The regular Chanhassen Village Council meeting on October 18,
1971, in the Chanhassen Village Hall, was opened with the Pledge
to the Flag. The following members",were present: Mayor Coulter,
Councilmen Bennyhoff, K1ingelhutz, Neiis and Wolf.
The following persons were present: Bernard Schneider, Joel
Hedtke, Ida Johnson, Mr. and Mri. Willard Johnson, Al Sk1uzacek,
Frank Kurvers, Herbert DeVaan, Don Gale, Ralph Thrane, Henry
Wrase, Tom Krueger, A. K. Krueger, Dallas Capesius.
RIVIERA CLUB (ON SALE INTOXICATING LIQUOR LICENSE): Tom Krueger,
representing the Riviera, requested an On Sale Intoxicating
Liquor License. He explained the past history of the Riviera and
what they propose to do in the future.
Ordinance #2, section 3, subsection 2, requires fixtures and
structure to have a fair market value of $250,000. As the
Riviera does not meet this requirement, the Council would have
to grant a variance or amend the ordinance. The Riviera meets
all other requirements in Ordinance #2.
Mayor Coulter explained the past history ~ the Rivier~j~
application for an On Sale Intoxicating Liquor License in 1966
and in 1969 for a Club Liquor License which was withdrawn by
the Riviera.
All Council members gave general comments on this request.
Bernard Schneider, Chairman of the Industrial Commission,
commented on the special meeting that the Industrial Commission
held at noon on October 18, 1971, to discuss this request.
The commission took no formal action.
A motion was made by Councilman Wolf and seconded by Councilman
K1ingelhutz that the matter of Ordinance #2, section 3, subsection
2, be studied by the Industrial Commission and their recommendations
be submitted to the Village Council.
A motion was made by Mayor Coulter, and seconded by Councilman
Bennyhoff that the above motion be amended to read, "that the
Industrial Commission report back to the Council no later than
November 1, 1971". The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, K1ingelhutz, Neils and Wolf.
No negative votes. Motion carried.
The following voted in favor of the original motion: Mayor Coulter,
Councilmen Bennyhoff, K1ingelhutz, Neils and Wolf. No negative
votes. Motion carried.
BILLS: A motion was made by Councilman Bennyhoff and seconded by
Councilman Wolf to approve the bills as submitted. The following
voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff,
Klingelhutz, Neils and Wolf. No negative votes. Motion carried.

FIRE DEPARTMENT: A motion was made by Councilman Klingelhutz
and seconded by Councilman Neils that the Village Treasurer
be instructed to issue a check to the Fire Department Relief
Association in the amount of $2,680.5l. The following voted
in favor thereof: Mayor Coulter, Councilmen Bennyhoff,
Klingelhutz, Neils and Wolf. No negative votes. Motion
carried.

This is the amount that the Village received from the State.
(2% fire insurance).
POLICE REPORT: Sergeant Wallin was present and gave the
September report.
A motion was made by Councilman Klinge1hutz and seconded by
Councilman Wolf that the Village adopt the following
proclamation:
WHEREAS, the children of our community are
associated with Halloween, including going from door-to-
door in their immediate neighborhoods with their happy
challenges of "trick-or-treat"¡ and
WHEREAS, the increasing possibility of accidents
due to the general carefree spirit of the children at this
particular time when their natural caution is abandoned and
when costumes and masks often make then indistinguishable
in the darkness of these early Fall evenings is an ever
present threat; and

WHEREAS, it would appear that parents generally
favor the late afternoon and early evening schedule since
it tends to limit participation to the younger children,
for whom the observance was originally intended, and
discourages interference and disruption by the very small
percentage of older children who, under cover of darkness
and with their identities concealed by masks and costumes,
might otherwise seek to spoil the fun for the smaller
children.
NOW, THEREFORE, I, WENDELL L. ANDERSON,
Governor of the Great State of Minnesota, in conjunction
with the undersigned Minnesota Mayors, do hereby proclaim
that Sunday, October 31, 1971, shall be known as Halloween.
We do further ask both children and their parents to co-
operate in limiting the time of trick-or-treat activities
to the period marked by 4:00 PM and the hour of 7:00 PM.
We also ask that, wherever possible, parents of the very
young children insure that they or other responsible adults
accompany them, and I further encourage all householders,
wherever they are able to do so, to cooperate in making
this a happy occasion for all youngsters.

DRAINAGE PROBLEM: A motion was made by Councilman Bennyhoff
and seconded by Councilman K1inge1hutz to take no action
on this until both property owners are present. (Gou1ett
and Jacobson). The following voted in favor thereof: Mayor
Coulter, Councilmen Bennyhoff, K1ingelhutz, Neils and Wolf.
No negative votes. Motion carried.
PROJECT 7l-4: A motion was made by Councilman Bennyhoff and
seconded by Councilman Wolf to approve the railroad right-of-
way easement. The following voted in favor thereof: Mayor
Coulter, Councilmen Bennyhoff, K1ingelhutz, Neils and Wolf.
No negative votes. Motion carried. '
A motion was made by Councilman Bennyhoff and seconded by
Councilman Neils to approve a realignment of the water line
if an easement cannot be obtained from the Char Lynn
Foundation by Friday, October 22, 1971, at 4:30 p.m.
The following voted in favor thereof: Mayor Coulter, Council-
men Bennyhoff, Klinge1hutz, Neils and Wolf. No negative votes.
Motion carried.
MAINTENANCE DEPARTMENT: A motion was made by Councilman
Bennyhoff and seconded by Councilman K1ingelhutz to authorize
advertising for a full time maintenance man. The following
voted in favor thereof: Mayor Coulter, Councilmen Bennyhoffn
Klingelhutz, Neils and Wolf. No negative votes. Motion:
carried.
ORDINANCE #34: An amendment to Ordinance #34 was submitted
and discussed. This amendment would allow the sale of
intoxicating liquor on all election days other than state
wide election days. No action was taken.
EDUCATION WEEK: A motion was made by Councilman Bennyhoff
and seconded by Councilman Wolf that the Village of Chanhassen
proclaim October 24 to October 30, 1971¡ as Education Week.
The following voted in favor thereof: Mayor Coulter, Council-
men Bennyhoff, K1ingelhutz, Neils and Wolf. No negative votes.
Motion carried.
ZONING: A motion was made by Councilman Neils and seconded by
Councilman Bennyhoff that the Village Attorney be instructed
to answer Mr. Bowen's letter pertaining to the zoning problems
in the Twin Hills area. The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, K1ingelhutz, Neils and
Wolf. No negative votes. Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Council-
man Neils that a letter be sent to Ratc1iff-Nicholson-Farre11
Products to explain the Zoning Ordinance. The following voted in
favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1inge1hutz,
Neils and Wolf. No negative votes. Motion carried.
