We have chosen to give priority to the widening of Trunk Highway (TH) 5 between Interstate 494 and TH 41 and to the construction of new U.S. Highway 212 between II I-494 and Norwood. These roads have great importance to agriculture and business truck traffic as well as the needs of the growing number of businesses and residents of the southwestern area of our state. IIThe Minnesota Department of Transportation (MnDOT) has recently announced its intention to build the first phases II of new U.S. Highway 212 beginning in 1993 . This announcement is of major importance to our area. But the job is not done. il To ensure that this major project is not delayed, the Coalition is working with our Congressional delegation to obtain 1991 funding for TH 212 design. The Coalition is also working with MnDOT to schedule the contract letting dates for II TH 212 improvements and •the remaining portions of the improvements to TH 5. II During the past three years, the Coalition has been active in efforts to secure the earliest possible construction of the new Highway 212 and TH 5 improvements. For example, the Coalition has: 11 * Facilitated the joint powers agreement among the Cities of Eden Prairie, Chanhassen and Chaska, Carver I County, Hennepin County and MnDOT relating to design of the widening of TH 5 in Eden Prairie and Chanhassen; II II 1 I * Facilitated the joint powers agreement amount Eden 11 Prairie, Chanhassen, Chaska, Carver County, Hennepin and MnDOT relating to funding of the EIS on new TH 212 ; * Promoted increased transportation funding before the Legislature; * Promoted programming of improvements to TH 5 and construction of new U.S. Highway 212 before MnDOT; * Supported a joint powers agreement among Chanhassen, Chaska and Carver County to jointly study the highway network ancillary to TH 41 and U.S. Highway 212 ; and * Encouraged state agencies to conduct a study of the economic impact of a Highway 212. The Coalition's goals for 1991 are: 1. Work to secure federal or other funding for 1 Highway 212. 2 . Maintain oversight over and commitment to the scheduled improvements to TH 5. 3 . Obtain the design and construction scheduling of TH 5 from Park Drive to TH 41. 4 . Build our membership base particularly in the western portion of the corridor. In the past years, our efforts have been financed by public and private sector contributions. To continue our work we are beginning an effort to obtain membership and • contributions from private organization and public agencies located along the corridor. We view our role as being that of a catalyst to action and a unifying force for all public and private organizations which will benefit by improvement of these roads. The Coalition hopes that your organization will agree that the Coalition has been and can be helpful to you. A representative of the Coalition will be calling upon you within the near future to discuss the Coalition's program and the willingness of your organization to contribute to the effort to obtain the earliest widening of TH 5 and construction of the new U.S. Highway 212. A schedule of amounts which we are asking units of government to contribute to the Coalition and to the design of TH 5 from Park Drive to TH 41 is enclosed. We hereby request that the City of 11 I : ' II Chanhassen donate $10, 000 to these purposes during calendar year 1991 ($5, 000 of which would be paid for design of TH 5 from Park Drive to TH 41 and $5, 000 of which would be contributed to the Coalition to help finance its programs described above) . 1 We now have a great opportunity to get new U.S. Highway 212 built. II Managers present: Fiskness, Cardinal, Peterson, Rahr and Scribner . IIManagers absent : None. Also present : Board Advisors Raymond Haik and Bob Obermeyer . Approval of Minutes. The minutes of the regular meeting of August 1, 1990 , were II reviewed. Following discussion it was moved by Rahr , seconded by Peterson, that the minutes be approved with the correction on page 4 in the paragraph dealing with the City of Minnetonka Judicial 1 Ditch No . 2 Project Request . The references to Mr. Erickson in - the 2nd and 4th paragraph of that discussion should read "Mr . Johnson" . Also the secretary' s name should read "Frederick Rahr" . Upon vote, the minutes were adopted as corrected. IIThe minutes of the special meeting of August 29 , 1991 were reviewed. Following discussion, it was moved by Cardinal , I seconded by Peterson that the minutes be approved with the reference to the secretary corrected to read "Frederick Rahr" . Upon vote, the motion _carried. IICorrespondence. IA communication from the City of Minnetonka dated August 6, 1990 requesting the District' s consideration of a cooperative project for an underpass project beneath Excelsior Boulevard. The I project will include provision