I The attached properties are consistent with previous City Council/
HRA interests on this matter . Authorization for acquisition/
condemnation is warranted in order to guarantee delivery of these
I properties in time for construction this spring . Negotiations
will continue in the meantime as the preferred method of
acquisition . Approval of the attached resolutions is recommended .

RESOLUTION AUTHORIZING ACQUISITION OF PROPERTY
FOR PROPOSED TRUNK HIGHWAY 101 REALIGNMENT ,
RESOLVED, that the City Council of the City of Chanhassen,
does hereby determine that it is necessary and for a public use
and purpose to acquire the property known as the Chanhassen Taco
Shop, legally described on the attached Exhibit "A", for the
proposed realignment of Trunk Highway 101. ,
AND BE IT FURTHER RESOLVED, that the Mayor and City
Clerk/Manager are hereby authorized and directed to execute all
documents necessary to effect the acquisition of the afore- I
mentioned property, and that the City Attorney be, and hereby is,
authorized and directed to effect negotiations and/or, if 1
necessary, institute condemnation proceedings and to do all i
things necessary and incidental thereto to acquire the property
pursuant to Minnesota Statutes Chapter 117 under the "quick take"
provisions of the Statute.
