobbs to withdraw the motion approving the Sussel Contract in
the August 26, 1974, minutes in the amount of $2,300. The Council
received advice that the structure proposed is not suitable for
the heavy warming house use and the Council wants to seek other
price quotes. The following voted in favor: Mayor Klingelhutz,
Councilmen Hobbs, Bennyhoff, Kurvers, and Neveaux. No negative
votes. Motion carried.
A motion was made by Councilman Kurvers and seconded by Councilman
Hobbs to approve the building of a warming house and seek at
least three price quotes. The following voted in favor: Mayor
Klingelhutz, Councilmen Hobbs, Bennyhoff, Kurvers, and Neveaux.
No negative votes. Motion carried.
VETERINARY CLINIC - UNIT CHARGES: Dr. Ralph Molnau was present.
Bill Schoell explained the Metro Sewer Board's evaluation of the
number of SAC charges in his letter dated September 18, 1974.
The Clinic will have two units, and the two rental spaces one
unit each.
A motion was made by Councilman Neveaux and seconded by Councilman
Hobbs to set the unit charges according to the City Engineer's
recommendations of September 18, 1974. The following voted in
favor: Mayor Klingelhutz, Councilmen Hobbs, Bennyhoff, Kurvers,
and Neveaux. No negative votes. Motion carried.
Dr. Molnau expressed concern about the street into Frontier
Development Park. He feels something should be done so they
can get in to their building next spring. Bill Schoell stated
some extra gravel and grading could be done.

DENNIS RUSTMAN - REDUCTION OF ASSESSMENT: The house is located
at 6291 Blue Jay Circle. Mr. Rustman is purchasing this duplex
and converting it to a songle family dwelling according to his
letter of September 11, 1974. Mr. Rustman was not present at
the Council meeting.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Hobbs to table this until Mr. Rustman presents himself to the
Council. The following voted in favor:, Mayor Klingelhutz,
Councilmen Hobbs, Bennyhoff, Neveaux, and Kurvers. No negative
votes. Motion carried.
ALEXANDER COMPANY: A motion was made by Councilman Kurvers and
seconded by Councilman Bennyhoff to authorize the Mayor and Clerk -
Administrator to sign an agreement with the Alexander Company
to install curb and gutter on the north side of Chan View.Street.
The following voted in favor: Mayor Klingelhutz, Councilmen
Hobbs, Bennyhoff, Neveaux, and Kurvers. No negative votes.._
Motion carried.
BILL FRIBERG: A letter was received from -Mr. Friberg dated-,
September 11, 1974, complaining about the way his street was
left after the sanitary sewer was installed. This road is a
cartway and not maintained by the City. Mr. Friberg lives at
3851 Church Road. The Administrator will check the problems and
try to resolve them.
MRS. LES ANDERSON - SPECIAL ASSESSMENTS: Mrs. Anderson was not
present.
A motion was made by Councilman Hobbs and seconded by Councilman
Bennyhoff to table Mrs. Anderson's request because the policy
of the City has not changed since June 17, 1974. The following
voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Bennyhoff,
Kurvers, and Neveaux. No negative votes. Motion carried.
CARVER BEACH HOUSE REMOVALS: About a year ago two houses were
demolished under the Hazardous Buildings Act. The cost of this
should be assessed against the properties. The total cost is
$1,792.00.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Neveaux to draft a resolution directing that these costs be
assessed out and ordering the City Clerk- Administrator to prepare
an assessment roll. The following voted in favor: Mayor
Klingelhutz, Councilmen Hobbs, Bennyhoff, Neveaux, and Kurvers.
No negative votes. Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Hobbs to draft a resolution calling for the public hearing on
this assessment for October 7, 1974, at 7:30 p.m. The following
voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Bennyhoff,
Kurvers, and Neveaux. No negative votes. Motion carried.
LIABILITY INSURANCE - MARTIN WARD'S LAWSUIT: The City Attorney
explained the City has two insurance carriers that might be
involved in this. A Reservation of Rights Agreement has been
submitted from dome Insurance Company.

A motion was made by Councilman Bennyhoff and seconded by Councilman
Hobbs to authorize the Mayor and Clerk- Administrator sign this
agreement. The following voted in favor: Mayor Klingelhutz,
Councilmen Hobbs, Bennyhoff, Kurvers, and Neveaux. No negative
votes. Motion carried.
OFFICE SPACE FOR CITY PLANNER: The Administrator explained that
when the planner is hired he will need office space. He suggested
the Public Works, Police, and Utility Departments be moved
downstairs and part of the Council Chambers be petitioned off
for their use.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Kurvers to adjourn the meeting. The following voted in favor:
