'}. 1. The final plat shall provide far a roadway easement dedication I of 27 feet on both sides of T. H. 101 and 17 feet on the south side of County Road 14,. east of T. H. 101. II 2. What was shown as Outlot A on the June 1, 1987, preliminary plat shall be deemed as a roadway easement. 3. Provision of a 20 foot trail easement for off street trails Ialong both sides of T. H. 101 and `County Road 14. 4. Drainage and utility easements shall be dedicated as necessary 1 for placement 'of all utility improvements. Staff does not let the mylars be signed and released until all of the conditions. II of final plat approval have been met. The applicant is agreeing to comply with all of the conditions of approval except for Condition #1 where he is required to provide the roadway easements and I dedication of 27 feet on both sides of T. H. 101. .The 17 feet on the south side of County Road 14 has already been provided for with the improvements to County Road 14. H. 101 until MnDOT agrees to pay for the trees located within the easement that are part of the Halla Nursery. Staff has been speaking with MnDOT and our Engineering Department ' and both feel strongly that the easements should still be required. It is unknown when improvements to TH 101 in this area will be made in the future. It is also unclear whether or not jurisdiction will ' remain with MnDOT or if TH 101 will come under the jurisdiction of the County or even the City. In either case, it is important that easements for such improvements are maintained. As the City Council is aware, when a property is platted, that is the time for the City to acquire easements that will be necessary for future roadway improvements. It would not be prudent of the City to allow Condition #1 to be removed from final plat approval. ' As a note, it should be pointed out that Condition #2 of final plat approval requires that Outlot A as shown on the June 1, 1987, ' preliminary plat shall also be deemed as a roadway easement. This will also be required to be provided before the mylars are recorded with Carver County. ' RECOMMENDATION Staff recommends that the City Council require the applicant to ' provide the conditions as approved with the original final plat approval and that the plat cannot be recorded with Carver County until all conditions have been provided to and approved by staff. Box 147 Chanhassen, MN 55317 RE: C.S. 1009 (T.H. 101) Plat for Great Plains Golf Estates Dear Ms. Olson:. I understand Rick Dalton has been talking to you and Don Halla of Halla Nurseries about this plat over the past week. I thought I would send you a short letter stating our position on T.H. 101 in this area. In January of 1987, Mn/DOT commented to the City on this plat as part of the normal plat review process. In that letter, we noted that we have no long range plans for T.H. 101 in this area other than to turn it back to local jurisdiction. We saw a need for a major north/south roadway to serve the needs of the local area, and therefore suggested that an additional 27 feet of right of way either side of the existing right of way be dedicated to roadway use. Our position remains the same now as it was in 1987. We still believe that at some point T.H. 101 will need to be widened. We do not have, nor do we plan any projects on T.H. 101 to widen the roadway. At some point, we will most likely turn the highway back to the city or county. The city or county may wish to upgrade T.H. 101. It is not unusual to request landowners along highways to dedicate property to serve traffic their development will generate when plats are being revised. Mn/DOT does not reimburse property owners for these dedications, either for the land or items on the land. We agree with the position you have taken, asking for the 27 feet of highway dedication on either side of the existing T.H. 101 right of way.
