1974 11 04REGULAR CHANHASSEN CITY COUNCIL MEETING NOVEMBER 4, 1974
The meeting was called to order by Mayor Klingelhutz on November 4,
1974, at 8:00 p.m. The meeting was opened with the Pledge to the Flag.
The following members were present: Mayor Klingelhutz, Councilmen Hobbs,
Bennyhoff, Neveaux, and Kurvers.
MINUTES: A motion was made by Councilman Kurvers and seconded by
Councilman Hobbs to approve the October 21, 1974, City Council minutes.
The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs,
Bennyhoff, Neveaux, and Kurvers. No negative votes. Motion carried.
A motion was made by Councilman Hobbs and seconded by Councilman
Bennyhoff to note the HRA minutes of September 24, 1974. The following
voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Bennyhoff, Neveaux,
and Kurvers. No negative votes. Motion carried.
The Administrator will ask representatives of the Metro Council Housing
Authority to appear before the Council to discuss the government block
grants and HRA.
A motion was made by Councilman Kurvers and seconded by Councilman
Neveaux to note the Park and Recreation Commission minutes of October
15, 1974. The following voted in favor: Mayor Klingelhutz, Councilmen
Hobbs, Bennyhoff, Neveaux, and Kurvers. No negative votes. Motion
carried.
FIREMEN'S APPRECIATION DAY: Mayor Klingelhutz suggested that knowing
what the firemen are doing for the City he felt there should be a
Firemen's Appreciation Day Saturday, November 9. The day of the
Firemen's Dance. Mayor Klingelhutz read the following proclamation:
Mayor Klingelhutz of the City of Chanhassen proclaims Saturday, November
9 as Chanhassen Firemen's Appreciation Day. You have all received
tickets to the firemen's annual dance. Let's all join them and show
our appreciation to these dedicated men. Unless you observe them and
see how many training meetings and lives and property these men have,
it is hard to realize what a dedicated group they really are. Send in
your donations now. Join and get acquainted with these dedicated men.
Let's all show our appreciation to them. Their special training may
save your life and property.
Councilman Bennyhoff moved to approve the proclamation and declare
Saturday, November 9 as Firemen's Appreciation Day. Councilman Neveaux
seconded the motion. The following voted in favor: Mayor Klingelhutz,
Councilmen Hobbs, Bennyhoff, Neveaux, and Kurvers. No negative votes.
Motion carried.
MINNESOTA PLANNING ASSOCIATION: The City presently does not belong to
the association or receive the newsletter. Dan Herbst will investigate
to see if it is worthwhile organization for the City to join.
OPEN MEETING LAW: Craig Mertz explained this new law to the Council.
This law provides that all the meetings of the governing board of any
city have to be open to the public.
HENNEPIN COUNTY COMPREHENSIVE TRANSPORTATION PLAN: A letter was received
from Hennepin County stating they would like imput from all municipalities
in Hennepin County to develop a comprehensive transportation system plan.

A motion was made by Councilman Bennyhoff and seconded by Councilman
Neveaux to appoint Hudson Hollenback, Mayor Klingelhutz, and Henry
Wrase to the Hennepin County Transportation Study Committee. The
following voted in favor: Mayor Klingelhutz, Councilmen Hobbs,
Neveaux, Bennyhoff, and Kurvers. No negative votes. Motion carried.
CIVIL DEFENSE DIRECTOR: The Civil Defense Director would like to
resign. This item will be on the next City Council Agenda.
NORDSKOV: Carl Dale, City Planner, Bill Schoell, City Engineer,
Hudson Hollenback, Tim Stone, and Dan Herbst, Planning Commission, were
present to discuss this proposal.
Carl Dale reviewed the history of the proposed PUD. Carl Dale explained
that in his report of July 1, 1974, he recommended 1) concept or sketch
plan approval of the entire 175 acres, 2) PUD zoning for the easterly
80 acres, and 3) final development plan approval for the first phase
of construction. Various approvals recommended would be contingent
upon a series of qualifications and conditions to be developed for
inclusion in the required zoning and development contract with the City.
Carl Dale recently met with the planner for Nordskov. They have agreed
to reduce the density to 9 units per acre on the first 80 acres.
The City Planner recommends approval of the density and the general plan.
Prior to approval a very detailed PUD permit should be developed.
The City Attorney asked the City Planner to submit a summary of his
meeting with the Nordskov planner.
Bill Schoell stated that in a letter of October 25 to Nordskov he
suggested ideas to tie up loose ends, These have all been done.
The Engineer recommended approval of the first phase.
The City Attorney suggested that if the Council gives sketch plan approval
the Council should put in writing, the density, reserved areas for open
space, thoroughfare alignment, etc. all of the refinements necessary to
utilize the amenities of the land.
Dan Herbst, Planning Commission, stated that if the Council gives
approval now when sewer is not available, in three to five years from
now the market may have changed for this type of housing. The Planning
Commission has not seen the architectural style of the buildings,
the elevation drawings, how Nordskov plans to dedicate the open space,
how Nordskov plans to control their amenities, etc.
Tim Stone, Planning Commission, asked the Council to consider; is this
a concept we want to approve or acknowledge in the City of Chanhassen.
Council members were polled as to whether the City Staff and consultants
should proceed with drawing up an outline of a permit.
Councilman Neveaux - I don't see how we can ignore the recommendations
from the Planning Commission. The Planning
Commission has studied this at great length.
If we were talking about someone that was ready
to go ahead and had utilities it would be a whole
new ballgame. The City should not be rushed
into this.
Councilman Bennyhoff - If we look at this whole project as a marketing
device and perhaps review the zoning ordinance and

