SUBJ: Adoption of an Ordinance Summary for the Surface Water
Management Utility
' On September 24, 1990, the City Council adopted Ordinance No. 132
establishing a Surface Water Management Utility District. The
district needs to be published in the local newspaper to satisfy
legal requirements. In keeping with past practices, staff normally
develops a summary of the ordinance to avoid the need to publish
the entire document with it's associated publication costs.
Staff is recommending that the City Council approve the attached
Summary for publication purposes.
In a related matter, staff and several members of the City Council
were in attendance at a recent breakfast meeting with Metropolitan
Council Chair Steve Keefe. Chairman Keefe spoke of the Council 's
coming efforts in dealing with water quality issues and advocated
water management utility districts as the most innovative approach
available to communities to deal with these problems and issues.
The City of Chanhassen received a substantial amount of interest
when it was noted that a Surface Water Management Utility District
had been adopted by the City and that, in our opinion, it
represents the most innovative and comprehensive attempt to deal
with water quality, wetland and storm drainage issues, yet
undertaken by a city. The Mayor and I spoke with Chairman Keefe
' after the meeting regarding our Comprehensive Plan update program.
It is my belief that Chanhassen's efforts in areas such as the
Surface Water Utility Program will be of great value when the Metro
Council reviews our Comprehensive Plan Amendment. As the City
Council is aware, I have been asked to serve on a Metro Council
Technical Advisory Committee established to address the non-point
source pollution issue. I have accepted this role believing that
it is extremely important that the interests of the community be
represented as programs and regulations are developed. I will keep
the City Council posted as to the Committee's progress.

SUMMARY ORDINANCE NO. 132 1
The ordinance establishes a Surface Water Management Utility
as allowed by Minnesota Statutes 444. 075. The Utility will be used
to generate funds used to support planning, construction, property
' acquisition, maintenance and related efforts designed to improve
the City's programs related to storm water management, water
quality and wetland protection. A formula for establishing fees,
credits and exemptions is provided. An appeal procedure is also
established. Fees are to be set by City Council resolution. I