for a trail adjacent to Purgatory Creek. Following discussion the staff was directed to identify the water management features of the project and report to the Managers at the next meeting . . IA communication dated August 29 , 1990 from the Metropolitan Council Chairman discussing the 40% non-point source pollution II reduction effort and the problems faced by the Metropolitan Council and the MPCA in complying with federal requirements . Following discussion of the correspondence, the Chairman directed Ithat copies of the correspondence and the news reports be II II I forwarded to the Nine Mile Creek Watershed District. The Managers noted that the basis for the program was a December 1989 agreement between the MPCA and the US Environmental Protection Agency. The staff was asked to secure information as to the consent to such a commitment requiring a large expenditure as well as the need to proceed with projects prior to obtaining and completing the Minnesota River Assessment Program being conducted by the MPCA and the Met Council . A communication dated August 28, , 1990 from the City of Chanhassen reporting that the cooperative project for construction and maintenance of a sedimentation basin on Lot 8, Block 2 , Sunny ' Slope Addition had been completed. The Staff reported that the sedimentation basin had been sodded and accumulated sediments removed. They also reported that for periodic clean-out of the ' sedimentation basin will be the responsibility of the City of Chanhassen maintelftance crews . The Staff recommended payment of the District 's share of the coopelrative project in the amount of ' $757 .00 . A letter dated August 27, 1990 from the City of Chanhassen responding to the District ' s request for a status report on the ' MPCA/Watershed District Lake Riley Chain-of-Lakes Project. The response detailed the problems faced by the City of Chanhassen in securing a public access to Lake Lucy. The conclusion was that the City could not be in a position to guarantee that a public access would be constructed. Given the response of the City, it was the recommendation of the staff that the managers defer any additional expenditures in connection with the project be deferred until the public access issued had been resolved. A letter dated August 13, 1990 from the City of Chanhassen responding to the District 's request for cooperative study of . upland water storage sites in the Bluff Creek watershed. The City reported that it does not have a completed stormwater management plan, but the City staff is hoping to receive council approval for a stormwater utility to establish a funding source for preparation of such a plan. The staff reported that the municipal stormwater drainage plans could be coordinated with the ongoing studies of the Watershed District . The Chairman reported on his attendance at the meetings in Chanhassen and the commitment by the Watershed District to make information and data collected by the District ' available to the City. The Chairman directed the staff to submit a report to the Managers concerning the estimated cost of a preliminary study of the upland areas of the Watershed to Bluff Creek for the purposes of identifying potential water storage sites . A communication from the Edenvale Golf Club outlining a preliminary request for maintenance work in the channel and flood plain of Purgatory Creek from the railroad culvert through the golf course to the Metro Road culvert. I support the continued deductibility of state and local income taxes. I am concerned that such a proposal would dramatically ' increase the already heavy tax burden which Minnesotans bear. I believe deficit reduction ought to be achieved through cutting spending across the board on all programs, not through tax increases . America is not undertaxed. In my judgment, spending cuts in both domestic and entitlement programs, combined with a significant decrease in the, defense budget, should be our first choice . Should taxes be a component of a Summit agreement, I will work to ' ensure that no one group is unfairly burdened. This petition and resolution came on for hearing before the Minnesota Municipal Commission on July 7, 1966, and August 17, 1966, in the Carver County Court House, Chaska, Carver County, Minnesota and after publication and posting of the proper notices pursuant to the authority and responsibility under Minnesota Statutes 414.02, Subd. 5. The Commission takes note of the fact that at this time there is a petition pending for the incorporation of the Town of Chanhassen. However, the petitioners for the incorporation and the Town Board have stated that they believe the merger of the Town of Chanhassen and Village of Chanhassen is preferable to the incorporation of the Town of Chanhassen alone. The Commission is issuing its present