Highway 101 Meeting Schedule

The last Highway 101 neighborhood meeting will be held on February 29,2000 at
the Chanhassen Recreation Center ITom 6:00 to 10:00 p.m.
A community-wide open house will be held on March 22, 2000 ITom 6:00 to
10:00 p.m. at the Chanhassen Recreation Center.
An open house for the residents living along the Highway 101 corridor will be
held on April 12, 2000 at the Chanhassen Recreation Center.
The above meeting schedule will allow the City Council to hold a public hearing
on the Highway 101 improvement project at their April 24, 2000 meeting, if
desired.
Please be aware I have received criticism ITom residents living along the corridor
who feel that the agencies are rushing to make a decision on this project without
allowing adequate time for residents to develop a full understanding of the project
and have their concerns addressed.

Current Status of Spring Load Restrictions
Spring Load Restrictions (SLR) will begin at 12:01 AM on
Friday, Feb. 25, 2000 in the SOUTH Zone, SOUTHEAST Zone,
& CENTRAL Zone, including the Twin City Metro Area.
SRR will last eight (8) weeks ftom the start date. Reminder, all county, city, and township
routes are automatically reduced to 5- TON Axle Limit during the times MN/DOT has set
SRR (this is a change ftom previous years).
Start date for the NORTH Zone has NOT been set.
Spring Load Restrictions are set based on the type of weather we have in early spring.
Starting dates will be set on very short notice in the year 2000 and will be based on a 3-
day weather forecast. It is the responsibility of the truck operator to ftequently check this
recorded message site at telephone 651-406-4701 or toll ftee 1-800-723-6543. The
recorded message will be updated to reflect changes in the spring load restriction
announcements.
The following comments will be helpful to you in planning your transportation needs.
The Winter Weight Increase Law that allows zero to 10% heavier than normal weights
will end on March 7, or earlier. If Spring Road Restrictions begin before March 7, the
Winter Weight Increase will end at 12:01 AM on the starting date of Spring Road
Restrictions within a zone or zones where Spring Restrictions have begun.
All county and town roads are by law automatically reduced to 5-Ton Axle Limit, unless
posted otherwise or changed by local ordinance, at the same time Spring Road
Restrictions start on State Trunk Highways as noted on this tape and the WEB site noted
above. Call 651-405-6018 to get a Spring Road Restriction Map, which shows postings
on State Trunk Highways.
Be aware any road, especially detoured routes, as well as, any bridge may be posted with
a weight restriction ANY time during the year. Therefore, watch for posted signs that
limit axle & axle group maximums on roadways or limit Gross Vehicle Weight (GVW)
on bridges.
As start dates become available and as changes are made, the phone message and the
WEB site will be changed. Thank you for checking and please drive safely.

MPCA Citizens' Board
to act on water quality
coop permits
On Feb. 22 the MPCA Citizens'
Board will be hearing and acting on
two Water Quality Cooperatives
Permits. These permits will autho-
rize the Headwater Rural Utility
Association (HRUA) and the Rainy
Rlver'Rural Utility Association
(RRRUA) to install subsurface
discharging alternative wastewater
trearment systems anywhere within
two large geographic regions-the
Mississippi River Basin and the
Rainy River Basin.
Cities that have dealt with the
oooperatives are concerned the
oooperatives will encircle a city,
stranding a city's investment in
wastewater treatment infrastruc-
ture. This means the cooperatives
oould operate to your city limits,
making the extra growth capacity
built into your system useless, and
cutting the revenue needed to pay
off the infrastructure debt.
The Board will first meet as a
permitting committee to discuss the
merits of the permits, 11a.m. -
12:30 p.m. in the Lower Level
Board Room of the MPCA. The
Board will reoonvene as the com-
mittee of the whole and the pennit
will be considered as an appear-
ance item from 3 to 5 p.m.

