1971 12 13 ~ I I I CHANHASSEN VILLAGE COUNCJ:L MINU'¡'ES - PecemÞe~,1,31 J.971 The regular Chanhassen Village Council meeting on December 13, 1971, was opened with the Pledge to the Flag. The following members were present: Mayor Coulter, Councilmen Bennyhoff, Klinge1hutz, Neils and Wolf. COUNCIL MINUTES: A motion was made by Councilman K1inge1hutz and seconded by Councilman Neils to approve the minutes of the December 6, 1971, meeting. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1inge1hutz,. Neils and Wolf. No negative votes. Motion carried. VALLEY AUTO PARTS: The attorney representing Valley Auto Parts reiterated their many problems. He explained why a night watchman would improve the situation. The Mayor interupted asking if Valley Auto Parts had received a copy of a memorandum from the Police Department. A five minute break was taken while Mr. Vassar and his attorney read the Police report. ORDINANCE #2: A motion was made by Councilman Klingelhutz and seconded by Councilman Bennyhoff to approve Ordinance #2-A, entitled, "AN ORDINANCE AMENDING SECTION 1, SUBDIVISION 2 OF SECTION 3, AND SUBDIVISION 6 OF SECTION 5 OF ORDINANCE NO.2, ADOPTED JULY 17, 1967, AND ENTITLED 'AN ORDINANCE LICENSING AND REGULATING THE SALE AND CONSUMPTION OF INTOXICATING LIQUOR AND PROVIDING A PENALTY FOR VIOLATION'." The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klinge1hutz, Neils and Wolf., No negative votes. Motion carried. PROFESSIONAL PLANNER: A motion was made by Councilman Neils and seconded by Councilman Wolf to approve the agreement for professional planning services between Design Planning Associates and the Village of Chanhassen, as submitted. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1inge1hutz, Neils and Wolf. No negative votes. Motion carried~ VALLEY AUTO PARTS (contd): Sgt. Wallin and Patrolmen Thiede and Anding were present and gave a report, to the Council, on the many problems at Valley Auto Parts. The need for better lighting and more fencing was generally agreed upon. A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf that the Administrator meet with Mr. Vassar and draw up a Conditional Use Agreement, allowing a mobile home to be placed on this property. Specifying a one year time limit and it must have approved sewer and water facilities. Agreement to be submitted back to the Council for final approval. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Neils and Wolf. Councilman Klinge1hutz voted no. Motion carried. POLICE REPORT: General discussion on the monthly Police report. The Administrator explained how burning complaints have been handled. It was the con census of opinion, by the Council, to follow the same procedure by warning the individual or firm once and that the second violation would be a written citation. ~ CHANHASSEN VILLAGE COUNCIL MINUTES - December ¡3, ¡97¡ -2- CHES MAR DRIVE: The Administrator read a letter from Mr. & Mrs. William Wegler, Mr. & Mrs. Dennis Jacobson and Mr. & Mrs. Wm. Johnson, requesting that 30 M.P.H. speed signs be placed on Ches Mar Drive. I The Police Department stated that 40 M.P.H. speed signs would be a proper speed limit. A motion was made by Councilman Bennyhoff and seconded by Council- man Neils that the Maintenance Superintendent be instructed to install 30 M.P.H. speed limit signs on Ches Mar Drive, between the north and south entrances on Hazeltine Blvd. The following voted in favor thereof: Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. Mayor Coulter voted no. Motion carried. The Mayor stated that the reason he voted no was because he felt that the Police Department recommendation should be followed. The minutes should reflect that in this discussion it was brought up that Mr. Volk, living on this street, is in violation of the Zoning Ordinance. WESTERN CONCRETE: A letter from Western Concrete was read explaining what they would do to maintain the area being used to clean the concrete trucks. Another letter from Western Concrete's I attorney was read, stating his opinion on this problem. The Village Attorney is to have a report ready, on this problem, by the next meeting. A motion was made by Councilman Wolf and seconded by Councilman Neils to ask the Park and Recreation Commission to review this problem with relationship to the natural ponding area and the environmental problems. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1ingelhutz, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff to request the Village Engineer submit a brief report on the problems of filling this area. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. SUNRISE RIDGE: A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf to waive the liability insurance requirements under Section 13 of the submitted Sunrise Ridge Development Contract. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Neils and seconded by Councilman I Klingelhutz to approve the development contract for Sunrise Ridge and authorize the Mayor and the Clerk to sign said contract and the final plat. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klinge1hutz, Neils and Wolf. No negative votes. Motion carried. ~ I I I CHANHASSEN VILLAGE COUNCIL MINUTES - December 13, 1971 -3- LAKE ANN PARK CONTRACT: The Council had a discussion with Mr. Pirkl, representative from Brauer & Associates, Mr. Gilbertson of Park Construction and Jerry Bel1air of Be1lai~ Construction. The Administrator was instructed to meet with all parties concerned and report back at the next meeting. GAS BIDS: A motion was made by Councilman Klinge1hutz and seconded by Councilman Bennyhoff to authorize the advertising for gasoline and oil bids for the year of 1972. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1ingelhutz, Neils and Wolf. No negative votes. Motion carried. TRUCK BIDS: The following bids were opened on Friday, December 10, 1971, at 2:00 p.m.: Harold Chevrolet plus $312.00 for 12 ply tires 8,018.85 Waconia Dodge 8,230.00 plus $100.00 for 12 ply tires plus $ 60.00 for additional 40 gallon gqS tank Ast1efords bid is for 10 ply tires 7,852.00 Brady Motors bid is for lO ply tires 8,080.30 Waconia Motors 12 ply tires are in bid 7,986.00 Explanation by Administrator: The low bid from Ast1efords does not meet all the requirements as requested in the bid specifications. Also the federal government is requiring 12 ply tires on this size truck as of January 1, 1972. The Administrator's recommendation is that the Council accept the low complete bid from Waconia Motor. A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf to accept the bid from Waconia Motors of $7,986.00. The following voted in favor thereof: Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. Mayor Coulter abstained. Motion carried. SPECIAL MEETING: A motion was made by Councilman Bennyhoff and seconded by Councilman Neils to approve the $15.00 expense for attendance of a seminar held by the Minnesota Housing Institute. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klinge1hutz, Neils and Wolf. No negative votes. Motion carried. CHANHASSEN V¡LLAGE COUNCIL M¡NUTE$ - Decembe~ 13, 197¡ -4- ~ SOUTHWEST SEWER ADVISORY BOARD: A motion was made by Councilman I Bennyhoff and seconded by Councilman Neils to authorize Councilman Wolf and Adolph Tessness to attend the meeting on December 16, 1971, and the Village pay the $5.00 per person expense. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1ingelhutz, Neils and Wolf. No negative votes. Motion carried. 1972 BUDGET: The administrator reported that the 1972 Budget as submitted and approved appears to be within the limits of the new state tax law. A motion was made by Councilman Neils and seconded by Councilman Wolf to adjourn. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1inge1hutz, Neils and Wolf.
