CHANHASSEN VILLAGE COUNCIL MINUTES - October 12, 1971
The special Chanhassen Village Council Meeting on October 12, 1971,
was opened with the Pledge to the Flag. The following members
were present: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz,
Neils and Wolf.
COUNCIL MINUTES: A motion was made by Councilman Wolf and
seconded by Councilman Klingelhutz to approve the minutes of
the October 4, 1971, meeting. The following voted in favor
thereof: Mayor Coulter, Councilmen Bennyhoff, K1inge1hutz,
Neils and Wolf. No negative votes. Motion carried.
PARK AND RECREATION COMMISSION MINUTES: A motion was made by
Councilman Bennyhoff and seconded by Councilman Klingelhutz
that the minutes of the October 5, 1971, Park and Recreation
Commission Meeting be noted and reaQ. The following voted in
favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz,
Neil and Wolf. No negative votes. Motion carried.
The Mayor asked if the Lake Committee had discussed the problems
of airplanes landing on lakes.
BUDGET: The Council discussed the Budget in general.
A motion was made by Councilman Wolf and seconded by Councilman
Neils to adopt the following programs as submitted in the 1972
Proposed Budget.

A motion was made by Councilman Wolf and seconded by Councilman
Neils to table the Budget discussion and amend the Agenda moving
on to item #3. The following voted in favor thereof: Mayor
Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No
negative votes. Motion carried.
Councilman Klingelhutz left the meeting.
STREET LIGHTS (BUSINESS DISTRICT): Cliff Stahlke from Northern
States Power was present to explain the difference between the
existing 23,000 lumen incandescent and the proposed 400 watt
mercury vapor lights. The proposed mercury vapor lights would
be installed by Northern States Power without charge to the
Village. The yearly rate is $6.00 less per fixture.
A motion was made by Councilman Wolf and seconded by Councilman
Bennyhoff to approve the installation of 19, 400 watt mercury
vapor lights in the business district. The following voted in
favor thereof: Mayor Coulter, Councilmen Bennyhoff, Neils and
Wolf. No negative votes. Motion carried.

CHANHASSEN ESTATES 2ND (STREET LIGHTS): A motion was made by I
Councilman Wolf and seconded by Councilman Neils to approve
the street lighting plan as shown on Exhibit !lA" dated
June 25, 1971, entitled "Proposed street lighting system,
Chanhassen Estates 2nd!l. Standard to be the same as Chanhassen
Estates. The following voted in favor thereof: Mayor Coulter,
Councilmen Bennyhoff, Neils and Wolf. No negative votes.
Motion carried.
BLUFF CREEK HIGHLANDS 2ND (CONTRACT FOR DEED): A motion was made
by Councilman Wolf and seconded by Councilman Bennyhoff to defer
action on the Contract for Deed on Outlot A, Bluff Creek Highlands
2nd. The following voted in favor thereof: Mayor Coulter,
Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion
carried.
BLUFF CREEK H!GHLANDS 2ND (DEVELOPMENT CONTRACT): A motion was
made by Councilman Bennyhoff and seconded by Councilman Wolf to
approve the Development Contract as submitted. The following
voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff,
Neils and Wolf. No negative votes. Motion carried.
PLANNER: A motion was made by Councilman Neils and seconded
by Councilman Bennyhoff to hire the firm of Design Planning
(Carl Dale and David Nelson) as recommended in the Planning
Commission Minutes of September 28, 1971. The following
voted in favor thereof: Councilmen Bennyhoff, Neils and Wolf.
Mayor Coulter abstained. Motion carried.

WESTERN CONCRETE: Don Cox and Gene Rosenwinkle were present
to explain what Western Concrete would do with regard to
maintaining the Frontier site in an orderly manner.
Councilman Klingelhutz returned.
A motion was made by Councilman Wolf and seconded by Councilman
Neils that if Western Concrete wishes to continue depositing
fill material that they request a letter from the P~C.A. and
the Metropolitan Council stating their position on this problem.
The following voted in favor thereof: Councilmen Bennyhoff,
Klingelhutz, Neils and Wolf. Mayor Coulter voted no. MotiQn
carried.
Mayor Coulter stated that the reason he voted no was that we
should follow Ordinance #l5.
A motion was made by Councilman Klingelhutz and seconded by
Councilman Wolf to allow Western Concrete to clean its trucks
on the Frontier site until October 26, 1971. The following
voted in favor thereof: Councilmen Bennyhoff, Klingelhutz,
Neils and Wolf. Mayor Coulter voted no. Motion carried.

WESTERN CONCRET (contd): The Minutes are to reflect that during
this extension, Western Concrete will use the back road when
entering and exiting the Frontier site.

Councilman Bennyhoff left the meeting.
A motion was made by Councilman Wolf and seconded by Councilman
Neils to set Code #l02 at $25.819.00. The following voted in
favor thereof: Mayor Coulter, Councilmen Klingelhutz, Neils
and Wolf. No negative votes. Motion carried.
A motion was made by Councilman Klingelhutz and seconded by
Councilman Wolf to set Code #l06 at $8,000.00. The following voted
in favor thereof: Mayor Coulter, Councilmen Klingelhutz, Neils
and Wolf. No negative votes. Motion carried.
A motion was made by Councilman Wolf and seconded by Councilman
Klingelhutz to set Code #l07 at $2,400.00 as originally submitted.
The following voted in favor thereof: Mayor Coulter, Councilmen
Klingelhutz, Neils and Wolf. No negative votes. Motion carried.
A motion was made by Councilman Wolf and seconded by Councilman
Neils to change Code #326, Item #3 to $13,000.00 making a grand
total of $49,ll5.00. The following voted in favor thereof: Mayor
Coulter, Councilmen Klinge1hutz, Neils and Wolf. No negative
votes. Motion carried.

