1974 11 25SPECIAL CHANHASSEN CITY COUNCIL MEETING NOVEMBER 25, 1974 The special Council Meeting was called to order'l.by Mayor Klingelhutz on November 25, 1974, at 8:00 p.m. The following members were present: Mayor Klingelhutz, Councilmen Bennyhoff, Neveaux, and Kurvers. Councilman Hobbs was absent. PLANNING COMMISSION MEMBER: Mayor Klingelhutz read a letter of resignation from Tim Stone. His resignation is effective as of the date of the appointment of a replacement. The Administrator stated he is placing an ad in the Carver County Herald requesting applications for all City Commissions. DON HANDS - CONDITIONAL USE PERM AND BUILDING PERMIT: The City Attorney suggested that the use of the building not include the storage of flamable gases or liquids, that the side yard setback conform to the zoning code and that the building be set back from the existing building by such distance as required by the applicable building code. Mr. Hanus stated this temporary building would be three feet from the existing building. The building would be used to store parts, iron, sheet metal, etc. A motion was made by Councilman Neveaux and seconded by Councilman Bennyhoff that the building permit be granted and the conditional use permit conditions be as indicated in the Building Inspector's letter of November 8, 1974. 1.. Blacktop the west portion of the parking lot as soon as possible but not later than June 1, 1975. 2. The parking to be controlled with paint markings. 3. The fence will be repaired on the west side of the property to conform with the existing fence. 4. No outside storage be allowed on the site after the completion of the garage. 5. Paint the structure the same color as the exi -sting buildings the summer of 1975. 6. This is a temporary facility. and as modified this evening and the City Attorney be directed to draft said conditional use permit. The following voted in favor: Mayor Klingelhutz, Councilmen Bennyhoff, Neveaux, and Kurvers. No negative votes. Motion carried. F. TODD WARNER: Mr. Warner is requesting a side yard variance of 7 feet to Ordinance #47. A motion was made by Councilman Neveaux and seconded by Councilman Kurvers to approve a variance of seven feet to Ordinance #47. The following voted in favor: Mayor Klingelhutz, Councilmen Kurvers, Neveaux, and Bennyhoff. No negative votes. Motion carried. MINNESOTA HIGHWAY DEPARTMENT: A letter was receivbd from the State Highway Department concerning a turn lane and by -pass lane at the entrance to Lake Ann Park. A motion was made by Councilman Bennyhoff and seconded by Councilman Neveaux that the Council sign the agreement from the Highway Department and that the Council feels it will have no adverse impact on Lake Ann Park. The following voted in favor: Mayor Klingelhutz, Councilmen Bennyhoff, Neveaux, and Kurvers. No negative votes. Motion carried. Chanhassen City Council Meeting, November 25, 1974 -2- ADMINISTRATOR: Mayor Klingelhutz and Councilman Bennyhoff requested information from the City Attorney on the top ten persons who applied for the position of Administrator in 1973. A Personnel Consultant will meet with the Council at the December 2nd meeting. STREET LIGHTING: The CBD minutes of October 29 and Planning Commission minutes of November 13 were read. A motion was made by Councilman Neveaux and seconded by Councilman Kurvers that the City authorize Carl Dale, City Planning Consultant, to complete a study of the CBD street lighting problem for a fee not to exceed $300 and the results of the study to be returned to the Planning Commission no later than January 1, 1975. The costs of the planning to be included in the street lighting project when assessed. The following voted in favor: Mayor Klingelhutz, Councilmen Kurvers, Bennyhoff, and Neveaux. No negative votes. Motion carried. PAGE HOUSE: The City Attorney reported that removal of the Page house will begin November 26, 1974. Merle Volk was low bidder at $750.00. REGIONAL PARK: A public hearing on the regional park study will be held Tuesday, November 26, 1974, by the Metropolitan Council. A letter from Carver County was read stating their recommendations on the park site. An excerpt from the Park and Recreation Commission minutes of November 19, 1974, was discussed. Members of the Park and Recreation Commission, Ad Hoc Committee, and Lake Study Committee were present to discuss the proposed regional park at Ches °Mar. Joan Simons, Metro Parks and Open Space, was present. Jack Bell, Lake Study Committee, stated the Committee would like to go on record as being generally opposed to the plan although they have not had much time to study it and would like to be in a position to further evaluate what kind of a proposal is forthcoming from the Metro Council before taking a firm position. Dick Dutcher, Ad Hoc Committee, stated they had presented their feedback to the Park and Recreation Commission as regards to opinions of the residents of the Lake Minnewashta area. Glen Carlson, Lake Study Committee, suggested an environmental impact study of the area if the shoreline is to be dredged. A motion was made by Councilman Kurvers and seconded by Councilman Bennyhoff that the utilization of the water and land resources as set forth on pages 37 and 38 of the Metropolitan Regional Park Standards for those purposes the Chanhassen City Council opposes the regional park. The following voted in favor: Mayor Klingelhutz, Councilmen Bennyhoff, Neveaux, and Kurvers. No negative votes. Motion carried. The imput from the Park and Recreation Commission, Ad Hoc Committee and Lake Study Committee should be included in the letter to the Metro Council. Chanhassen City Council Meeting, November 25, 1974 -3- PLANNER: A motion was made by Councilman Bennyhoff and seconded by Councilman Neveaux to hire Bruce Pankonin as City Planner starting December 16, 1974, at a salary of $14,400 a year and after six months $14,900. The following voted in favor: Mayor .Klingelhutz, Councilmen Bennyhoff, Kurvers, and Neveaux. No negative votes. Motion carried. CHANHASSEN POLICE DEPARTMENT: Ric Anding was present to discuss the police report. The Council has not received the police budget from the County. A motion was made by Councilman Bennyhoff and seconded by Councilman Kurvers o adjourn. The following voted in favor: Mayor Klingelhutz, Counci eve x Bennyhoff, and Kurvers. No negative votes.
