The special Chanhassen Village Council Meeting was opened with
the Pledge to the Flag. The following members were present:
Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. Mayor Coulter
was absent.
Acting Mayor Klingelhutz opened the meeting.
COUNCIL MINUTES: A motion was made by Councilman Wolf and
seconded by Councilman Bennyhoff to approve the October 12, 1971,
and the October 18, 1971, Council Minutes. The following voted
in favor thereof: Councilmen Bennyhoff, K1ingelnutz,'Nei1s and
Wolf. No negative votes. Motion carried.
PARK AND RECREATION COMMISSION MINUTES: A motion was made by
Councilman Neils and seconded by Councilman Wolf that the Park
and Recreation Commission Minutes of October 19, 1971, be noted
and read. The following voted in favor thereof: Councilmen
Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes.
Motion carried.
PLANNING COMMISSION MINUTES: A motion was made by Councilman
Wolf and seconded by Councilman Neils that the Planning Commission
Minutes of September 14, 1971, October 13, 1971, and October 26,
1971, be noted and read. The following voted in favor thereof:
Councilmen Bennyhoff, Klinge1hutz, Neils and Wolf. No negative
votes. Motion carried. '
Mayor Coulter arrived.
RIVIERA (LIQUOR LICENSE A~PLICATION): There was general discussion
on the Industrl Commission Meeting of October 27, 1971.
Mr. Tom Krueger explained how the Riviera would be operated if
they received a liquor license. He further stated that he could
have a full written application prepared by the next Council
Meeting.
A motion was made by Councilman Bennyhoff and seconded by Councilman
K1ingelhutz to table any further discussion on the Riviera request
until a full formal written application has beenpresente~ to the
satisfaction of the Village' Attorney. The following voted in favor
thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils
and Wolf. No negative votes. Motion carried.
CARVER COUNTY EMERGENCY EMPLOYMENT AGREEMENT: The Village Attorney
stated that he could not approve the agreement at this time.
A motion was made by Councilman Bennyhoff and seconded by Council-
man Wolf to authorize the Mayor and the Village Administrator to
sign the Carver County Emergency Employment Act Agreement. The
following voted in favor thereof: Councilmen Bennyhoff, K1ingelhutz
and Wolf. Mayor Coulter and Councilman Neils voted no. Motion
carried.

CARVER COUNTY EMERGENCY EMPLOYMENT AGREEMENT (contd):

Mayor Coulter stated that he voted no because he could not
sign until the Village Attorney had approved the agreement.
A motion was made by Councilman Klinge1hutz and seconded by
Councilman Wolf to defer the signing of the agreement until
the Village Attorney has had time to submit his opinion on
or before 4:30 p.m., November 5, 1971. The following voted
in favor thereof: Mayor Coulter, Councilmen Bennyhoff,
Klingelhutz, Neils and Wolf. No negative votes. Motion
carried.
DRAINAGE PROBLEM: Mr. Goulett and Mr. Jacobson were present.
Councilman Wolf stated that he felt this problem should be
solved at the lowest possible cost.
Maintenance Superintendent, Henry Wrase, was present and stated
that he felt that an open ditch running to the south would
solve the problem.
A motion was made by Councilman K1inge1hutz and seconded by
Councilman Neils to authorize the Maintenance Department to
cut an open ditch to allow the drainage to run to the south. I
The following voted in favor thereof: Mayor Coulter, Councilmen -
K1ingelhutz and Neils. Councilmen Bennyhoff and Wolf voted no.
Motion carried.
The reason Councilmen Bennyhoff and Wolf voted no was that they
felt that the drainage should run to the north.
SHOOTING PERMIT (HARVEY THIES): General discussion on the issuing
of a shooting permit north of Highway 5 and what the village
policy is.
Mr. Thies is requesting a shooting permit to hunt raCOGHaS.
A motion was made by Councilman Neils and seconded by Councilman
Wolf to deny the request for a shooting permit, to Harvey Thies,
for north of Highway 5. The following voted in favor thereof:
Councilmen Bennyhoff, Neils and Wolf. Mayor Coulter and Council-
man K1inge1hutz voted no. Motion carried.
DORN APARTMENTS: General discussion on unit charges. Mr. Dorn
stated that a number of other communities, that he has built
apartments in, have charged ~ of a residential unit instead of
3/4 as Chanhassen does.
A motion was made by Councilman Klinge1hutz and seconded by I
Councilman Neils to defer any further action on this until
8:10 p.m., November 15, 1971. The Engineer to research this
and submit a report to the Council. The following voted in
favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1inge1hutz,
Neils and Wolf. No negative votes. Motion carried.

A motion was made by Councilman Neils and seconded by Councilman
K1ingelhutz to approve the' purchase of three (3) Federal 10-10
radios at the lowest quoted price. The following voted in favor
thereof: Mayor Coulter, Councilmen Bennyhoff, Klinge1hutz, Neils
and Wolf. No negative votes. Motion carried.
Fire Safety Corporation has quoted a price for three (3) Federal
10-10 radios at $100.00 each. The Administrator to contact
North American Safety and American LaFrance for their quotations.
NEW EMPLOYEE: A motion was made by Councilman Bennyhoff and
seconded by Councilman Neils that the Administrator, Maintenance
Superintendent and the Park and Recreation Commission Chairman
interview the applicants for the park maintenance man. The
following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klinge1hutz, Neils and Wolf. No negative votes.
Motion carried.

man Wolf that the Administrator, Maintenance Superintendent
and Councilman Klingelhutz interview the applicants for maintenance
man. The following voted in favor thereof: Mayor Coulter, Council-
men Bennyhoff, K1inge1hutz, Neils and Wolf. No negative votes.
Motion carried.
CAPITOL IMPROVEMENTS: A motion was made by Councilman Wolf and
seconded by Councilman Bennyhoff to authorize the advertising for
bids for a new truck as budgeted for in the 1972 Budget. The
following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion
carried.
