Re: McGlynn Footings
IIDear Mr. Harri:
You have contacted me asking if there was any possible means by
I which staff could administratively allow the construction of
footings for a new 52, 000 sq. ft. addition for McGlynn in advance
of the site plan being reviewed by the Planning Commission and City
Council. You further stated that Mr. McGlynn recognizes that if
1 footing construction were to start and the new site plan was not
approved by the Planning Commission/City Council, that removal of
such would be solely at McGlynn's expense and the construction of
1 such would not be used as a reason for why the item needs to be
approved. Further, you stated that this early construction was
necessary if the new structure is to be enclosed so that interior
Iwork can be completed during the winter.
Planning staff agrees that there is little likelihood that the
proposed addition will be denied and/or modified so as to harm
I early construction of footings. We also concur that the 70 acres
of land owned by McGlynn equates to little or no chance of parking
or other site requirements not being able to be accommodated with
I or without the footing construction. Although it is unlikely that
your application will be denied, staff is also sensitive to the
potential statement that by staff authorizing footings, why should
I the Planning Commission or City Council look at it at all - staff
has effectively undermined the Planning Commission's/Council 's
authority.
I As stated earlier, McGlynn definitely has been a positive business
within our community. Any way in which we can help McGlynn grow
and be a more vital part of our community should be pursued. I
I would suggest a compromise. The item will be placed on to the
Planning Commission agenda for November 7th. I see their vote as
being critical and one which will more likely include specific

conditions which may affect the footing construction. The Planning 1
Commission agenda is also being sent to the City Council.
Accordingly, they will have received the proposal prior to their
meeting on Monday, November 5, 1990. As that agenda is relatively
light, I should have an opportunity to verbally discuss this issue
with the Council. I will attempt to achieve their agreement that
the technical conditions should be responded to by the Planning
Commission and, unless someone objects Monday evening, that staff
can authorize a conditional approval of footings following the
Planning Commission review on November 7th. The item would still
appear on the City Council agenda of November 19th for final
consideration and potential amendment of all other (non-footing)
conditions.
Please notify me as soon as possible as to McGlynn's reaction to 1
this proposal.
