BACKGROUND
As part of the downtown redevelopment and the City's acquisition of
' the Instant Web building, the City purchased, through metes and
bounds description, the subject property. Since the transactions
were done by metes and bounds descriptions, the right-of-ways
acquired for Market Boulevard and "Bowling Alley" Road do not show
on any half section maps or plats and it is unclear as to the
extent and location of city owned land located in the Filly's
parking lot. Therefore, staff initiated the preliminary plat to
' locate the City owned property and to have the street right-of-ways
shown on all plats and half sections for future reference.
PROPOSAL
The proposal is to plat the right-of-way for Market Boulevard and
"Bowling Alley" Road. In addition, the preliminary plat is
creating 3 outlots (A, B and C) which are also under city
ownership. Outlots A and B are located within Filly's parking lot
and Outlot C is a remnant piece south of "Bowling Alley" Road and
' north of the railroad track. All of the property is proposed to be
platted as right-of-way or as an outlot.
The City will be retaining ownership of the 3 outlots and the
' outlots will remain as outlots and unbuildable unless combined with
adjacent properties. Currently, the size and configuration of the
outlots results in them being unbuildable. The City is in the
process, along with the Southwest Metro Transit Commission, of
' considering relocating the bus shelter currently located on Market
Boulevard. The first proposal was to relocate the shelter onto
Outlot C, but due to the limitations from being required to
maintain an area of open site distance for the railroad track
crossing at Market Boulevard, the shelter is now proposed for
Outlot A (Attachment #1) . There will still be landscaping
' improvements and a bus turnaround provided on Outlot C. Parking
for the bus shelter, the bus shelter and improvements will be
granted by the City to the Southwest Metro Transit Commission by
easement over Outlots A and B. Outlot C is now proposed primarily
for only the bus turnaround and accessory improvements. To further
ensure that the bus shelter, bus turnaround and accessory
improvements are public improvements, staff is _recommending that
"Bowling Alley" Road right-of-way include Outlot C and the portion
of Outlot A which will contain the bus shelter. This will allow
the improvements which would not be permitted on an "outlot" since
' an outlot can not be developed. Southwest Metro Transit Commission
will retain a 5 to 10 year easement over the bus shelter
improvements and will be responsible for maintenance. Should the
bus shelter not be permanent and again be relocated, the portion
' of right-of-way no longer necessary could be vacated. Plans for
the relocation of the shelter are only conceptual at this time.
The HRA has agreed in principal but final approvals are yet to be

obtained. In addition, the site plan will need to be finalized for
review by the Planning Commission and City Council at future
meetings.
NOTE: The reason for the quotation marks around "Bowling Alley"
Road is that this is not the official name nor does anyone want it
to be the official name of the street. When Market Boulevard was
constructed, a contest was held to name the street. The City
Council could again initiate such a contest.
PLANNING COMMISSION UPDATE
The Planning Commission unanimously recommended approval of the
preliminary plat with staff's recommended condition. '
RECOMMENDATION
Staff recommends the City Council adopt the following motion: ,
"The City Council approves Preliminary Plat #90-8, for Easy Ryder
Addition as shown on the plat dated September 6, 1990, with the
following conditions:
1. Outlot C and the portion of Outlot A used for the bus shelter
shall be shown as part of "Bowling Alley" Road right-of-way. "

a . the operation is under contract agreement with the State of
Minnesota to provide these services;

c. no gas or parts are sold on the site;
d . no outdoor storage of vehicles or related materials;
e . no diesel testing to be allowed at the site;
f . state and federal air and noise standards shall be complied with . I
If problems are found to exist , the property owner shall be
required to pay for any testing deemed to be required by the City
to clarify the situation; ,

Vehicles stacking in fire lanes , parking areas and other drives
shall be prohibited .
All voted in favor except Wildermuth who's vote was silent and the motion
