1974 09 30CHANHASSEN CITY COUNCIL MEETING SEPTEMBER 30, 1974 The special City Council meeting was called to order by Mayor Klingelhutz on September 30, 1974, at 8:00 p.m. The meeting was opened with the Pledge to the Flag. The following members were present: Mayor Klingelhutz, Councilmen Hobbs, Bennyhoff, Neveaux, and Kurvers. PUBLIC HEARING BUESGENS OFFICE PARK WATERMAIN IMPROVEMENT PROJECT 73 -10 SEPTEMBER 30, 1974, AT 8:00 P.M. The following persons were present: Bill Brezinsky, Bill Schoell, Russell Larson, and Mr. and Mrs. Frank Bongard. A motion was made by Councilman Hobbs and seconded by Councilman Kurvers to waive the reading of the public hearing notice. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Bennyhoff, Neveaux, and Kurvers. No negative votes. Motion carried. Bill Schoell explained the location of the watermain. It was installed from the Milwaukee Railroad south to State Highway 5 and then west along the existing roadway and ties into the 8" line to Chanhassen Estates. The total cost of the project is $24,702.00. The Frank Bongard property was assessed 96 feet (single family residential) at this time. The property is zoned commercial. The remainder of the assessment is deferred until the use of the property changes. Councilman Bennyhoff moved the adoption of the assessment roll in the form of a resolution providing for the payment of the total cost of the project in the amount of $24,702.00 to be assessed against the benefited properties over a three year period with interest at 72 percent on the full amount from time to time unpaid and that the first of the installments of the assessment together with interest on the entire assessment from September 30, 1974, to December 31, 1975, is to be collected with the general taxes in the year 1975 and the other installments to be payable with general taxes in each consecutive year thereafter until the assessment is paid in full. Motion seconded by Councilman Hobbs. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Bennyhoff, Neveaux, and Kurvers. No negative votes. Motion carried. A motion was made by Councilman Bennyhoff and seconded by Councilman Neveaux to close the assessment hearing. PUBLIC HEARING WESTERN HILLS SECOND ADDITION AND SUNRISE HILLS FOURTH ADDITION IMPROVEMENT PROJECT 73 -2 SEPTEMBER 30, 1974, AT 8:20 P.M. The following persons were present: Bill Brezinsky, Tom Klingelhutz, Bill Schoell, and Russell Larson. A motion was made by Councilman Bennyhoff and seconded by Councilman Kurvers to waive the reading of the notice of public hearing. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Kurvers, Bennyhoff, and Neveaux. No negative votes. Motion carried. Special City Council Meeting, September 30, 1974 -2- Bill Schoell explained this project is for the installation of sanitary sewer, watermain, drainage, street improvements, and curb and gutter on Long View Cirlce and parts of the extension of Laredo Drive. The total cost of this project is $89,745.00. The 17 lots on Long View Circle will pay the costs for sanitary sewer, watermain, street work, one -half the sanitary sewer costs to connect to the existing system, one -half of the roadway costs abutting Laredo Drive and one -half the storm sewer costs for a total cost of $2,802 per lot. The City will pay for the additional eight foot width of Laredo Drive in the amount of $5,133.00. The remaining costs will be assessed against Outlot C and the unplatted land west of Laredo Drive. Tom Klingelhutz stated it would be all right to divide the costs equally against Outlot C and the unplatted parcel of land. A motion was made by Councilman Bennyhoff and seconded by Councilman Kurvers that on all special assessment projects involving platted but unimproved tracts of land that any and all assessments pending against the property at the time of the application for a building permit shall be paid in full prior to the issuance of a building permit. Subject, however, to such variances as the Council may in its sole descretion declare from time to time. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Bennyhoff, Neveaux, and Kurvers. No negative votes. Motion carried. Councilman Bennyhoff moved the adoption of a resolution approving the assessment roll in Project 73 -2 assessing the total cost of $84,612.00 against the assessible lots in .Western Hills Second Addition and Sunrise Hills Fourth Addition as setforth in the assessment roll over a period of seven years at an interest rate of 7, percent. The first installment together with interest on the entire assessment from September 30, 1974, to December 31, 1975, to be collectible with general taxes payable in 1975 and that each remaining installment together with appropriate interest to be payable with general taxes in each consecutive year thereafter until the entire assessment is paid. Motion seconded by Councilman Hobbs. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Bennyhoff, Neveaux, and Kurvers. No negative votes. Motion carried. A motion was made by Councilman Neveaux and seconded by Councilman Bennyhoff that the $5,133.00 for the payment of this road come out of the General Funds for 1976 and 1977 unless some other source of funding is available. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Bennyhoff, Neveaux, and Kurvers. No negative votes. Motion carried. Motion carried. 