Members present: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wo1¡. COUNCIL MINUTES: A motion was made by Councilman K1ingelhutz and seconded by Councilman Neils to approve the Council Minutes of November 1, 1971. The following voted in' favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Bennyhoff and seconded by Council- man Wolf to approve the Council Minutes of November 4, 1971. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1inge1hutz, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Klinge1hutz and seconded by Council- man Wolf to approve the Council Minutes of November 8, 1971. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1inge1hutz, Neils and Wolf. No negative votes. Motion carried. PARK AND RECREATION COMMISSION MINUTES: A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf that the Park and Recreation Commission Minutes of November 2, 1971, be noted and read. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klinge1hutz, Neils and Wolf. No negative votes. Motion carried. BOAT~HOUSE BUILDING PERMIT APPPLICATION (ARNOLD HED): Mr. Hed was present and stated that after considering the possibility of boat houses being built all around the lake, he felt there might be an aesthetic problem. A motion was made by Councilman K1ingelhutz and seconded by Councilman Wolf to refer this problem to the Park and Recreation Commission. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1inge1hutz, Neils and Wolf. No negative votes. Motion carried. UNIT CHARGE: The Village Engineer presented a report dated November 12, 1971, with regard to the estimated amount of water used in multiple units compared with single family residential. He recommends, "that the trunk charges for sanitary sewer and water be set atl/2 of the single family unit charge, based on the relative quantity uses by multiple residential units as against single family residential units". A motion was made by Councilman Klingelhutz that the unit charge for multiple units be set at 60% of the rate of single family residential units. Motion dies for lack of a second. ~ CBÀNHÀSSEN V¡L~ÀGE CQUNCIL MINUTES - Nov~mÞe~ ¡5, 197¡ -2- UNIT CHARGES (CONTD): A motion was made by Councilman Bennyhoff I and seconded by Councilman Neils to accept the Engineer's recommendation and set the apartment rate at 50% of residential ' units. A motion was made by Councilman Bennyhoff and seconded by Council- man Neils to amend the above motion to read, "that the rate for apartments up to an including two (2) bedroom units be set at 50% of a residential unit. IDA JOHNSON FENCE: Ida Johnson reiterated her problem. Past history was, explained on this matter. The Village Attorney stated that we could not reimburse Mrs. Johnson for a fence that is on Village property. A motion was made by Councilman Wolf and seconded by Councilman Neils to instruct the Maintenance Department to install whatever safety signs are necessary on Lyman Blvd. The following voted I in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. BILLS: A motion was made by Councilman Klingelhutz and seconded by Councilman Bennyhoff to approve the bills as submitted. and amended. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1inge1hutz, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Klingelhutz and seconded by Council- man Bennyhoff to approve a $50.00 payment to the Chicago, Milwaukee, St. Paul & Pacific Railroad for a pipeline agreement. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. WINTER RECREATION: A motion was made by Councilman Klingelhutz and seconded by Councilman Wolf to approve a salary of $90.00 for Mr. Ron Mielke for supervising the Saturday rnrning recreation program from November 6, 1971 to December l2, 1971. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1inge1hutz, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Wolf and seconded by Councilman Neils that the admission for the winter recreation adult program I be set at 50¢ per adult, per night and the admission for the Saturday morning childrens program be set at 25¢ per child, per week. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. ,Ç-F ~ I I I ~-~ CHANHASSEN VILLAGE COUNCIL MINUTES - November L5, 1971 -3- WINTER RECREATION (CO NT D); SPANISH LESSONS: A motion was made by Councilman Neils and seconded by Councilman Wolf that the students enrolling in this course should pay for the full session at the first lesson and the program shall be self-supporting. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1inge1hutz, Neils and Wolf. No negative votes. Motion carried. RIVIERA: Mr. Degan, attorney for Mr. Krueger and the Riviera, explained what has been done to date. A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff to instruct the Village Attorney to draft an amendment to Ordinance #2 with the intent of the recommendations in the Industrial Commission Minutes of October 27, 1971. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1inge1hutz, Neils and Wolf. No negative votes. Motion carried. SUNRISE RIDGE: The Village Engineer is requested to have a report on the Erickson - Scott catch basin problem at the next meeting. A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff to rezone the Sunrise Ridge property from Farm Residence District to Residence District A (R-1 District under the proposed Zoning Ordinance). The Following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1inge1hutz, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Wolf and seconded by Councilman Neils to approve the preliminary plat with the conditions listed in the Planning Commission Minutes of November 9, 1971, Items 1 thru 8 as follows: 1. That a variance be granted to Section 7.02, subsection h of Ordinance #33 for Lots 1, 2, 3 and 7 upon Village Engineer's recommendation in report dated Sept. 24, 1971. 2. That a variance be granted to Section 8~06, subsection a(2) and b of Ordinance #33 for Lot 7 upon Village Engineer's recommendation in report dated Sept. 24, 1971. 3. Sections 9.01 and 9.02 of Ordinance #33 be irtcorporated in final plat. 4. Lot 1 does not appear to be a corner lot and so does not require the additional 15 feet as stated in Ordinance #33. 5. The developer is not totally responsible for or does not significantly add to the problem at Erickson-Scott catch basin but the Council should direct immediate attention to remedy this problem as in Village Eggineer's report Nov. 5, 1971. 6. The covenants be presented in final form prior to final plat approval. 7. Include the drainage plan as presented Nov. 9, by Rieke, Carroll, Muller, in the preliminary plat. CHANHASSEN VILLAGE COUNCIL MINUTES - November 15, 1971 -4- SUNRISE RIDGE (CONTD): 8. Fences and walkway easements as discussed'and agreed to by Mrs. Moulton and Mr. Scott in minutes of Oct. 26, 1971, be adhered to. In addition, that the Village request payment in full for equal assessments for water and sewer on the five additional lots, upon application for a building permit. Assessments shall be equal to all other lots in the 67-4 Project. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. PLANNER AGREEMENT: The Village Attorney stated that the agreement will be presented at the next meeting. ZONING ORDINANCE: A motion was made by Councilman Wolf and seconded by Councilman Neils to set the date for the public hearing on the proposed zoning ordinance for December 15,l97l, 7:30 p.m. in the Chanhassen Elementary School. The ii10wing voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klinge1hutz, Neils and Wolf. No negative votes. Motion carried. NORTH SERVICE AREA: Financial Consultant, Carl Ehlers,was present to explain the final report on the financing of the the North Service Area. The Council decided that this matter needed more discussion and that a special meeting be called for November 22, 1971, at 8:00 p.m. ' GEDNEY SEWER PROBLEM: A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff that Al Klingihutz be appointed to represent the Village at meetings with Gedney and Chaska on this sewer problem.
