1971 11 08 ~ I I I ~ CHANHASSEN VILLAGE COUNCIL MINUTES - November 8, 1971 The regular Chanhassen Village Council Meeting on November 8, 1971, was opened with the Pledge to the Flag. The following members were present: Mayor Coulter, Councilmen Bennyhoff, K1inge1hutz, Neils and Wolf. INDUSTRIAL COMMISSION MINUTES: A motion was made by Councilman Klingelhutz and seconded by Councilman Bennyhoff that the Industrial Commission Minutes of October 27, 1971, be noted and read. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1ingelhutz, Neils and Wolf. No negative votes. Motion carried. ' RIVIERA: The Village Attorney reported that the Riviera application for a liquor license was not ready yet. EMERGENCY EMPLOYMENT ACT AGREEMENT: The Administrator reported that once the employees are approved by the Village they may start immediately. The Village Attorney voiced his concern on what cost the Village may incur. A motion was made by Councilman Wolf and seconded by Councilman Klingelhutz to request a letter from the O.E.O., stating what costs the Village of Chanhassen may be obligated for. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1inge1hutz, Neils and Wolf. No negative votes. Motion carried. NEW CAREERS PROGRAM: A motion was made by Councilman Wolf and seconded by Councilman K1inge1hutz that the Administrator gather more information on the New Careers Program. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1inge1hutz, Neils and Wolf. No negative votes. Motion carried. BOARD OF ADJUSTMENTS AND APPEALS: The Board of Adjustments and Appeals recommends the following: a. A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf to grant a request for a 5' variance from a 10' requirement to Hanson & K1ingelhutz Const. on Lot 1, Block 2, Western Hills. Variance granted for the following reasons: l. Two other houses in same block are built within 5' of the lot line. 2. Adjacent house is 5' from lot line on opposite side. 3. 5' variance has been allowed in Old Village in the past. 4. Garage wall will abut variance side. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1ingelhutz, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Klinge1hutz and seconded by Councilman Bennyhoff to grant a request for a 5' variance for a 2nd garage for John Ackerman on W. 77th Street. Granted for the following reasons: 1. Has permission from neighbor. 2. 5' variance has been allowed in Old Village in the past. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. c. A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff to grant a request for a 5' variance for Callinan, Pleasent View Addition. Granted for the following reasons: 1. The garage will be 35' from neighbors garage. 2. Owner has already changed plans to comply with drainfie1d requirements. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klinge1hutz, Neils and Wolf. No negative votes. Motion carried. BUILDING PERMIT APPLICATION: General discussion on Arnold Hed's building a boat house. A motion was made by Councilman Bennyhoff to approve the Building Permit for a boat house as per plans and specifications on Arnold Hed property. Motion died for lack of a second. The Council asked if the neighbors had been notified. The Building Inspector answered that they had not been notified. A motion was made by Councilman Neils and seconded by Councilman Wolf to delay action on this application until November 15, 1971, at 8:10 p.m. so that an expression from the adjoining property owners can be obtained. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1ingelhutz, Neils and Wolf. No negative votes. Motion carried. FIRE DEPARTMENT: A motion was made by Councilman Klingelhutz and seconded by Councilman Neils to authorize the Fire Department Relief Association to invest $2,680.51 in Savings Certificates. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1ingelhutz, Neils and Wolf. No negative votes. Motion carried.
