SUBJ: Consider Water Service Connection to 23115 Summit Avenue

Mr. Larry Schmidt, resident at 23115 Summit Avenue, is requesting
11 water service from the City of Chanhassen. Mr. Schmidt's pro-
perty borders the city limits between Shorewood and Chanhassen.
This parcel is unable to be serviced with utilities from
I Shorewood and as such, the owner is requesting the City' s per-
mission to tap into the City' s watermain on Hummingbird Road.
The City' s watermain currently deadends at the city limits on
Hummingbird Road.
IIAs noted on the attached Water Connection Agreement, the City of
Shorewood has no objection to Chanhassen providing water service
II to this parcel. The typical water connection charges and useage
fees would be collected from this parcel even though they are
located in the city of Shorewood.
1 It is therefore recommended that the City Council approve of the
water connection to 23115 Summit Avenue with the following con-
ditions:
II1. The resident shall comply with the terms set forth in the
Water Connection Agreement prepared by the City of Shorewood
1 dated May 15, 1990.
2 . The resident shall pay the City of Chanhassen a typical water
I connection charge and useage fees in conjunction with permit
fees to connect to the City's watermain.
3. Any expense for connecting the sewer to the City' s watermain
IIshall be bore by the property owner.
4. The property owner will not be entitled to any rebate of con-
, nection charges from the City of Chanhassen should the City of
Shorewood eventually extend water service to this property.

5. Work within the public right-of-way and the connection to the
City' s watermain shall be completed by a contractor approved
' by the City of Chanhassen and shall be coordinated with the
City' s utility superintendent.
' 6 . The property owner shall provide the City with financial
security in the amount of $2,000.00 to guarantee street
restoration ( i.e. Letter of Credit, or cash escrow) .

THIS AGREEMENT, made this I5 day of , 1990, by and
between the CITY OF SHOREWOOD, a municipal corporation, ( e "City")
and L.P.-P12-41 S -M i i of 2.311S ckrtnmi± Av. , Shorewood,
Minnesota, (the "Owner").
' WHEREAS, Owner is the owner of certain real property (the "Owner
Property") located in the City of Shorewood, County of Hennepin, State of
Minnesota, described in Exhibit A, attached hereto and made a part hereof;
' and
WHEREAS, the City owns a municipal water system which does not
presently serve the Owner Property; and
WHEREAS, the Owner desires to interconnect with the Chanhassen
' Municipal Water System and pay to the City of Chanhassen a connection charge
therefor; and
WHEREAS,. the City is willing to permit Owner to connect to the
Chanhassen Municipal Water System provided that Owner agrees to the
provisions contained herein.

NOW, THEREFORE, in consideration of the mutual contained
covenants herein, the parties agree as follows:
1. Owner shall have the right to interconnect with the
Chanhassen Municipal Water System and pay to the City of Chanhassen a
connection charge therefor.
' 2. All work involved in such interconnection will be done
according to City specifications and under City supervision and all
' expenses and costs connected therewith will be paid by Owner. Owner
-further agrees to convey all necessary easements and donate all watermains
to City after completion of the project.
' 3. In the event that City extends the Shorewood municipal
water system to serve the Owner Property at some time in the future, Owner
agrees to pay any assessment in connection therewith on the same basis as
' all other properties assessed at that time, and Owner herewith
specifically agrees to waive any claims or defenses to said assessment
based upon a theory of no benefit because of the water connection allowed
herein.
4. It is further agreed by and between the parties that this
Agreement shall run with the land and shall benefit and be binding upon
their respective legal representatives, successors and assigns.