BUDGET (contd): A motion was made by Councilman Wolf and
seconded by Councilman Neils to add $1,000.00 to Item #2,
Code #431 for the purchase of a 4th lot in Minnewashta Heights,
making a grand total of $2,225.00. The following voted in
favor thereof: Councilmen K1ingelhutz, Neils and Wolf. Mayor
Coulter voted no. Motion carried.
A motion was made by Councilman Wolf and seconded by Councilman
Neils to add $l,890.00 to Item #1, Code #432 for supervisory
help, making a grand total of $3,490.00. The following voted
in favor thereof: Councilmen Klingelhutz, Neils and Wolf. Mayor
Coulter voted no. Motion carried.
A motion was made by Mayor Coulter and seconded by Councilman
Wolf to approve Code # 436 in the amount of $700.00, as submitted.
The following voted in favor thereof: Councilmen Klingelhutz,
Neils and Wolf. Mayor Coulter voted no. Motion carried.
A motion was made by Councilman K1ingelhutz and seconded by
Councilman Wolf that Code #437, Item #l be reduced to $700.00
making a grand total of $2,400.00. The following voted in favor
thereof: Mayor Coulter, Councilmen Klingelhutz, Neils and
Wolf. No negative votes. Motion carried.
A motion was made by Councilman Klinge1hutz and seconded by
Councilman Wolf to set the total of Code #54l at $16,000.00.
The following voted in favor thereof: Mayor Coulter, Council-
men K1ingelhutz, Neils and Wolf. No negative votes. Motion
carried.
A motion was made by Councilman Wolf and seconded by Councilman
Neils to add $500.00 and an Item #10 to Code #65l for a vehicle
for the Park and Recreation use, making a grand total of
$l2,664.00 for Code #651. The following voted in favor thereof:
Mayor Coulter, Councilmen Klinge1hutz, Neils and Wolf. No
negative votes. Motion carried.
A motion was made by Councilman Wolf and seconded by Councilman
Neils to approve Code #871 as submitted unless the Village
Attorney finds that the full payment for the Park Bond Issue
is unnecessary. The following voted in favor thereof: Mayor
Coulter, Councilmen K1inge1hutz, Neils and Wolf. No negative
votes. Motion carried.
A motion was made by Councilman Wolf and seconded by Councilman
Neils to adopt Resolution #1012711, entitled "RESOLUTION SETTING
THE 1972 BUDGET" and certify said Budget to the County Auditor.
A motion was made by Mayor Coulter and seconded by Councilman
Neils that the above motion be amended to read that if there is
any relief from legislative action that said relief be subtracted
from the levy as submitted. The following voted in favor thereof:
Mayor Coulter, Councilmen K1inge1hutz, Neils and Wolf. No negative
votes. Motion carried.

BUDGET (contd): The following voted in favor thereof (the
original motion): Mayor Coulter, Councilmen Klinge1hutz,
Neils and Wolf. No negative votes. Motion carried.
SUNRISE RIDGE: A motion was made by Councilman Neils and
seconded by Councilman Wolf to set the date for the Public Hearing
for zoning of Sunrise Ridge for October 26, 1971, at 7:30 p.m.
This Public Hearing to be held in conjunction with the Planning
Commission Public Hearing on the preliminary plat. The following
voted in favor thereof: Mayor Coulter, Councilmen K1ingelhutz,
Neils and Wolf. No negative votes. Motion carried.
PROJECT 71-4: A motion was made by Mayor Coulter,and seconded
by Councilman Neils to approve easement numbers 5 and 6 in the
amount of $1.00 each, in the name of Dorn Builders, Inc. The
following voted in favor thereof: Mayor Coulter, Councilmen
K1inge1hutz, Neils and Wolf. No negative votes. Motion
carried.
UTILITY DEPARTMENT: A motion was made by Councilman Wolf and
seconded by Councilman Klingelhutz that a fee in the amount of
10% of all the utility billing be charged for administration
and be credited to the General Fund. The following voted in
favor thereof: Mayor Coulter, Councilmen Klinge1hutz, Neils
and Wolf. No negative votes. Motion carried.
ELECTION JUDGES: A motion was made by Councilman Klingelhutz
and seconded by Councilman Neils that the following people be
approved as election judges.

seconded by Councilman Neils that the Village Attorney is to
have the Zoning Ordinance completed and submitted to the Planning
Commission on or before November 15, 1971. The following voted

and Wolf. No negative votes. Motion carried.
SOLID WASTE ORDINANCE: A motion was made by Councilman Wolf
and seconded by Councilman Neils that the Village Attorney is to
have the Solid Waste Ordinance completed and submitted to the
Council on or before November l5, 1971. The following voted in
favor thereof: Mayor Coulter, Councilmen K1ingelhutz, Neils
and Wolf. No negative votes. Motion carried.
