BACKGROUND On July 28, 2003, the City Council adopted a resolution supporting the accelerated funding of new TH 212. On March 22, 2004, the City Council adopted a resolution granting Municipal Consent of the TH 212 project. On September 13, 2004, the City Council held a public hearing on the 2005 MUSA Improvements. On January 10,2005, the City Council received an update on the TH 212 project and discussed using State bonding to pay for the City improvements. On February 14,2005, the City Council ordered the 2005 MUSA Improvements to be built in conjunction with the TH 212 project. On February 28, 2005, the City Council approved the Cooperative Agreement with MnDOT for TH 212. At the March 14,2005 work session, staff discussed with Council using State bonding to help pay for the TH 212 improvements. On March 14,2005 Council called for a pubic hearing on the TH212/TH 101 Gap Bonding Project Items. DISCUSSION The City is considering bonding for the City improvements to be constructed in conjunction with the TH 212 project. Todd Gerhardt March 21, 2005 Page 2 program that MnDOT has created through the "MnDOT GO Bond Local Loan Program", established by the State of Minnesota, Minn. Stat. § 174.52 Subd. 2. This program was established to assist in paying the local share of trunk highway projects that have local costs that are directly or partially related to trunk highway improvements and that are not funded or are only partially funded with other state and federal funds. At the September 13, 2005 MUSA public hearing, projects and costs were identified to be built in conjunction with the TH 212 project. On February 14, 2005, the Council ordered these projects forward. To meet the bonding and assessment requirements, the other City improvements that are planned to be bonded and assessed outside the scope of the 2005 MUSA need a public hearing. These improvements are shown on the attached spread sheet with improvements proposed to be assessed. The improvements for the TH 212 project proposed to be assessed include turn lanes, signals, and sewer and water improvements. Also included in the background is the preliminary assessment roll. Staff has proposed including in the state bonding the TH 101 GAP project. The project has not yet been approved by Council, but it is appropriate to include this project in the bonding public hearing process at this time so a separate bonding hearing does not need to be held. No improvements in conjunction with the TH 101 project are proposed to be assessed. The bonding amounts for the TH 101 GAP project are not expected to be finalized until a construction contract is awarded in 2006. A separate municipal consent public hearing is scheduled for April 25, 2005 so the public can comment on the proposed improvements. The loan agreement with the State is anticipated to be considered for authorization at the April 11, 2005 City Council meeting. An assessment hearing for the improvements is anticipated in June. The assessment hearing date is dependent on when staff receives final costs from the TH 212 contractor for the improvements. The proposed improvements are necessary, cost-effective, and feasible.