order for the merger of the Town and Village of Chanhassen at this time because it also believes the merger is preferable to incorporation of the Town ' of Chanhassen. The commission will seek an extension of time for the filing of its decision in connection with the incorpora- tion petition until after the merger has become effective. When the merger becomes effective the incorporation petition will then be denied. ' The petition of the freeholders of the Town of Chanhassen and Resolution of the Village of Chanhassen for the consolida- tion of the Town and Village of Chanhassen was filed pursuant to and in compliance with Minnesota Statutes 414.; and said ' Petition and Resolution were in all respects proper in form, contents and execution. II. ' Notice of the hearing on the Petition and Resolution for { the consolidation of the Town of Chanhassen and Village of ' Chanhassen was duly given as required by statute. The Commission I --2-- 1 IP/ ' convened by a lawful quorum at the scheduled hearing. All parties of record for and against said Petition and Resolution ' were present at, and participated in the hearings. III. The area to be incorporated and consolidated as a new ' municipality is the entire Town of Chanhassen, Carver County, Minnesota and the entire Village of Chanhassen, Carver and ' Hennepin Counties, Minnesota. IV. ' The area of the Town of Chanhassen and Village of Chanhassen is approximately 1$, 124 acres. V. The population of the Town of Chanhassen and the Village of Chanhassen as estimated by the most recent estimate of the ' Metropolitan Planning Commission is: Town 3,765 and Village - 563, total 4,32$. II VI. Approximately 6 per cent of the combined area of the Town ' and Village of Chanhassen is platted and 94% is unplatted. VII. ' The Village of Chanhassen is almost entirely developed having residential; commercial and industrial type buildings. ' The Town of Chanhassen is approximately 90% undeveloped and 10% developed. Of the developed area approximately 32% is residential, 10% is commercial, 7% is industrial, 6% is public ' and semi-public buildings, 13% is public open space, 26% is railroads and streets. ' VIII, Population and construction in the Village of Chanhassen ' have grown in the past to the point where the Village is substantially developed with little area available for future ' development. Population and construction in the Town of Chanhassen have grown in the past and are expected to continue to grow at an increased rate in the future. -3- I 1 ' IX. The assessed value of all of the platted property in the Town of Chanhassen exceeds the assessed valuation of the un- platted land and the assessed value of the Village of Chanhassen in 1960 was $355,015. ' X. The Village of Chanhassen has its own sewage treatment facilities and central water system. The systems can be expanded to service a considerable portion of the area in the Town of Chanhassen. The Village of Chanhassen has a voluntary fire department which services the village and will be able ' to serve the major portion of the Town of Chanhassen. Portions of the Town of Chanhassen are also serviced by neighboring I . Voluntary Fire Departments. The Village of Chanhassen has a Police Department. The Town of Chanhassen has police protection furnished by the Carver County Sheriff's Office and two elected ' constables. The Village Police Department can be expanded to provide additional police protection for the Town of Chanhassen ' area. XI. ' Both the Town and Village of Chanhassen have zoning ordin- ances. The Town and Village of Chanhassen have adopted sub- division regulations, appointed Planning Commissions, hired professional engineering firms, and have cooperated and worked ' together in regard to planning for the future. XII. An active citizens group has studied the financial and ' other aspects of the merger of the Town and Village of Chanhassen and reported on the same. ' XIII. The Town of Chanhassen and Village of Chanhassen can be ' reasonably expected to participate in suburban growth in the metropolitan area, and are now, or are potential residential, commercial, and industrial property. There is now and will be in the immediate future a need for increased governmental service in the area to be incorpora- ted and the Village form of government will better be able to 1 protect the public health, safety and welfare of the residents within the Town of Chanhassen. It is in the best interest of the public that the Town and Village be merged to form a new municipality so that municipal services to the residents in the ' Town and Village can be more efficiently and economically pro- vided to the residents. ' XV. The area proposed to be incorporated can best be served by one village in the matter of community planning, installa- ' tion of