BOX 147 • CHANHASSEN, MINNESOTA 55317 ' (612) 937-1900 • FAX (612) 937-5739 MEMORANDUM TO: Don Ashworth, City Manager ' FROM: Paul Krauss, Planning Director DATE: January 4 , 1990 ISUBJ: Provision of Utilities and Access to a Proposed Subdivision and/or Potential Annexation of Land Located on the Chanhassen/Victoria City Line Staff has been contacted regarding a potential subdivision of 8 single family lots located primarily in Victoria but partially in Chanhassen. Of the 8 lots, one would contain an existing home with the balance being available for new development. One of the ' new lots would be located in Chanhassen. The site is located north of Hwy. 7 and south of the old Chicago, Northwestern Railway line off of Pipewood Curve. Staff has spoken with both Curtis Oakes, Victoria City Planner and with the potential deve- lopers of the property regarding the subdivision. Staff is seeking direction from the City Council in how to proceed with this proposal. The site is situated in such a way that the sole means of access would be via Pipewood Curve to Hwy. 7. Pipewood Curve is an undersized Chanhassen street that has a fairly poor intersection with Hwy. 7. In addition, Victoria is unable to provide and water service to the property due to the distance and location of lines within that community. Therefore, Victoria will be requesting that access, water and sewer services be provided through the City of Chanhassen. In reviewing this proposal, we concluded that an alternative might be consideration of annexation of the parcel should the owner ' petition the City to do so. Staff is unsure as to how to proceed. We recently provided services to a parcel located in Shorewood where annexation does not appear to have been con- ' sidered. With regards to this plat, it does appear to be possible to provide services into this area, although a final determination could not be made until engineering plans have been prepared for review by our City Engineer. In addition, Pipewood Curve could be improved at the developer' s expense to provide access for the additional home sites. On the other hand, it is not possible to access this property from Victoria and situations of this type present problems for provision and maintenance of I I Mr. Don Ashworth 11 January 4 , 1990 Page 2 ' utility services, billing of utility services, street main- tenance, street plowing provision of emergency services and related matters . To a certain extent these problems could ' possibly be addressed through a contractual agreement such as a development contract that was used in the Shorewood situation. Again, staff is seeking direction of the City Council and will ' communicate your response to the developer and to the City of Victoria. Manager' s Comments: I see this request as being totally dif- ferent than some of the sewer/water agreements previously entered into with the City of Shorewood. Most of those instances involve ' an individual lot, with the City not potentially faced with having to enter onto private property in another City, coordinate sewer/ water/street construction, etc. This example more closely parallels the Volk subdivision process, i .e. in the Volk instance, the City of Chaska would be providing snow plowing, street sweeping, roads/sewer/water construction. It is also similar in that, in the Volk instance, the City of Chanhassen ' did not have the capability of providing sewer and water to the property.