Takings
The House Local Government
Committee passed H.F. 591 as
amended to the House CMI Law
Committee. While the majority of
the bill was deleted, two provisions
affecting eminent domain remain:
. Quick Take: The bill amends
Minnesota's eminent domain
quick take provisions by requir-
ing a full year's notice before
possession of the property is to
be taken; the law currently
requires 90 days prior notice;
. Compensarion: The bill allows
property owners to be reim-
bursed for attorneys fees and
other costs in the event the real
property owner wins a judgment
in excess of 15% of the offer
made by the condemning author-
Ity and is patterned after Wisc.
Stat. sec. 32.28. This language
is not clear about what reason-
able attorneys fees are nor does
it provide a threshold dollar
amount before the compensation
requirements would be triggered.
For example, if the court award
was $1,500 and the city offered
$1,000, the city would be liable
for attorney's fees, appraisal
fees, and other costs.
Shooting Ranges
Due to Immense opposition to the
Shooting Range Preservation bill,
Sen. Jim Vickerman (DFL-Tracy)
withdrew the bill, H.F. 619/S.F. 592,
from the Senate Local and Metro-
politan Government Committee
agenda. The bill, set for a hearing
Feb. 16, would have exempted
shooting ranges from zoning
activities. It 15 unclear whether this
bill will be rescheduled, however, It
likely will be pursued by its propo-
nents through amendments this
year or as a bill next session.
Charter Commissions
Rep. Barb Haake (R-Mounds View)
introduced H.F. 2517 to prohibit
elected City officials from serving on
charter oommissions. Apparently
this bill stems from an issue in her
community. The bill would have any
elected official who is currently
serving on a charter commission be
removed immediately upon rhe
effective date of the bill. The LMC
does not have a position on the bill
at this time. However, similar to last
year's watershed management
organization legislation, we are
concerned this bill will address a
specific problem while having the
potential to negatively impact other
cities statewide. If you have any

WE NEED YOUR HELP!
The City of Chaska will be celebrating its sesquicentennial ( I 50th Birthday) in 2001. It will be a
time to gather our people to recognize the City's heritage and to honor those who preceded us,
and those who continue to strive to make Chaska the "Best Small Town in Minnesota".
What do we have to celebrate? What happened during the City's 150 years? The City will be
one and one-half centuries old - reason enough to celebrate. But, Chaska experienced an
evolution during its 150 years that has been exciting and unique. Following is a very brief
summary of the City's history.
The City has evolved from an early eighteenth century fur trading post to a community of
16,000. In August of 1851, Thomas Andrew Holmes selected Chaska as a trading post site. In
1857 the original Carver County Court House was built on the sites that are now the First
National Bank of Chaska, and Chaska Post Office. The City Square site was also set aside for
park purposes in 1857. Summer band concerts began as early as 1877. As the century closed,
the City Square, after a slow beginning, had become an important part of the community - a
gathering place - as it is today.
During the first half of the 1900's, Chaska's main industrial base was the production of sugar,
manufacture of bricks, and a service center for the agriculture community. The 1950's saw the
beginnings of the transition of Chaska ITom being the center of an agriculture trade area into a
community experiencing the expansion of a rapidly growing metropolitan area.

Thank you for attending our luncheon on January 27th. For those of you unable to attend. I have enclosed
copies of our handouts distributed during the luncheon. The luncheon was a means of opening the doors of
dialogue between the PGA Championship and your respective cities. The partnership between the PGA of
America and Hazeltine National Golf Club depends heavily on the successful relationship with our neighbors. So
in order to promote and introduce the PGA Championship to each of our neighbors. we are recommending the
following.
We are asking each city to designate a representative to serve on our Community Relations Committee, or CRC
committee. This committee will provide a forum to keep each of your cities aware of the current happenings
within the PGA Championship. while helping us. and you share that information which is important to your
respective citizens.
We know this will provide your offices with the necessary tools to better answer questions or concerns on the
event's impact on your communities. The meetings will not require a lot of personal time outside of attending
committee meetings by your designee's behalf. The committee's purpose is to act more as a conduit by which
information may be dispersed. and rumors dispelled. A timeline of scheduled meetings will be established this
spring upon hearing from your designated representative. We hope you will join us in taking this proactive step
in sharing the PGA Championship with your communities. with the State of Minnesota. and the world.

