SUBJECT: EDA Bonds for Lake Ann Park Maintenance Building
The attached documents describe the modified plan for financing the Lake Ann
Park maintenance building and the procedural actions necessary to issue the
bonds. This process was complicated by the belief that we needed to create a new
"project area." In consultation with city staff and Mary Ippel it was determined
that the building will be built inside the existing Downtown Chanhassen
Redevelopment Project Area of TlF District I, as previously created by the
HRNEDA. The documents have been changed to simply add the constructing
and equipping of the municipal building to the list of public improvements as an
additional activity. Creating a new project area is not necessary.
There is another issue that arose during the course of discussions that must be
addressed. The city will need to lease the property that the building is to be
situated on to the EDA. This provides the lenders with the legal authority to take
possession of the building in the case of non-payment. The parcel to be leased is
the approximately 60 acre parcel that comprises the majority of Lake Ann Park.
Since the City commits to annually paying the amount due under the lease, no
adverse consequences are anticipated. Even if non-appropriation were to occur by
some future council, the property is guided for park or open space which would
prohibit the lender from developing the property some other way.
The procedure on Monday evening is to hold the public hearing and adopt the
resolution approving the redevelopment plan as a City Council and then recess.
The EDA will then be called to order to accept the same plan by resolution and
then adopt the Revenue Bond sale resolution. After that motion, the EDA will
adjoum and the City Council will hold the Truth-in- Taxation public hearing.

RESOLUTION APPROVING REDEVELOPMENT PLAN FOR
DOWNTOWN CHANHASSEN REDEVELOPMENT AREA. MODIFICATION NO. 14
BE IT RESOLVED by the City Council (the "Council") ofthe City of Chanhassen,
Minnesota (the "City"), as follows:
Section 1. Recitals.
1.01. It has been proposed by the Economic Development Authority of the City of
Chanhassen, Minnesota (the "Authority"), that the Authority establish a Redevelopment Project
Area in connection with constructing and equipping a municipal building for the City and adopt a
redevelopment plan for the municipal building, all pursuant to and in conformity with applicable
law, including Minnesota Statutes, Sections 469.001 through 469.047 and 469.090 through
469.1081.
1.02. The municipal building will be located within the Chanhassen Downtown
Redevelopment Project Area (the "Project Area") previously established by the City so therefore
it will not be necessary to establish a new project area.
1.03. A "Redevelopment Plan for Downtown Chanhassen Redevelopment Area,
Modification No. 14," dated December 4,2000 (the "Plan") has been prepared and presented for
the Council's consideration.
1.04. The Council has investigated the facts relating to the Plan.
1.05. The City has performed all actions required by law to be performed prior to the
adoption and approval of the Plan, including, but not limited to, a review of and written comment
on the Plan by the City's Planning Commission and holding a public hearing thereon following
not less than 10 nor more than 30 days' prior published notice thereof, as required by law.
Section 2. Findings for the Adoption and ADDroval of the Plan.
2.01. The Council hereby finds that the Plan conforms to the general plan for the
development or redevelopment ofthe City as a whole because the Project Area is properly zoned
for the intended uses, and the anticipated development is in furtherance of long range plans of the

City for that area; and that the Plan will afford maximum opportunity consistent with the sound
needs of the City as a whole, for the development of the Project Area and adjacent areas by
private enterprise because they will enable the Authority to provide and finance necessary public
facilities within the Project Area.

2.02. The Council further finds that the Plan is intended and, in the judgment of this
Council, its effect will be, to promote the public purposes and accomplish the objectives
specified in the Plan.
Section 3. ADDroval and AdoDtion ofthe Plan. The Plan, as presented to the Council on
this date, including without limitation the findings and statements of objectives contained
therein, are hereby approved, established, and adopted and shall be placed on file in the office of
the City Manager.
Adopted by the City Council of the City of Chanhassen, Carver and Hennepin Counties,
Minnesota, this 4th day of December, 2000.
