Poor soils were discovered on the site which has been compounded by the wet construction season and has necessitated the subgrade excavation. Although the original development contract required that all subgrade 1 correction work be performed by the developer, they requested that the City entertain including this work under the City improvement project and the cost to be assessed back against the Iproperty. A letter is on file stating this fact. The attached contract amendment has therefore been prepared to I include the subgrade excavation in the amount of $12 ,150 and select granular borrow in the amount of $20, 950 for a total additional of $35 ,100 . I find this change order is acceptable and consistent with the terms of the development contract between I the developer and the City. It is therefore recommended that Contract Amendment No. 1 to Improvement Project No. 89-25 be accepted in the amount of an add of $35 ,100 and an amended I contract ceiling amount be authorized at $324,037. 95. The contract amendment has been prepared I as requested by the developer of the site to include subgrade excavation and the placement of select granular borrow material , as required for subgrade correc- tion, as a part of the site improvement contract. IThe original development contract required that all subgrade correction work would be performed by the Developer as a part of the site grading for the pro- • II ject. It is our understanding that at the request of the Developer, the City has agreed to include the subgrade excavation and select granular borrow work as a part of the site improvement contract with the costs being assessed back to the benefitting property.