one of them is always the community and state support for such an event. It Is our hope to continue the support
and exdtement that Is characteristic with Minnesota and local communities like yours when previous major

Diana Kasper convened the meeting and following introductions, Lee
Meyer of KKE Architects explained the funding for the fields at the .
present Middle School campus and the proposed sequence of
development. Points were made including:
· irrigation is critical (it does not do any good to develop new
fields if the old or new are not irrigated)
· 70 X 110 is minimum size for soccer field
· Chaska Tennis Assn. wants to dome four tennis courts which could be
a partnership with funding from the Tennis Assn., Chaska Parks and
Recreation, and the District.
The discussion then moved to the Chaska High School site. Comments
included:

PM in the Fall, 2000.

What is the cost of bleachers? Why the difference between $150,000
and $120,000 It was later explained that the difference of$30,000 is
in the design costs, the fencing, etc.
Groups indicated that they might be able to fund the bleachers so that
the money contributed could go back to fields to get sand peat fields.

TI\i5 balanced transportation funding proposal calls for the creation of ¡j new multimodal
transportation fund. A statutory dedication of approximately 46 percent of the motor vehicle
sales tax will be made to this new fund.
This transfer will provide approximately $245 million per year in new dollars.
The creation of this fund will position Minnesota to'leverage additional federal funds for
transportation purposes and corrects the state's history of under funding transportation and
transit. The proposal supports smart growth principles by aligning transportation Investments
with land use, Jobs and housing.

Minnesota motor vehicle registration" taxes are among the highest in the region, averaging
an estimated $126 in 1999 for a passenger vehicle. Considerably lower rates can be found in
the neighboring states of North Dakota, $55 average rate; Wisconsin, $45 flat fee; and
South Dakota, $45 average rate.'
The w<r¡ roads are designed today, passenger cars do not erode them any more than the
weather. In addition, the tax paid by motorists is based on vehicle value, which has no
relationship to road deterioration. A better and more fair solution is needed,
The Governor's proposal
. Governor Jesse Ventura believes MiMesota

and retains a minimum tax of $35.

Motor vehicle registration taxes are currently
depositèd to the dedicated highway funds. The
Governor's proposal transfers general funds to
replace lost highway funds resulting from the
tax reduction in the first year. After the first
year, a constitutional amendment is proposed to
transfer approximately 54 perrent of the motor
vehicle sales tax to replace the lost revenue to
the highway fund.

Dear Representative Molnau,
Thank you for your time and your counsel regarding Chanhassen's desire
to upgrade our current library facilities. I believe Carver County
Commissioner Ursula Dimler, our City Manger Scott Botcher and myself all
came away from the meeting with a clearer understanding of the obstacles
and opportunities involved in seeking State participation in a new
library project.
During our visit you raised an issue that deeply concerns me. You asked
for clarification of Chanhassen's position on the proposed development
of Highway 212, in light of the visits to various State Legislators and
members of the Governor's staff by Chanhassen Councilwoman Linda Jansen
and representatives of the Sierra Club. Your agitation at Chanhassen's
perceived reversal of position took me by surprise.
The City has not wavered from the official position we communicated to
Mr. Robert Lindall of the Southwest Corridor Coalition in the fall of
1998. The City's position is quite clear. In October of 1998, the City
forwarded a signed Memorandum of Understanding and an accompanying
letter that clearly stated that Chanhassen does support the future
building of Highwav 212. We also noted that the City has a number of
design concerns that will have to be addressed before the project moves
forward. We executed a second MOU in March of 1999 regarding the
acquisition ofland along the right-of-way. The City Council has not met
as a group to discuss any modification to our official position since
then. I've enclosed a copy of the MOU for your files, as well as a copy
of an editorial letter recently written by Mr. Botcher.
The crux of the issue is whether or not Ms. Jansen's visits with the
State Legislators and the Governor's staff should be construed as
representing the official position of Chanhassen, or whether she is
merely expressing her personal opinion as a citizen. Clearly, she has
received no official direction from the City Council to contact anyone
about Highway 212. The topic of Highway 212 has not come up in our
Council work sessions in any manner that would even informally lead Ms.
Jansen to be conducting informational interviews on the subject, nor is

