ISUBJ: Appointment to Housing and Redevelopment Authority
IStaff was directed at the last City Council meeting to ask the City
Attorney to provide an opinion in regards to a City Council member
I being appointed to the HRA, and, if appointed, could that member's
term coincide with their term ,=of office on the City Council.
Attached you will find the City Attorney's response which states
that "the terms can be made to coincide".
IUnder the Minnesota Housing and Redevelopment Authority Act, the
Mayor is responsible for appointing a new commissioner to the HRA,
1 with City Council approval.

RE: Appointment of HRA Commissioners
Dear Don: 1
At the last City Council meeting the question was asked if ,
the term of a City Council member appointed to the HRA could be
made to coincide with the term of office on the City Council. The
term can be made to coincide. Minn. Stat. § 469.004, Subd. 6
provides:
I
Appointment; approval; term; vacancy. The commissioners
shall be appointed by the mayor, with the approval of the I
governing body. Those initially appointed shall be appointed
for terms of one, two, three, four, and five years.
respectively. Thereafter all commissioners shall be
I
appointed for five year terms. Each vacancy in an unexpired
term shall be filled for the remainder of the term for which
the original appointment was made. Any member of the
governing body of a city may be appointed and may serve as a II commissioner of the authority for the city. The council of
any city which appoints members of the city council as
commissioners may set the terms of office of a commissioner I
to coincide with the commissioner's term of office as a
council member. -
