Approve Temporary Permits to Construct for Trunk Highway S/West 78th
Street Improvement Project No. 97-6
The Minnesota Department of Transportation (MnDOT) and the City of Chanhassen have
been working cooperatively for several years to bring about the reconstruction of Highway 5
from Powers Boulevard to Highway 41 and the construction of West 78th Street from Lake
Ann Park to Highway 41. This project will upgrade Highway 5 to a four-lane, divided
roadway and include the installation of permanent traffic signal systems at Audubon Road,
Galpin Boulevard, and Century Boulevard.
The construction phase of the TH S/West 78th Street Improvement Project will take two full
construction seasons. It is desirable for the construction contract to be awarded in the early
spring of 2000 to take full advantage of the short construction season. However, due to the
lengthy process required for right-of-way acquisition, it appears that construction will not
occur until August of2000. This will result in Highway 5 being under construction for
essentially three summers with completion by late summer of 2002.
Recognizing the safety and capacity problems on this segment of Highway 5 and the benefit
of completing the project in two construction seasons rather than three, the City is asking
property owners from whom MnDOT will be acquiring right-of-way to grant MnDOT the
right to enter upon their property for the purposes of construction without having the right-
of-way acquisition process completed. MnDOT officials have rescheduled the contract
letting for this project from June 14,2000 to March 24,2000 which would allow
construction to begin in the spring and provide for substantial completion by fall of 200 I
contingent upon the City obtaining Temporary Permits to Construct from property owners.
I recommend approval of the Temporary Permits to Construct for MnDOT parcel nos. 213,
216D, 219, 220A, 311C, and 321. By executing the Temporary Permits to Construct, the
City retains all rights to compensation for its property impacted by this project and helps to
insure the construction of Highway 5 and West 78th Street will be substantially completed by
fall of 200 I. The construction plans for this project are available in my office for review.