1 Special City Council Meeting, September 30, 1974 -3- PUBLIC HEARING MOLINE ADDITION WATERMAIN IMPROVEMENT PROJECT 73 -9 SEPTEMBER 30, 1974, AT 8:40 P.M. The following persons were present: Curtis Hagen, Mr. and Mrs. George Jackson, Bill Brezinsky, Bill Schoell, and Russell Larson. A motion was made by Councilman Neveaux and seconded by Councilman Hobbs to waive the reading of the notice of public hearing. The following voted in favor.: Mayor Klingelhutz, Councilmen Hobbs, Bennyhoff, Neveaux, and Kurvers. No negative votes. Motion carried. Bill Schoell explained this improvement consists of building a watermain into the addition from the existing watermain on County Road 117 and providing service taps to each lot. The total cost of the project is $12,322.00. Councilman Hobbs moved the adoption of a resolution approving the assessment roll in Project 73 -9 assessing the total cost of $12,322.00 against the assessable lots as shown on the assessment roll in the Moline Addition and contiguous lands lying to the west. Payable over a period of 13 years with interest at 72 percent. The first installment with interest on the entire assessment to be collected with general taxes in the year 1975 with interest to December 31, 1975, and that each remaining installment together with appropriate interest to be payable with general taxes in each consecutive year thereafter until the entire assessment is paid. Motion seconded by Councilman Bennyhoff. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Bennyhoff, Kurvers, and Neveaux. No negative votes. Motion carried. PUBLIC HEARING LAKE SUSAN SANITARY SEWER IMPROVEMENT PROJECT 73 -7 SEPTEMBER 30, 1974, AT 9:00 p.m. Councilman Bennyhoff Chaired this assessment hearing. The following persons were present: Mrs. George Shorba, Jr., Don Gale, Russell Lawrence, Willis Klein, Keith Bartz, Bill Schoell, Bill Brezinsky, and Russell Larson. A motion was made by Councilman Hobbs and seconded by Councilman Neveaux to waive the reading of the notice of public hearing. The following voted in favor: NKMK Councilmen Hobbs, Bennyhoff, Kurvers, and Neveaux. No negative votes. Motion carried. Bill Schoell explained that this improvement consists of building a sanitary sewer line from the Lake View Hills line west to Lake Susan and around the south shore. This line could serve 81 acres of the Richard Lyman farm and 72 acres of the Al Klingelhutz farm. The total cost of this project is $82,893.00. $28,544 will be paid out of the trunk connection charges when the 882 acres are developed. Special City Council Meeting, September 30, 1974 -4- Councilman Neveaux moved the adoption of a resolution assessing the cost of the Lake Susan Sanitary Sewer Improvement Project 73 -7. The assessable costs against the benefited property owners being $46,989.00 lateral assessment and a $7,360.00 trunk assessment for a total to be assessed of $54,349.00 payable over a period of 13 years at 72 percent interest on the unpaid balance. The first installment to be due and payable with general taxes in the year 1975 with interest on the entire assessment from September 30, 1974, to December 31, 1975, and that each remaining installment together with appropriate interest to be payable with general taxes in each consecutive year thereafter until the entire assessment is paid. Motion seconded by Councilman Kurvers. The following voted in favor: Councilmen Neveaux, Kurvers, and Bennyhoff. Councilman Hobbs abstained. Mayor Klingelhutz did not take part in this hearing. Motion carried. A motion was made by Councilman Kurvers and seconded by Councilman Neveaux to close the public hearing. PUBLIC HEARING CARVER BEACH STREET DUST COATING PROJECT SEPTEMBER 30, 1974, AT 9:30 P.M. The following persons were present: J. F. Ernst, Tim Stone, R. F. Amick, Bill Brezinsky, Bill Schoell, and Russell Larson. The City Administrator explained that this project will be assessed against improved and occupied properties in Carver Beach. The total cost of this project is $1,708.00 or $14.00 per residence to be assessed for one year. Councilman Bennyhoff moved to assess the full costs ($1,708) of the Carver Beach Dust Coating Project against the improved properties in Carver Beach and contiguous areas payable in one installment collectible with the general taxes in the year 1975 at 8 percent interest on the assessment from September 30, 1974, to December 31, 1975, except that interested property owners may pay the assessment in full within 30 days from September 30, 1974, at no interest. Councilman Hobbs seconded the motion. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Bennyhoff, Kurvers, and Neveaux. No negative votes. Motion carried. A motion was made by Councilman Bennyhoff and seconded by Councilman Hobbs to close the assessment hearing. RED CEDAR POINT PROJECT 71 -1E: Carl Eagen representing Minn Kota Contracting was present to discuss why this project was not completed by the expiration date of July 15, 1974. Mr. Eagen stated they had poor supervision on the project. They spent a lot of time testing the watermains for leaks and found five faulty hydrants. They plan to have this project completed by October 15, 1974. Special City Council Meeting, September 30, 1974 -5- A motion was made by Councilman Bennyhoff and seconded by Councilman Neveaux to pay Minn Kota $6,275.16 on Project 71 - 1E. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Bennyhoff, Neveaux, and Kurvers. No negative votes. Motion carried.
