CHANHASSEN VILLAGE COUNCIL MINUTES - December 6, 1971
The special Chanhassen Village Council Meeting on December 6, 1971,
was opened with the Pledge to the Flag. The following members
were present: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz,
Neils and Wolf.
COUNCIL MINUTES: A motion was made by Councilman Klingelhutz and
seconded by Councilman Bennyhoff to approve the Council Minutes
of November 15, and November 22, 1971. The following voted in
favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1inge1hutz,
Neils and Wolf. No negative votes. Motion carried.
Councilman K1inge1hutz would like the minutes of November 22, 1971,
to reflect that the reason he voted no on the Resolution was that
he does not want to proceed with plans and specifications until
after the public hearing.
PARK AND RECREATION MINUTES: A motion was made by Councilman Neils
and seconded Councilman Bennyhoff that the Park and Recreation
Commission Minutes of November 16, 1971, be noted and read. The
following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klinge1hutz, Neils and Wolf. No negative votes. Motion
carried.
PLANNING COMMISSION MINUTES: A motion was made by Councilman
Klinge1hutz and seconded by Councilman Neils that the Planning
Commission Minutes of November 9, 1971, be noted and read. The
following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klinge1hutz, Neils and Wolf. No negative votes. Motion
carried.
CONTINUATION OF PUBLIC HEARING: A motion was made by Councilman
Wolf and seconded by Councilman K1inge1hutz that the Continuation
of the Public Hearing with the Planning Commission on November 9,
1971, be noted and read. The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, K1ingelhutz, Neils and Wolf.
No negative votes. Motion carried.
CENTRAL BUSINESS DISTRICT MEETING: A motion was made by Councilman
K1inge1hutz and seconded by Councilman Bennyhoff that the Minutes
of the Central Business District Meeting on November 17, 1971, be
noted and read. The following voted in favor thereof: Mayor Coulter,
Councilmen Bennyhoff, K1ingelhutz, Neils and Wolf. No negative votes.
Motion carried.
Councilman K1inge1hutz gave a report on the Central Business District
Meeting. He also gave a report on the Chamber of Commerce Meeting
when the Central Business District proposal was discussed.
CHANHASSEN ESTATES 2ND ADDITION (PROJECT 71-3): A motion was made
by Councilman Bennyhoff and seconded by Councilman Neils to approve
the final bills, as submitted, for Chanhassen Estates 2nd Addition,
as follows:

A motion was made by Councilman K1ingelhutz and seconded by
Councilman Wolf to amend the above motion to read that the bills
are for sewer and water only. The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf.
No negative votes. Motion carried.
The following voted in favor of the original motion: Mayor I
Coulter, Councilmen Bennyhoff, K1ingelhutz, Neils and Wolf. No
negative votes. Motion carried.
LAND DEDICATION: The Administrator explained why the dedication
of land (7' x 140') for public use is being submitted by the
following people:
Raymond Rettler Lorraine Hanson
Angeline Rettler Henry Schutrop
W. H. Hanson Delores Schutrop
The Administrator also stated that the Village Attorney has
prepared a resolution for acceptance of this dedicated land.
The Village Attorney reported that he has received a letter from
William Odell stating that the actual ownership of this land is
somewhat obscure. Consequently the Village Attorney does not
recommend that the Council accept this land dedication.
A motion was made by Councilman Neils and seconded by Councilman
Wolf not to accept this land dedication because of the uncertainty
of ownership.
KERMIT AUSTAD stated that is the Village will give the land
to the abutting property owners, they would appreciate this
land.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. I

NORTH SERVICE AREA: The Village Attorney explained his letter
dated December 2, 1971, pertaining to the North Area Sewer and
Water District. In his opinion the entire area can be considered
one project and can be assessed as such under certain guidelines.
A motion was made by Councilman Klinge1hutz and seconded by
Councilman Bennyhoff to dispense with the Agenda. The following
voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff,
Klingelhutz, Neils and Wolf. No negative votes. Motion carried.
VALLEY AUTO PARTS: The attorney representing Valley Auto Parts
was present requesting a variance to Ordinance #1, be granted
to Valley Auto Parts. Valley Auto Parts would like to place a
mobile home on their property so that a night watchman can live
on their property. There have been many cases of vandalism and
watch dogs have not been able to stop the vandalism.
A motion was made by Councilman Klingelhutz and seconded by
Councilman Wolf to defer any action on this until the Police
Department, Industrial Commission and the Council can look at
the site. The following voted in favor thereof: Mayor Coulter,
Councilmen Bennyhoff, K1inge1hutz, Neils and Wolf. No negative
votes. Motion carried.
This item is to be placed on the Agenda December 13, 1971, at
8:10 p.m.
P.C.A. BURNING VIOLATION: The Village Attorney explained the
facts pertaining to the Schimmelpfennig burning violation. -
A motion was made by Councilman Wolf and seconded by Councilman
Neils that the Fire Chief be instructed not to sign any P.C.A.
burning permit applications without Council approval. The
following voted in favor thereof: Councilmen Bennyhoff, K1inge1hutz,
Neils and Wolf. Mayor Coulter voted no. Motion carried.
Mayor Coulter stated that the reason he voted no was that he
did not think any burning should be allowed.
AIRPLANE PROBLEM: The Village Administrator reported that
Mr. Hodgson's letter and proposed ordinance has been forwarded to
the Park and Recreation Commission. The Park and Recreation
Chairman stated that they-would discuss this matter at their
meeting December 7, 1971.
PROFESSIONAL PLANNER: A motion was made by Councilman Klinge1hutz
and seconded by Councilman Wolf to approve the agreement for a
professional planning service wìth Design Planning Associates.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion
carried.

TWIN HILLS AREA: Councilman K1inge1hutz questioned the Village I
Attorney as to the status of this problem.
The Village Attorney stated that he has discussed this with
Mr. Bowen and that he would be officially answering Mr. Bowen's
letter shortly.
SOLID WASTE ORDINANCE: Councilman Wolf questioned the Village
Attorney as to the status of the solid waste ordinance.
The Village Attorney stated that he will be submitting this
ordinance before the end of the year.
FRONTIER (WESTERN CONCRETE DUMPING): Fritz Coulter asked what
the status is on this problem.
The Administrator will check into this and report at the next
meeting.
ENVIRONMENTAL COMMITTEE: Fritz Coulter asked what has happened
to the Environmental Committee.
Sally deLancey stated that the Park and Recreation Commission will
be discussing this at their meeting December 7, 1971.

Bennyhoff to adjourn. The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and
Wolf. No negative votes. Motion carried.
