Application of Kris Cosgrove for a private
kennel license for 7187 Fawn Hill Road.
FINDINGS OF FACT
AND 'DECISION
On October 9, 2000, the Chanhassen City Council met to consider the above
application ofKris Cosgrove ("Applicant") for a private kennel license for three dogs to
be located at 7187 Fawn Hill Road ("Subject Property").
The Applicant was present and the City Council heard testimony from all
interested persons wishing to speak at the meeting and now makes the following Findings
of Fact and Decision:
FINDINGS OF FACT
I.
The Subject Property is zoned RSF, Residential Single Family District.
2.
Chanhassen City Code Section 5-16 requires any person maintaining a private
kennel in the City to obtain a private kennel license.
3.
Section 5-16 requires approval by the City Council of the issuance of a private
kennel license in all cases where either: 1) the City inspector does not affirmatively
certifY that the kennel is maintained in a neat, orderly, and safe condition; or 2) the
City has received complaints.
4.
The City has been informed of numerous problems concerning Applicants dogs
located at the Subject Property: excessive barking, aggressive behavior by the dogs,
the dogs run-at-Iarge, the dogs have bitten people on several occasions, the
Applicant does not consistently have the dogs wear the electronic collars designed to
work with the invisible fence, and the Applicant has not been responsive to
neighbors' requests to control the dogs.
5.
There are a number of young children living in the surrounding neighborhood and
near the Subject Property.
6.
The Subject Property is located near a neighborhood park.
7.
A Carver County Sheriff's Department Report dated August 6, 2000, documented a
dog-bite incident by one of the dogs owned by the Applicant, in which the dog ran
outside the invisible fence, into the street in tront of the Subject Property and bit a
neighbor who was out walking in tront of the Subject Property.

8. Based upon the record and testimony provided in this matter, the City finds that
the Applicant is unable or unwilling to control here dogs and that the approval of
a dog kennel would create a safety hazard.

The application for a private kennel license is denied,

VerifY Compliance with City Ordinance at 7187 Fawn Hill Road
On October 17, City Manager Scott Botcher, Carver County Sergeant Dave Potts,
Carver County Deputy Gary Stahlke, and myself inspected Ms. Cosgrove's
residence to verify compliance with the City Council's decision to have "one of
the three dogs removed." Based on our inspection, Ms. Cosgrove only had two
dogs being kept at her home o£1187 Fawn Hill Road.
We also investigated the potential propensity or disposition ofthe remaining two
Shetland Sheep Dogs and found them !ill! to be "dangerous or potentially
dangerous dogs." Staff walked by the house more than once and the dogs showed
no signs of attacking or aggressive behavior. We also noticed that the two dog's
voice boxes were removed, limiting the noise level of their barking.
Conclusion
Ms. Cosgrove has complied with the City Council's decision to have one of the
three dogs removed. Staff also found the remaining dogs not to be potentially
dangerous or a threat to the neighborhood. No further action will be taken on this
item.