thoroughfares, street systems, sewer and water systems, fire and police protection and other vital and necessary community services. XVI. The entire area to be incorporated and consolidated is or is about to become urban or suburban in character. ' XVII. The township form of government in Chanhassen Township ' is inadequate to cope with the problems of urban or suburban growth within the Town. XVIII. ' The Town and Village of Chanhassen when merged can be served by a general drainage system and the result of the ' consolidation will be to provide the most reasonable and efficient governmental services relating to drainage and sewage disposal within said area. XIX. The name of the proposed Village is Chanhassen. XX. The Citizen's Committee, Petitioners, Village Council ' and Town Board have requested that the plan of government be Optional Plan A. i -5- � f V. XXI. II During the proceedings in connection with the consolidaten petition and resolution requests and petitions were received II for the annexation of portions of the Town of Chanhassen to neighboring municipalities. Evidence was received in connec- tion with these proposed annexations and after the considera- tion of the testimony, all of the parties who made appearances as listed above agreed and the Commission now finds that it is in the best interest of the entire area that the northwestern portion of the Town of Chanhassen as more particularly described II in the Order of the Commission dated the 14th of November, 1966, should be annexed to the Village of Victoria and the southwestern I portion of the Town of Chanhassen as more particularly described _, in the Order of the Commission dated the 15th day of December,1966 should be annexed to the City of Chaska. A request was also I made for the annexation of the southeastern portion of the Town of Chanhassen as more particularly described in Exhibit "A" IIattached hereto and made a part hereof by reference, to the City of Chaska and evidence was received in regard to said Irequest. All parties agreed and the Commission now finds that it is in the best interest of the City of Chaska, the territory II described in Exhibit "A", the Town of Chanhassen and the Village of Chanhassen that no part of the land described in Exhibit "A" II be annexed to the City of Chaska and that all of the area des- cribed in Exhibit "A" be included as a part of the new consoli- ' dated Village of Chanhassen. . CONCLUSIONS OF LAW II 1. The Minnesota Municipal Commission duly acquired and now has jurisdiction of the within proceedings. 2. The area to be incorporated is the Town of Chanhassen, ICarver County, Minnesota and the Village of Chanhassen, Carver and Hennepin Counties, Minnesota. I 3. The area to be incorporated and consolidated is now, or is about to become, urban or suburban in character. i1 /I A 4. Municipal Government of the area to be consolidated is required to protect the public health, safety and welfare / ' in reference to plat control and land development and construc- , tion which can be reasonably expected to occur within a ' reasonable time in the area to be consolidated. 5. There is an existing and reasonably anticipated nelled of governmental services, such as, but not limited to, sewage ' disposal and fire protection in the area to be consolidated. 6. The Township form of government is not adaquate to cope with the problems of urban or suburban growth of the Town of Chanhassen. ' 7. The area to be consolidated can feasibly and practically provide for, and best serve, the noed for governmental service ' ..presently. and as they become necessary within said area. $. The name of the new municipality shall be the Village of Chanhassen. 9. The plan of government shall be Optional Plan "A". 10. The first election of officers in the new village shall be held on the seventh Tuesday after the date on which it shall have come into existence. ' 11. Affidavits of candidacy for the election of new village officers shall be filed with the Clerks of the Town of Chanhassen and Village of Chanhassen but shall otherwise be as provided by law for village elections. On Monday, October 8, 1990, the Board of Adjustments and City Council discussed procedures concerning the handling of variances II relative to appeals of Board of Adjustment decisions to the City Council. The Board of Adjustment is established as a group that can approve or deny variance applications. They are the final word on these applications unless their actions are appealed to the City I Council. Over the past several years, there have been a number of appeals of Board decisions made by one member of the City Council to the extent that it became regular practice to automatically I schedule review of variance applications by the City Council on the same night that they are acted upon by the