MEMORANDUM
1 TO: Mayor and City Council
FROM: Don Ashworth, City Manager A IL°
I DATE: July 23, 1990
1 SUBJ: Visitor Presentations, Petition for Enforcement of Water
Surface Usage Ordinance, Lotus Lake Homeowners
Association
II
Attached please find a petition received from homeowners on Lotus
I Lake asking to make a presentation before the City Council. The
request is confusing in that previous requests have been to the
affect of changing Chanhassen's ordinance to prohibit or be more
restrictive in regards to ski jets. To the best of my knowledge,
I we are enforcing the ordinance as it exists. The Public Safety
Director has addressed some of these issues as a part of his t
memorandum included in the administrative presentation pursuant to
II a previous request from Councilmember Jay Johnson. In regards to
the request to modify the ordinance to specifically include brand
names of ski jets, such is not required as both the public
I safety/attorney's office agrees that the current definition does
include ski jets regardless of brand name.
This office would recommend that the City Council allow for the
1 presentation as requested and determine whether future action is
possible or not.

With this petition we, the undersigned Lotus Lake lakeshore homeowners, I
request that the City of Chanhassen diligently enforce the Surface Water
Use Ordinance #73, Article III, to promote safety and reduce noise dis-
turbance. We further request that the Definition of Motorboats (Ordinance
#73, Article I, Sec. 6-1) be clarified for the record to include personal
watercraft, known by such brand names ay Jet-Ski, Wave Runner, Wet Bike,
Wet Jet, Sea Doo, etc. , thereby requiring personal watercraft to adhere
to the rules and regulations stated in Ordinance #73.
