The notice is required by a change in state statute. The form will show that potential tax increases may occur from the City (16% increase) , the County (11% increase) and the school (9% increase) . The form is misleading as: 0 The City Council has not adopted the tax level shown. By contrast, the Council has stated that there will not be a tax increase in 1991; and 1 o The amount shown in the form is the City's levy limit as set by the state. Any city publishing a tax less than the state maximum will have their taxes reduced to that lower level for all 11 following years. However, in the past ten years the City has never taxed to the maximum level. The City will not tax to this maximum for 1991; and o The City's budget hearing dates have been set for December 3 and 10, 1990. As of this date, neither city staff nor the City Council know what level of tax will be set for 1991. However, a preliminary budget has been drafted which reflects no property tax increase. The points presented in this notice pertain 11 solely to the City of Chanhassen, although we believe that they are also true for the county and school district. It was concluded that the City would be willing to allow Shafer' s vehicles to use eastbound West 78th Street and Market Boulevard for their haul route from the bridge embankment fill site with the understanding that your drivers will adhere to the 30 mile per hour speed limit in this area and with the further understanding that Shafer will see to it that the roadway is kept 11 clean of all haul material . Any damages to City utilities and curbings and/or excessive amounts of debris deposited in our storm sewer system resulting from the hauling activity will be corrected by Shafer at the conclusion of the project at no expense to the City. Similarly, on Lake Drive East the City is happy to permit the continued use of this road by Shafer as a haul road providing the road is kept clean and any damage repaired including storm sewer debris removed. You also agreed that County Road 17 and the intersection of West 78th Street would be swept clean. My recent inspection of the site on Friday afternoon confirmed that this has already been done. Thank you. Further, it was concluded that since the use of water on your dirt haul road will in all likelihood aggravate the transport of clay materials from the site, it was thought best that a calcium chloride treatment be done on this haul road to keep the dust down and solidify the haul road surface. This should help to control mud during periods of precipitation as well as dust. The American Lung Association of Minnesota is to be commended for their support of programming such as ours, and we certainly appreciate the personal assistance provided by you. Attached please find copies of newspaper articles that appeared during the week of October 14-20. Our Building Inspection Department then fielded calls that we received in response to this publicity. Both the City Council and the Public Safety Commission received their alpha track detectors, along with t-shirts, bumper stickers, magnets, hats, etc. , and Building Official Steve Kirchman will be following up with them when it is time to have their radon detectors analyzed. Information that you provided to us in the form of literature and other adver- tising material was distributed aggressively by our staff. I do believe it is fair to say that all of our 12,000 residents were exposed to the informatio. 'n one form or another. For that, we all thank you! City of Chanhassen IIDear Paul: 1 As you know, Moon Valley has commenced a declaratory judgment action against the City contending that the City does not have the right to regulate it. You asked me to outline the probable course 1 of the litigation. 1. Venue. The plaintiff has filed the suit in Hennepin County. We are attempting to have it moved to Carver County. The 11 judge who has been assigned the case is out of town for three weeks. We will probably have an answer to this issue in six weeks. We will take no further action until this is resolved. II2. Motion to Dismiss. We intend to file a motion to dismiss arguing that the Complaint failed to state a cause of action. If the motion is unsuccessful, discovery and a trial will follow. I3. Counterclaim. The City's new mining ordinance gives operating mines six months to apply for a permit. The six month 1 period will run out on November 25, 1990. Apparently Mrs. Wegler has a lingering illness and had a severe attack this past Saturday evening. Family members contacted 911 and were deeply concerned with her life. Response occurred within 2-3 minutes by the Carver County Sheriff's Department, Waconia Paramedics and the Chanhassen Fire Department. The Wegler family ' was thoroughly impressed with the professionalism shown by all three departments and the coordinated efforts that each provided. Councilman Workman asked that I pass this compliment on to the ' Carver County Sheriff's Department, Chanhassen Fire Department and Waconia Paramedics. In fact, the service has reduced complaints in City Hall considerably and solved several long-standing animal control problems. II The character and demeanor of your Officers is as much - or more - of an asset as the patrol itself. The Shorewood City Council and staff are 100% behind the program and sincerely hope the City of II Chanhassen continues to provide the service through the contract term, at least. IIThis financial proposal conforms to the format outlined in the Request for Proposal and Scope of Services dated (revised) October 2, 1990. The major scope changes from an earlier' edition lie in the areas of traffic signals, landscaping, utilities, and CADD. For the purposes of this agreement, computer-related costs have been applied to the overhead rate which is subject Ito post-project audit. Attached is a graphic which depicts the key personnel assigned to this project. Many of the staff assigned to this project have been involved in the I other TH 5 projects to the east.