Board of Adjustments. This causes several problems. The first is that it is somewhat subverts the intent of the Board of Adjustments which is to approve I or deny the variance by automatically assuming that the Council will review each action. This is not required by law and could lead to an extensive and unwarranted workload for the City Council. I The second problem concerns the applicants themselves. The applicants attend the Board of Adjustment's meeting at 7:00 p.m. and they are often forced to wait around until 10:00-11:00 p.m. I only to find that the City Council reapproved their variance anyway. As noted above, the intended procedure by ordinance is that the I Board approves or denies a request and that anyone aggrieved by the action has 10 working days to appeal the variance. The procedure agreed to by the City Council will do the following: I1. The Board of Adjustments will act on a variance request in the normal manner. I 1 • Variance Procedure October 10, 1990 ' Page 2 2. Any person aggrieved by this decision, including the ' applicant, area residents or members of the City Council, would have 10 working days to file an appeal of the decision. The variance will not go into affect until the 10 working day time period has expired. 3. If an appeal of the decision is received in writing during the ten day time frame, action on the variance will be scheduled ' for the next available City Council meeting. This will allow staff to prepare any additional findings necessary for City Council review and to provide the City Council with the ' minutes of the Board of Adjustment meeting. 4 . To keep the City Council informed as to Board of Adjustment actions, the City Council will receive a Board of Adjustment packet with their regular City Council packet. This will replace the inclusion of Board of Adjustment items in the regular City Council agenda. Additionally, copies of the ' Board of Adjustment minutes will be given to the City Council in their packet along with minutes of Planning Commission and Park and Recreation Commission meetings. ' We hope that this revised procedure can eliminate some confusion and make this process easier for applicants and residents alike. BOX 147 • CHANHASSEN, MINNESOTA 55317 (612) 937-1900 • FAX (612) 937-5739 1 MEMORANDUM 1 TO: Paul Krauss, Planning Director FROM: Charles Folch, Assistant City Engineer 1 DATE: October 16, 1990 SUBJ: Intersection Evaluation of Orchard Lane and Oriole South 1 of TH 7 PW070-A-4 ' During the public hearing on the conditional use permit for PJ's Restaurant at the October 3 , 1990 Planning Commission meeting, Jan Reed, a local resident, expressed a concern for the signage ' at the intersection of Orchard Lane and Oriole just south of TH 7. At your request, I have conducted a field evaluation of this intersection. ' Current signage at the site consists of a yield sign for northbound traffic on Oriole at Orchard Lane, a dead-end sign for 1 southbound traffic on Oriole just south of Orchard Lane, a 30 mph speed limit sign for southbound traffic on Oriole north of Orchard Lane, and standard street name signs at the southwest corner of Oriole and TH 7 and the southwest corner of Oriole and 1 Orchard Lane. It is presumed that the concern raised relates to southbound 1 traffic on Oriole coming off of TH 7 conflicting with the northbound Orchard Lane traffic. Both of these movements are currently unrestricted. Thus, the direction having right-of-way is not clearly defined. 1 The inherent features of this intersection create some difficulties in determining the proper solution. Oriole, south of Orchard Lane, is considered the minor traffic leg of this intersection and thus, would commonly be the segment chosen to control . However, doing so would still not define the previously 1 mentioned right-of-way movement issue. Orchard Lane is considered the major traffic leg of the intersection. However, it intersects Oriole on a down grade and at a skew. Therefore, it would seem more appropriate to control movements from this leg of the intersection. 1 1 Paul Krauss October 16 , 1990 Page 2 In discussing this matter with City Engineer Gary Warren, it was our consensus that the appropriate solution to eliminating future right-of-way confusion by motorists and the associated hazard at this intersection is to install a stop sign for northbound traffic on Orchard Lane at Oriole and remove the existing yield sign for northbound Oriole traffic at Orchard Lane. This configuration will allow full right-of-way for northbound Oriole and southbound Oriole traffic coming from TH 7 and continuing south on Oriole or turning west on Orchard Lane. This stop sign I is warranted at this intersection based on the premises that the application of the normal right-of-way rule is unduly hazardous at this intersection.