sne reporting any information back to the Council. Therefore, I must conclude that she is acting
(in concert with the Sierra Club) solely as an independent citizen, totally separate ITom any
official capacity as a representative of Chanhassen.
In one of our next work sessions, I will request that our elected City Council members clearly
communicate whether they are representing the City's official position or their personal position
as a citizen when dealing with other government officials or with the press. However, to the
extent that any member of our community is exercising their rights as an individual citizen, the
City has no basis to become involved.
I hope this clears up any confusion. If in the future you have any concerns about Chanhassen's
position on issues, in the spirit of keeping the communication lines open and unambiguous, I
would appreciate it if you contact me directly as soon as a question comes up.

The City of Chanhassen has given a great deal of thought, study and discussion to
the Memorandum of Understanding <MOU) fOrwarded by the Southwest Corridor
Transportation Coalition. Although the MOU advocates action steps to accelerate
the design and cOnstruction of Highway 212, many issues important to the City of
Chanhassen still remain IIDr'esolvcd. Until these issues can be resolved, the City is
unable to sign the proposed agreement in its cunent form.
Chanhasscn has histoñcally taken a responsible, wen-p1anned approach to
development to preserve the character that our residents value. Highway 212 has
the poœntial to be one of the most disruptive and destructive public improvement
projects to take place in our commwúiy. Done properly, Highway 212 could be an
asseL If done incorrectly, it could divide our commwúty.

Apan from these issues, it is imPOrtant to note that Chanhassen does suppon the

L If construction of Highway 212 proc::eds in a series of suges, and results in a
temporary tennination of the highway in Chanhassen, our existing road
infrastructure is insufficient to cope with the additional traffic without
considerable investment and significant impact to our commwúty. Since one of
the major arguments for 212 is that it will serve to pass traffic through the
cOmmunity. the entire length through our city should be built at one time.
2. We need to look at the overall tranSPOrtation needs on a regional level. The
Southwest Corñdor Transportation Coalition is championing the completion of
Highway 212, but this is only one element in the broader context of regional
ttansponation. We should stanñghtnow to coordinate thesi: needs. Member
cities and counties should appoint representatives to work with MnDOT to
craft a well fhought out comprehensive pIan.
3. Major upgrading of Highway 494 must be funded in order to cope with the

and accessible throughout the process. As pressure builds to move forward
with aspects of 212 planning and right-of-way acquisition, we will schedule
regular public input meetings to re-examine, re-study, and re-think how and
when to proceed and what the design and character should be.
In light of the above issues, the City of Chanhassen has taken the liberty of drafting
and forwaniing a MOU it would wholeheanedly support and sign.

WHEREAS. the parties hereto. wbilc recognizing it is in their mutual best interests to

NOW. THEREFORE. in consideration of the premises and their mutual best interests, the
panics hereto hereby agree as follows:
1) The construction of 212 should be completed westerly to County Road 4 as the
Cit;}' of Eden Prairie has desired.
2) The acquisition of 212 CoIIidor right-of-way should continue, fully utilizing the
DEMONSTRATION GRANT FUNDS and available RALF. only acquiring properties deemed
tle('~5S"ty by mutual agreement between MnDOT and the respective governmental entities in
wbid1 said acquisitions reside.
3) In that funds are not available in the foreseeable future to COnstruct the balance of
212 in its enñret;}', and construction should not proceed further until there is sufficient committed
funding to upgrade Highway 494 to accommodate the additional traffic, and the needed
lnfrastructurc in the affected communities can be put in place to handle the projected additional
trnffic vohnnes:
a) In Olanhassen. where existing road infrastructure is insufficient to handle
the increased traffic levels if212 terminates there temporarily, 212 should be constructed
œmpletely through the commu~ity in a single phase.

b) In the intcñm. the Right-<lf-Way should be left in Passive ParJc use with