see if there isn't someplace where we can make
provision for that sort of thing. I think we
should stick with preliminary approval and that
is not to say changes cannot be made. Guidelines
are what we really need at this stage of the game.
We should take our time and do it right.
Councilman Hobbs - I think we should have some guidelines. I feel
like Councilman Bennyhoff and Councilman Neveaux at
this time.
Councilman Kurvers - I think the timing of this project is off. The
sewer is not there.
The Administrator asked for a moritorium on future PUDs in areas where
sewer is not available until the ordinance has been revised.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Hobbs to declare a 180 day moritorium on proposed PUDs where sewer is
not available in order to establish guidelines and revise the ordinance.
After much discussion Councilman Hobbs withdrew his second and
Councilman Bennyhoff withdrew the motion.
This will be discussed at the November 18 Council meeting.
NSP RATE INCREASE: Thomas Stearns, Public Utility Rate Expert, Assistant
City Attorney, City of St. Paul, was present asking the City to join
St. Paul in opposition to NSPs proposed rate increase in January 1975.
The first hearing will be held in February. Mr. Stearns will submit a
resolution to the City Council.
DON HANUS - SIGN PERMIT: Mr. Hanus was present requesting a sign permit
for Chanhassen Auto Parts. The 4 x 8 x 14 feet high free standing sign
would be installed on the southeast corner of the property. The sign
will not extend over the sidewalk.
A motion was made by Councilman Neveaux and seconded by.Councilman
Bennyhoff to approve the proposed sign. The following voted in favor:
Mayor Klingelhutz, Councilmen Hobbs, Bennyhoff, Neveaux, and-Kurvers.
No negative votes. Motion carried. -
DON HANUS - COLD STORAGE BUILDING: Mr. Hanus requested a permit to
erect a 16 x 30 foot temporary cold storage building on a concrete
floating slab. He would clean up and blacktop around his buildings.
Jerry Schlenk reported that Mr. Hanus has met with the CBD Committee.
The Committee agreed to go along with this proposal as long as he would
blacktop and stripe the lot and fix the fence on the westerly side.
The Council referred this to the Planning Commission.
67TH STREET: The City Attorney explained that Roy Steller wants to
convey this 33 foot wide roadway to the City. The City has maintained
part of the road for many years.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Hobbs to accept the street with a minimum of a 50 foot right -of -way
and maintain it as in the past. If additional improvements are requested
these will be assessed against the abutting property owners. The
following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux,
Bennyhoff, and Kurvers. No negative votes. Motion carried.

PROPOSED DUCK LAKE TRAIL TRUNK SANITARY SEWER: Bill Schoell recommended
the City not make any move, but wait and see what Eden Prairie Council
does about ordering plans and specifications for this project. He
suggested the City Administrator write Eden Prairie and ask what the
status of the project is.
AMERICAN LEGION POST 580: The Legion has petitioned the City for
sanitary sewer. Bill Schoell recommended that the City wait with this
project until the Sinnen property is developed as it is to costly to
run the line to the Legion now. He also stated that Frontier Park
sewer has enough capacity and is deep enough on the north side of
Highway 5 at the east end of the Standard Oil property. The only
problem is the cost to go under State Highway 5. It was decided to
give the Legion a cost figure for this route.
MOON VALLEY RIFLE RANGE: The Administrator stated the Police Department
has checked and found there is no supervision of the shooting. Russell
Larson explained that the owner had applied for a conditional use permit
to operate a gravel pit and rifle range. This application was tabled
because the owner was going to purchase more land on the bluff. Nothing
more has been done. The conditional use permit application will be
brought before the Council.
MINNESOTA SAFETY COUNCIL: Mayor Klingelhutz suggested the City purchase
reflective tape kits for resale to City residents.
NORDSKOV: The City Attorney asked the Council whether or not they
want the planner, attorney, engineer, and administrator to write up
a permit before the November 18 Council meeting. It was decided to
wait with the permit.
